G-08-03-06-8C1 - 3/6/2008 ORDINANCE NO. �-� - AN ORDINANCE AMENDING CHAPTER 3, SECTION 3.105, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING PERMIT FEES; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 3 , Section 3 . 105, Code of Ordinances (1995 Edition) , City of Round Rock, Texas, is hereby amended to read as follows : 3.105 PERMIT AND INSPECTION FEES (1) Residential Construction (a) For all new residential construction, a permit fee for each building shall be paid at the time of filing the permit application, in accordance with the following schedule: (i) For single-family residential construction $285.00 (ii) For duplex residential construction $320.00 (iii) For townhouse and multi-family construction $60.00 plus eight cents ($0.08) per square foot of floor space. (b) For purposes of ensuring compliance with the City Fire Code, for all new multi-family construction and all new condominium construction, a fee in the amount of five cents ($0.05) per square foot of floor space shall be paid at the time of filing the permit application, said fee to be for review of building plans for compliance with Fire Code requirements and for initial in-field inspection of each building. , (2) Commercial and Office Construction (a) For all new commercial and office construction, a permit fee for each building shall be paid at the time of filing the permit application, as follows: $60.00 plus eight cents ($0.08) per square foot of floor space. (b) For purposes of ensuring compliance with the City Fire Code, for all new commercial and office construction, a fee in the amount of five cents ($0.05) per square foot of floor space shall be paid at the time of filing the permit application, said fee to be for review of building plans for compliance with Fire Code requirements and for initial in-field inspection of each building. 080228D2/ps (3) Industrial Construction (a) For all new industrial construction, a permit fee for each building shall be paid at the time of filing the permit application, as follows: $60.00 plus eight cents (0.08) per square foot of floor space. (b) For purposes of ensuring compliance with the City Fire Code, for all new industrial construction, a fee in the amount of five cents ($0.05) per square foot of floor space shall be paid at the time of filing the permit application, said fee to be for review of building plans for compliance with Fire Code requirements and for initial in-field inspection of each building. (4) Other Types of Construction (a) For all other types of new construction, a permit fee for each building shall be paid at the time of filing the permit application, as follows: $60.00 plus eight cents ($0.08) per square foot of floor space. (b) For purposes of ensuring compliance with the City Fire Code, for all other types of new construction, a fee in the amount of five cents ($0.05) per square foot of floor space shall be paid at the time of filing the permit application, said fee to be for review of building plans for compliance with Fire Code requirements and for initial in-field inspection of each building. (5) Other Permits (a) Any owner, authorized agent, or contractor who desires to enlarge, alter, remodel, repair, or change the occupancy of a building or structure, or to erect or construct a sign of any description, or to install or alter fire extinguishing apparatus, elevators, engines or to install a steam boiler, furnace, heater, incinerator, or other heat producing apparatus, or other appurtenances, or otherwise provide for a fixed improvement, the installation of which is regulated by this Code of Ordinances, shall pay a fee for each building permit as required at the time of filing application in accordance with the following schedule: Total Valuation Fees $2,000 and less $35.00 $2,001 to $15,000 $35.00 for the first $2,000 plus $7.00 for each additional thousand or fraction thereof, to and including $15,000. $15,001 to $50,000 $125.00 for the first $15,000 plus $4.00 for each additional thousand or fraction thereof, to and including $50,000. $50,001 to $100,000 $260.00 for the first$50,000 plus $3.00 for each additional thousand or fraction thereof, to and including $100,000. $100,000 to $500,000 $400.00 for the first $100,000 plus $2.00 for each additional thousand or fraction thereof, to and including $500,000. 2 $500,001 and up $1,200.00 for the first $500,000 plus $1.00 for each additional thousand or fraction thereof. (b) Any owner, authorized agent, or contractor who desires to enlarge, alter, remodel, repair, or change the occupancy of a building or structure, or to erect or construct a sign of any description, or to install or alter fire extinguishing apparatus, elevators, engines or to install a steam boiler, furnace, heater, incinerator, or other heat producing apparatus, or other appurtenances, or otherwise provide for a fixed improvement, the installation of which is regulated by the City Fire Code, shall pay a fee for the review of plans for compliance with Fire Code requirements and for the initial in-field inspection of the building at the time of filing application in accordance with the following schedule: Total Valuation Fees $2,000 and less $15.00 $2,001 to $15,000 $25.00 for the first$2,000 plus $1.50 for each additional thousand or fraction thereof, to and including $15,000. $15,001 to $50,000 $50.00 for the first $15,000 plus $1.25 for each additional thousand or fraction thereof, to and including $50,000. $50,001 to $100,000 $100.00 for the first$50,000 plus $1.00 for each additional thousand or fraction thereof, to and including $100,000. $100,000 to $500,000 $150.00 for the first $100,000 plus $0.65 for each additional thousand or fraction thereof, to and including $500,000. $500,001 and up $500.00 for the first$500,000 plus $0.35 for each additional thousand or fraction thereof. (c) The applicant for the permit shall include an amount for the Total Valuation, which shall be the total value of all construction work for which the permit is sought, including, but not limited to, all materials, labor, painting, roofing, electrical, plumbing, heating, air conditioning, and any other permanent equipment incorporated in the construction work. If the Building Official does not agree with the amount of the Total Valuation as submitted by the applicant, the Building Official shall determine the total cost using certified construction estimates or nationally recognized publications to determine the Total Valuation. If an applicant disputes the Total Valuation so determined by the Building Official, the applicant may appeal to the City Manager, whose decision regarding the Total Valuation shall be final. (6) Moving of Building or Structures For the moving of any building or structure, the fee shall be $50.00. (7) Demolition of Building or Structures For the demolition of any building or structure, the fee shall be $25.00. 