WHEREAS, the City of Round Rock, ( "City" ) has previously entered
into an Agreement Concerning Creation and Operation of The Meadows at
Chandler Creek Municipal Utility District ( "Agreement") dated May 10,
1984 whereby the City consented to the creation of the District, and
WHEREAS, the Agreement provides that the City must approve any
changes to Land Use Designations within the District, and
WHEREAS, the Apostolic Church, the owner of property within the
District has submitted a proposed amended Land Use Plan to the City for
its review and approval, and
WHEREAS, the District has consented to the proposed amended Land
Use Plan as submitted by the Apostolic Church, and
WHEREAS, the City, s Planning and Zoning Commission has reviewed
the Land Use Plan and has recommended its approval, and
WHEREAS, the City and the Apostolic Church desire to enter into
an Agreement and Development Plan for Lot 1, Block A, Meadows at
Chandler Creek, Section 25, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an Agreement and Development Plan for Lot 1, Block
A, Meadows at Chandler Creek, Section 25, a copy of same being attached
hereto as Exhibit "A" and incorporated herein for all purposes .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and

the subject matter hereof were discussed, considered and formally acted

AGREEMENT AND DEVELOPMENT PLAN FOR

THIS AGREEMENT and Development Plan is made and entered into by and between the
City of Round Rock, Texas, a Texas municipal corporation, having its offices at 221 East
Main Street, Round Rock, Texas 78664 (hereinafter referred to as the "City"), and the
Apostolic Church, (hereinafter referred to as the "Owner", whether one or more).
WHEREAS, the Owner has submitted a request to the City to amend a Land Use Plan
previously approved in an Agreement concerning Creation and Operation of the Meadows
at Chandler Creek Municipal Utility District, dated May 10, 1984, and
WHEREAS, on September 15, 2004, the City's Planning and Zoning Commission
recommended approval of the Owner's request to amend said Plan,
NOW THEREFORE BY THIS AGREEMENT WITNESSETH that, in consideration of the
covenants and conditions set forth herein, the City and the Owner agree as follows:
I.
GENERAL PROVISIONS
1. Conformity with Development Plan
All uses and development within the Property shall generally conform to the
Development Plan set forth in Section II herein.
2. Changes and Modifications
No changes or modifications will be made to this Agreement or the Development
Plan unless all provisions pertaining to changes or modifications as stated below
are followed.
3. Miscellaneous Provisions
3.1 Necessary Documents and Actions.
Each party agrees to execute and deliver all such other and further
instruments and undertake such actions as are or may become necessary or
convenient to effectuate the purposes and intent of this Agreement.

3.2 Severability.
In case one or more provisions contained herein are deemed invalid, illegal
or unenforceable in any respect, such invalidity, illegality or unenforceability
shall not affect any other provisions hereof and in such event, this
Agreement shall be construed as if such invalid, illegal or unenforceable
provision had never been contained herein.
3.3 Entire Agreement.
This Agreement constitutes the entire agreement of the parties and
supersedes any prior or contemporaneous oral or written understandings or
representations of the parties respecting the subject matter hereof.
3.4 Applicable Law.
This Agreement shall be construed under and in accordance with the laws of
the State of Texas.
3.5 Venue.
All obligations of the parties created hereunder are performable in
Williamson County, Texas and venue for any action arising hereunder shall
be in Williamson County.
3.6 No Third Party Beneficiaries.
Nothing in this Agreement, express or implied, is intended to confer upon any
person or entity, other than the parties hereto (and their respective
successors and assigns), any rights, benefits or remedies under or by reason
of this Agreement.
3.7 Duplicate Originals.
This Agreement may be executed in duplicate original, each of equal dignity.
3.8 Notices.
Until changed by written notice thereof, any notice required under this
Agreement may be given to the respective parties, by certified mail, postage
prepaid or by hand delivery to the address of the other party shown below:

