WHEREAS, on February 8, 2007, the City of Round Rock entered into
an Interlocal Agreement Regarding Ancillary Consulting Services for
Regional Water System ( "Agreement") with the City of Cedar Park and the
City of Leander ("Parties") , and
WHEREAS, pursuant to the Agreement, the City and Parties wish to
enter into a Memorandum of Agreement to approve the Client Additional
Services Authorization, dated November 14, 2007, between the Project
Consultant and the City of Cedar Park, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a Memorandum of Agreement with the City of Cedar
Park and the City of Leander, a copy of same being attached hereto as
Exhibit "A" and incorporated herein for all purposes .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

Justification:
Lockwood, Andrews & Newnam, Inc. (LAN) has been working on acquiring the necessary
easement and land for the Regional Water System, Phase I Improvements. They have
successfully negotiated two contracts for the acquisition of the Water Treatment Plant Site.
These additional services are for the work required to acquire 14 additional temporary
construction easements; 59 appraisal reports; obtain owner and encumbrance reports from
title company; obtain survey services for annexation, zoning, and platting; obtain surveys
for PEC and access easements on WTP site; project management, attending public
meetings, Design Oversight Committee (DOC) meetings, and miscellaneous real estate
related issues. The total fee for this additional work is $209,690.00 with the City of Round
Rock's portion being $80,856.46. This amount is based on Round Rock's allocation of
38.56% of the capacity in the regional system. The DOC and City-staffs recommend
execution of these additional services for LAN.
Funding:
Cost: $80,856.46
Source of funds: Capital Project Funds (Self-Financed Utility)

Lockwood, Andrews & Newnam, Inc. (Engineering Consultant)
Background Information:
The original and current contract with LAN is for engineering design services for the Treated
Water Transmission Line, Segment 1 which includes land and easement acquisitions. LAN is
providing the easement and land acquisition services for the successful completion of all of
the Regional Water System, Phase I Improvements.