3 (8) Failure to Obtain Permit Where work for which a permit is required by this Code of Ordinances is started or proceeded with prior to obtaining said permit, the fees herein specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code of Ordinances in the execution of the work nor from any other penalties prescribed herein. (9) Reinspection Fee Upon notification by the permit holder or his agent, the Building Official or the Fire Department shall make the necessary inspection and shall either approve that portion of the construction as completed or shall notify the permit holder or his agent of any violation of this Code of Ordinances. If upon reinspection a portion of the construction inspected is not approved, a fee of fifty dollars ($50.00) shall be paid for any subsequent reinspection of the construction not approved. (10) Structural Steel Inspection Fee For any type of construction where structural steel components will be included, the applicant for a building permit shall pay a Structural Steel Inspection Fee. The Structural Steel Inspection Fee shall be the greater of$100.00 or five cents ($0.05) per square foot of: (a) the total floor space contained within the steel frame, plus (b) the total area covered by, but not contained within the steel frame. Where the steel frame components are a minimal part of the construction being permitted and require no more than two (2) inspections as determined by the Building Official, the Structural Steel Inspection Fee shall be $100.00. The applicant shall be entitled to a refund of the Structural Steel Inspection Fee in the event no structural steel inspection is actually made. (11) Sprinkler System Inspection Fees (a) Sprinkler System Plan Review (i) For any type of construction which includes a fire sprinkler system, an inspection fee for the review of sprinkler plans, visual inspection, and hydraulic leak inspection of the system in the amount of sixty dollars ($60.00) for each riser plus two dollars ($2.00) for each sprinkler head in excess of 25 shall be paid at the time of filing the permit application. (ii) Upon notification by the permit holder or his agent, the Fire Department shall make the necessary inspection and shall either approve the fire sprinkler system plan as installed or shall notify the permit holder or his agent of any violation of the Fire Code. If upon inspection a portion of the fire sprinkler system inspected is not approved, a fee of fifty dollars ($50.00) shall be paid for any subsequent reinspection of the fire sprinkler system. (b) Partial Visual Inspection Fee For requests to visually inspect only a portion of a fire sprinkler system, rather than the entire system at once, an additional fee of $25.00 shall be paid for each partial inspection requested in addition to the initial sprinkler system plan review fee. 4 (12) Fire Systems Inspection Fee For any type of construction which includes a fire system other than a sprinkler system, including kitchen hood suppression systems and paint hood suppression systems, an inspection fee for the in-field visual inspection in the amount of fifty dollars ($50.00) per system shall be paid at the time of filing the permit application. (13) Alarm Plans Review and Inspection Fee (a) For any type of construction which includes a fire alarm system, a fee for plan review, including visual and audible in-field inspection, in the amount of sixty dollars ($60.00) for each panel plus one dollar ($1.00) for each device shall be paid at the time of filing the permit application. (b) Upon notification by the permit holder or his agent, the Fire Department shall make the necessary inspection and shall either approve the fire alarm system plan as installed or shall notify the permit holder or his agent of any violation of the Fire Code. If upon inspection a portion of the fire alarm system inspected is not approved, a fee of fifty dollars ($50.00) shall be paid for any subsequent reinspection of the fire alarm system. (14) Institutional Facility Inspection Fees (a) The Fire Department shall provide fire-prevention inspections of institutional facilities as requested. (b) Institutional Facility Inspection Fees shall be paid to the Fire Department at the time of the request as follows: (i) One dollar ($1.00) per bed for Hospitals/Nursing Homes; (ii) Fifty dollars ($50.00) for institutional facilities which require a day care or foster care license from the state. (15) No Refunds Except as provided in paragraph (10) above, after an application for a building permit has been made and the permit fee paid, there will be no refunds made by the City to the applicant. (16) Expired Permits Once a building permit has expired, the applicant must reapply for a new permit and pay all applicable fees. (17) Copies of Inspection Reports Additional copies of any inspection or fire report prepared by the Fire Department shall be made available for an additional charge of three dollars ($3.00). (18) Environmental Research Fee Requests to the Fire Department for environmental site research shall be subject to a fee to cover the cost of research and production, as follows: One hundred dollars ($100.00) plus thirty-five dollars ($35.00) per hour or fraction thereof after the first hour. 5 II. This ordinance shall become effective on the 1st day of April, 2008 . III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof . C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 3, Section 3.105 of the Round Rock Code of Ordinances regarding construction permit and inspection fees. (Second Reading) Department: Fire Staff Person: William Wusterhausen, Fire Marshal Justification: Staff recommends the amendment of Section 3.105 of the Code of Ordinances regarding fees. This ordinance will require fees to be paid for services provided by the Fire Marshal's office in regards to new construction. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: As a result of the public input from the 10 year plan, the public requested that services be paid for by those receiving the service. The Fire Marshal's office currently performs plan reviews, new construction inspections, and annual inspections for businesses requiring State License in the City. All these activities performed by the Fire Marshal's Office are required fire and life safety inspections, which are currently being paid for as part of the annual operating costs. As the City continues to grow and more construction occurs, the adoption of these fees will help keep operating expenses down so that the tax rates stay low for residents. Staff recommends the adoption of these fees to recover the costs involved with these activities. These fees are comparable to other cities who currently charge these fees throughout the State and locally.