3.9 Effective Date.
This Agreement shall be effective from and after the date of due execution
hereof by all parties.
3.10 Binding Effect.
This Agreement and the Development Plan binds and benefits the Owner
and its successors and assigns; provided, however, that an Owner will have
no liability hereunder after it sells, and no longer has an interest in, the
Property.
II.
DEVELOPMENT PLAN
1. Definitions
Words and terms used herein shall have their usual force and meaning, or as
defined in the Code of Ordinances, City of Round Rock,Texas, hereinafter referred
to as "the Code."
2. Property
This Development Plan("Plan")covers the real property more particularly described
in Exhibit 'A" attached hereto, which describes four parcels of land, shown as
Parcels A,B,C and D, respectively.
3. Purpose
The purpose of this Plan is to insure a development that 1)is equal to or superior to
development that would occur under the standard ordinance requirements , and 2)
does not have an undue adverse affect upon adjacent property,the character of the
neighborhood, traffic conditions, parking, utilities or any other matters affecting the
public health, safety and .
4. Permitted Uses.
The Property shall be used and developed for the uses set forth herein.
3.
4.1 Parcel A (5.270 acres, as described in Exhibit "A"):
Public Facilities 2 (PF-2), as described in the Code, with the following
modifications:
Kindergarden through 8th grade school is allowed with a maximum height of
two stories and a maximum square footage of 35,000 s.f. (Including kitchen,
cafeteria, toilets, classrooms & administration).
Gymnasium is allowed with a maximum height of two stories and a maximum
square footage of 8,000 s.f. (excluding locker rooms, showers, toilets or
storage).
Day care is allowed with a maximum square footage of 3,000 s.f.
Church offices are allowed with a maximum square footage of 2,500 s.f.
4.2 Parcel B (0.976 acres, as described in Exhibit "A"):
Office(OF), as described in the Code,with the following modifications:
Maximum height of two stories
4.3 Parcel C (0.999 acres, as described in Exhibit "A"):
Local Commercial (C-2), as described in the Code, with the following
modifications:
Maximum single commercial use size of 10,000 s.f.
Additional prohibited uses (see below).
4.4 Parcel D (1.00 acres, as described in Exhibit "A"):
Local Commercial (C-2), as described in the Code, with the following
modifications:
Maximum single commercial use size of 10,000 s.f.
Maximum height of two stories.
Only office uses permitted above one story.
Additional prohibited uses (see below).

4.5 Additional Prohibited Uses in Local Commercial (C-2):
No overnight accommodations (hotels, motels, bed & breakfast)
No auto service, carwash facilities, gas stations
No Pawn Shops
No Wireless Transmission Facility, attached
4.6 Additional Requirements for construction in Local Commercial (C-2):
Earth tone color schemes shall be reviewed for acceptability and compliance
with the Church Architectural Board for approval prior to installation. Colors
shall be compatible with adjacent developments.
No buildings shall have "drive-throughs."
Translucent vinyl awnings are prohibited.Approved awnings,with a minimum
soffit distance of four (4) feet, must be 4:12 pitch or greater with materials
equal to that approved for 3:12 sloped roofing.
Roofing shall be tile, slate or non-reflective prefinished standing seam
metals. (Galvalume is not permitted).All roofs shall be required to be sloping.
Single sloped roofs are not acceptable unless constructed with continuous
parapets and approved continuous awnings at all walls. Should mechanical
equipment be placed on the roof it shall be completely screened from view in
all directions. Roof pitches not behind parapets shall be 3:12 or greater.
Horizontal wall articulations for single wall distances less than 100 feet must
be a minimum of twelve (12) inches offset from the face of the primary wall
and be a minimum of 24 inches in width. Should the minimum articulation be
used, distances between articulations shall be no further than 20 feet.
5. Changes to Agreement and Development Plan.
5.1 Minor Changes.
Minor changes to this Agreement or Plan which do not substantially change
this Plan may be approved administratively, if approved in writing, by the
Director of Public Works, the Director of Planning and Community
Development, and the City Attorney.
5.2 Major Changes.
Major changes shall be resubmitted following the same procedure required
by the original application.

and Development Plan for Lot 1, Block A, Meadows at Chandler Creek,
Section 25 with the Apostolic Church.

