AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF ROUND ROCK, TEXAS ADOPTED IN SECTION 11.401(2)(a),
CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK,
TEXAS, AND MAKING THIS AMENDMENT A PART OF THE SAID
OFFICIAL ZONING MAP, TO WIT: TO REZONE 9.564 ACRES OF
LAND, OUT OF THE P.A. HOLDER SURVEY, ABSTRACT NO. 297,
IN ROUND ROCK, WILLIAMSON COUNTY, TEXAS, FROM
DISTRICT SF-2 (SINGLE FAMILY - STANDARD LOT) TO DISTRICT
PF-3 (PUBLIC FACILITIES - HIGH INTENSITY).
WHEREAS, an application has been made to the City Council of
the City of Round Rock, Texas to amend the Official Zoning Map to
rezone 9 . 564 acres of land, out of the P.A. Holder Survey, Abstract
No. 297, in Round Rock, Williamson County, Texas, being more fully
described in Exhibit "A" attached hereto, from District SF-2
(Single Family - Standard Lot) to District PF-3 (Public Facilities
- High Intensity) , and
WHEREAS, the City Council has submitted the requested change
in the Official Zoning Map to the Planning and Zoning Commission
for its recommendation and report, and
WHEREAS, the Planning and Zoning Commission held a public
hearing concerning the requested change on the 12th day of December
2007, following lawful publication of the notice of said public
hearing, and
WHEREAS, after considering the public testimony received at
such hearing, the Planning and Zoning Commission has recommended
that the Official Zoning Map be amended so that the property
described in Exhibit "A" be zoned District PF-3 (Public Facilities
- High Intensity) , and

WHEREAS, on the 24th day of January, 2008, of ter proper
notification, the City Council held a public hearing on the
requested amendment, and
WHEREAS, the City Council determines that the zoning provided
for herein promotes the health, safety, morals and protects and
preserves the general welfare of the community, and
WHEREAS, each and every requirement set forth in Chapter 211,
Sub-Chapter A. , Texas Local Government Code, and Section 11 . 300 and
Section 11 . 400, Code of Ordinances (1995 Edition) , City of Round
Rock, Texas concerning public notices, hearings, and other
procedural matters has been fully complied with, Now Therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND
ROCK, TEXAS:
I.
That the Official Zoning Map adopted in Section 11 .401 (2) (a) ,
Code of Ordinances (1995 Edition) , City of Round Rock, Texas, is
hereby amended so that the zoning classification of the property
described in Exhibit "A" is hereafter designated as District PF-3
(Public Facilities - High Intensity) .
II.
A. All ordinances, parts of ordinances, or resolutions in
conflict herewith are expressly repealed.
B. The invalidity of any section or provision of this
ordinance shall not invalidate other sections or provisions
thereof .

C. The City Council hereby finds and declares that written
notice of the date, hour, place and subject of the meeting at which
this Ordinance was adopted was posted and that such meeting was
open to the public as required by law at all times during which
this Ordinance and the subject matter hereof were discussed,
considered and formally acted upon, all as required by the Open
Meetings Act, Chapter 551, Texas Government Code, as amended.

AN ORDINANCE PROVIDING FOR THE EXTENSION OF. CERTAIN
BOUNDARY LIMITS OF THE CITY OF ROUND ROCK, TEXAS,
AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING
OF 60.6 ACRES OF LAND, WHICH SAID TERRITORY LIES
ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS
OF THE CITY OF ROUND ROCK, TEXAS.
WHEREAS, a public hearing before the City Council of the
City of Round Rock, Texas where all interested persons were pro-
vided with an opportunity to be'heard on the proposed annexation
of the property described in Exhibit "A" attached hereto and made
a part hereof, was held on the 12 day of October 19 78
which date is not more than twenty days nor. less than ten days
prior to the institution of annexation proceedings; and
WHEREAS, notice of such public hearing was published in a
newspaper having general circulation in the City of Round Rock,
Texas on the 28 day of September , 1978 , which date is
not more than twenty nor less than ten days prior to the date of
such public hearing; and
WHEREAS, the territory lies adjacent to and adjoins the present
boundaries of the City of Round Rock, Texas; and
WHEREAS, all requirements of the laws of the State of Texas
and the Home Rule Charter of the City of Round Rock have been com- .
plied with, and
WHEREAS, the territory above described contains 60.6 acres;
now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
Section 1. The land and territory, described in Exhibit "A",
which is attached hereto and made a part hereof, lying adjacent to
and adjoining the present boundaries of the City of Round Rock,
Texas is hereby added and annexed to the City of Round Rock, Texas.,
and said territory hereinafter described shall hereafter be included
within the boundary limits of the City of Round Rock, Texas, and
the present boundary limits of such city, at the various points con-
tiguous to the area hereinafter described, are altered and amended
so as to include said area within the corporate limits of the City
of Round Rock, Texas. .
Section 2. The above described territory and the area sd
annexed shall be a part of the City of Pound Rock, Texas, and
the inhabitants thereof, if any, shall be entitled to all of
the rights and privileges of all the citizens and shall be
bound by the acts, ordinances, resolutions and regulations of
the City of Round Rock, Texas.

60.6 acres of land, same being out of and a part of the Prior A. Holder
Survey in Williamson County, Texas, which 60.6 acres of land are more par-
ticularly described by metes and bounds as follows:
BEGINNING FOR REFERENCE at an iron stake found in the north line of U.S.
Highway 79, said stake also being at the southwest corner of that certain
13.07 acre tract of land as conveyed to Kelly Edgar and Ina May Ogletree
McAdams, by deed recorded in Volume 491, Page 593 of the Deed Records of
Williamson County, Texas, and from which corner the northwest corner of

Lutheran Church, to rezone 9.564 acres of land from SF-2 (Single

Intensity), located on the north side of East Palm Valley Blvd (US Hwy
79), east of North A. W. Grimes (CR 1460). Also known as the Palm

Justification:
The proposed PF-3 (Public Facility - High Intensity) District is located on the north side of
East Palm Valley Blvd (Us Hwy 79), east of North A.W. Grimes (CR 1460). The church,
cemetery and related uses utilize the site currently. While the church may operate under the
current single-family zoning designation the rezoning request will provide a contiguous
zoning district for the church property. The rezoning request, in conjunction with the
adjacent voluntary annexation and original zoning request, allows the church to continue
operations within city limits. The request complies with the General Plan.

Background Information:
This tract of land is located within the City of Round Rock's ETJ in Williamson County. An
original zoning request and a rezoning request for the tract of land is also on the January

Rock's Zoning Ordinance at the Planning and Zoning Commission meeting on December 12,
2007. No public comments were received.
