DATE: November 14, 2007
SUBJECT: City Council Meeting - November 20, 2007
ITEM: *10D1. Consider an ordinance annexing 6.34 acres of Red Bud Lane right-of-way
located north of CR 117. (First Reading)
Department: Planning and Community Development
Staff Person: Jim Stendebach, Planning and Community Development Director
Lee Heckman, Principal Planner
Justification:
The tract of land, known as N. Red Bud Lane, Tract 1, consists entirely of platted public right-of-
way. The tract contains approximately 6.34 acres and abuts previously annexed rights-of-way;
this right-of-way was conveyed to the City of Round Rock in accordance with the Paloma Lake
Consent Agreement previously adopted by the City Council. It is the City's desire to annex this
tract in order to bring City-owned rights-of-way into the city limits, and to meet the terms of that
Consent Agreement.
Funding:
Cost: N/A
Source of funds: N/A
Outside Resources: N/A
Background Information:
This tract of land is located within the City of Round Rock's ETJ in Williamson County. The tract actually
consists of three platted lots, each of which was conveyed by deed to the City of Round Rock. A portion
of one of these lots was previously annexed into the city limits at the time the involuntary annexation of
the 270-acre Burge, Gordon, Madsen, et al Tract was approved by Council in 2006. Consequently, there
is a middle section of N. Red Bud Lane right-of-way that is excluded from this annexation tract.
Related, all of the property in this annexation tract was previously incorporated into the Paloma Lake
Municipal Utility Districts. Earlier this year, the southern portion of the tract was excluded from Paloma
Lake MUD No. 1, and the northern portion was excluded from Paloma Lake MUD No. 2. Because of this
release and exclusion, the City may now properly annex the tract and meet the terms of the Consent
Agreement.
The Consent Agreement calls for additional conveyance to, and City annexation of, rights-of-way
property. As there will be additional N. Red Bud Lane annexation, this has been designated as Tract 1.
Public Comment:
Public notice is not required for voluntary annexation, in accordance with Section 43.028 of the
Texas Local Government Code.