Justification:
Although the subject property is located outside the City Limits in the Meadows of Chandler Creek
Municipal Utility District (MUD), the Consent Agreement that created the MUD requires City
Council approval for any changes to the MUD's Land Use Plan. The Board of Directors of the MUD
has reviewed the proposed amendment to the Land Use Plan and has no objection to the changes
proposed by the Apostolic Church. (Please see the attached letter from the General Manager of
the MUD.) The original Land Use Plan designates the subject property as single-family
residential. However, both Bowman Road and FM 1460 are now arterial roads, with FM 1460
currently being upgraded to accommodate additional traffic from growth in northeast Round Rock.
Given these changing conditions, retaining this intersection for single-family residential use is no
longer appropriate. The proposed amendment, on the other hand, allows for the property to be
developed in a manner more suitable for the intersection of two arterials without being
detrimental to the neighboring residences. As the attached information indicates, the proposed
eight-acre development includes an office building, a general retail building, a potential mixed-use
building (both retail and office), a church, church offices, a day care, and a K-8 school with a
gymnasium. Although the City's Zoning Ordinance does not apply to this property due to its
location outside the City Limits, the proposed amendment to the Land Use Plan ties the proposed
uses to the City's zoning districts in order to simplify the changes and to ensure that all of the
proposed buildings will meet the compatibility standards and development regulations (such as
landscaping & screening requirements, building design guidelines, etc.) specified in the Zoning
Ordinance.

Background Information:
The City Council approved the Consent Agreement creating the Meadows at Chandler Creek MUD
in May 1984. The Consent Agreement required that a Land Use Plan be developed for the MUD.
This Plan was approved by the City Council in January 1992. The amendment to the Land Use
Plan requested by the Apostolic Church was originally presented to the Planning and Zoning
Commission on July 7, 2004. At this meeting, the Commission asked the applicant to postpone
the request and meet with the surrounding neighborhood to address their concerns. After making
some adjustments to the proposed land use plan with the assistance of City Staff, representatives
from the Church met with the Meadows of Chandler Creek neighborhood association on Thursday
evening, September 9, to discuss the proposed development. On September 15, 2004, the
Planning and Zoning Commission rendered a favorable recommendation to amend the Meadows
at Chandler Creek Land Use Plan as proposed.
Public Comment:
Public Notice and a public hearing were held in accordance with the City of Round Rock's Zoning
Ordinance. A public hearing was held on September 15, 2004, at the regular meeting of the
Planning and Zoning Commission. Because this application is for a land use change, Staff has
treated it as an in-City zoning change and has sent out notification to neighboring property
owners accordingly.

THIS AGREEMENT and Development Plan is made and entered into by and between the
City of Round Rock, Texas, a Texas municipal corporation, having its offices at 221 East
Main Street, Round Rock, Texas 78664 (hereinafter referred to as the "City"), and the
Apostolic Church, (hereinafter referred to as the "Owner", whether one or more).
WHEREAS, the Owner has submitted a request to the City to amend a Land Use Plan
previously approved in an Agreement concerning Creation and Operation of the Meadows
at Chandler Creek Municipal Utility District, dated May 10, 1984, and
WHEREAS, on September 15, 2004, the City's Planning and Zoning Commission
recommended approval of the Owner's request to amend said Plan,
NOW THEREFORE BY THIS AGREEMENT WITNESSETH that, in consideration of the
covenants and conditions set forth herein, the City and the Owner agree as follows:
I.
GENERAL PROVISIONS
1. Conformity with Development Plan
All uses and development within the Property shall generally conform to the
Development Plan set forth in Section II herein.
2. Changes and Modifications
No changes or modifications will be made to this Agreement or the Development
Plan unless all provisions pertaining to changes or modifications as stated below
are followed.
3. Miscellaneous Provisions
3.1 Necessary Documents and Actions.
Each party agrees to execute and deliver all such other and further
instruments and undertake such actions as are or may become necessary or
convenient to effectuate the purposes and intent of this Agreement.

3.2 Severability.
In case one or more provisions contained herein are deemed invalid, illegal
or unenforceable in any respect, such invalidity, illegality or unenforceability
shall not affect any other provisions hereof and in such event, this
Agreement shall be construed as if such invalid, illegal or unenforceable
provision had never been contained herein.
3.3 Entire Agreement.
This Agreement constitutes the entire agreement of the parties and
supersedes any prior or contemporaneous oral or written understandings or
representations of the parties respecting the subject matter hereof.
3.4 Applicable Law.
This Agreement shall be construed under and in accordance with the laws of
the State of Texas.
3.5 Venue.
All obligations of the parties created hereunder are performable in
Williamson County, Texas and venue for any action arising hereunder shall
be in Williamson County.
3.6 No Third Party Beneficiaries.
Nothing in this Agreement, express or implied, is intended to confer upon any
person or entity, other than the parties hereto (and their respective
successors and assigns), any rights, benefits or remedies under or by reason
of this Agreement.
3.7 Duplicate Originals.
This Agreement may be executed in duplicate original, each of equal dignity.
3.8 Notices.
Until changed by written notice thereof, any notice required under this
Agreement may be given to the respective parties, by certified mail, postage
prepaid or by hand delivery to the address of the other party shown below:

3.9 Effective Date.
This Agreement shall be effective from and after the date of due execution
hereof by all parties.
3.10 Binding Effect.
This Agreement and the Development Plan binds and benefits the Owner
and its successors and assigns; provided, however, that an Owner will have
no liability hereunder after it sells, and no longer has an interest in, the
Property.
II.
DEVELOPMENT PLAN
1. Definitions
Words and terms used herein shall have their usual force and meaning, or as
defined in the Code of Ordinances, City of Round Rock, Texas, hereinafter referred
to as "the Code."
2. Property
This Development Plan ("Plan")covers the real property more particularly described
in Exhibit 'A" attached hereto, which describes four parcels of land, shown as
Parcels A,B,C and D, respectively.
3. Purpose
The purpose of this Plan is to insure a development that 1)is equal to or superior to
development that would occur under the standard ordinance requirements , and 2)
does not have an undue adverse affect upon adjacent property,the character of the
neighborhood, traffic conditions, parking, utilities or any other matters affecting the
public health, safety and .
4. Permitted Uses.
The Property shall be used and developed for the uses set forth herein.

4.1 Parcel A (5.270 acres, as described in Exhibit "A"):
Public Facilities 2 (PF-2), as described in the Code, with the following
modifications:
Kindergarden through 8th grade school is allowed with a maximum height of

MEADOWS AT CHANDLER CREEK, SECTION 25, LOT 1, BLOCK A
LAND USE DESIGNATIONS FOR LOTS 1-4 OF THE REPLAT
Lot 1: Public Facilities 2 (PF-2) with the following modifications:
■ K-8 school is allowed with a maximum height of two stories and a maximum
square footage of 35,000 s.f. (including kitchen, cafeteria, toilets, classrooms
& administration).
■ Gymnasium is allowed with a maximum height of two stories and a maximum

Additional Requirements for construction in C-2:
• Earth tone color schemes shall be reviewed for acceptability and compliance
with the Church Architectural Board for approval prior to installation. Colors
shall be compatible with adjacent developments.
■ No buildings shall have "drive-thrus."
■ Translucent vinyl awnings are prohibited. Approved awnings, with a
minimum soffit distance of four(4) feet, must be 4:12 pitch or greater with
materials equal to that approved for 3:12 sloped roofing.
■ Roofing shall be tile, slate or non-reflective prefinished standing seam metals.
(Galvalume is not permitted). All roofs shall be required to be sloping.
Single sloped roofs are not acceptable unless constructed with continuous
parapets and approved continuous awnings at all walls. Should mechanical
equipment be placed on the roof it shall be completely screened from view in
all directions. Roof pitches not behind parapets shall be 3:12 or greater.
■ Horizontal wall articulations for single wall distances less than 100 feet must
be a minimum of twelve(12) inches offset from the face of the primary wall
and be a minimum of 24 inches in width. Should the minimum articulation be
used, distances between articulations shall be no further than 20 feet.

ITEM: 14.B.1. Consider a resolution authorizing the Mayor to execute an Agreement
and Development Plan for Lot 1, Block A, Meadows at Chandler Creek,
Section 25 with the Apostolic Church.

Justification:
Although the subject property is located outside the City Limits in the Meadows of Chandler Creek
Municipal Utility District (MUD), the Consent Agreement that created the MUD requires City
Council approval for any changes to the MUD's Land Use Plan. The Board of Directors of the MUD
has reviewed the proposed amendment to the Land Use Plan and has no objection to the changes
proposed by the Apostolic Church. (Please see the attached letter from the General Manager of
the MUD.) The original Land Use Plan designates the subject property as single-family
residential. However, both Bowman Road and FM 1460 are now arterial roads, with FM 1460
currently being upgraded to accommodate additional traffic from growth in northeast Round Rock.
Given these changing conditions, retaining this intersection for single-family residential use is no
longer appropriate. The proposed amendment, on the other hand, allows for the property to be
developed in a manner more suitable for the intersection of two arterials without being
detrimental to the neighboring residences. As the attached information indicates, the proposed
eight-acre development includes an office building, a general retail building, a potential mixed-use
building (both retail and office), a church, church offices, a day care, and a K-8 school with a
gymnasium. Although the City's Zoning Ordinance does not apply to this property due to its
location outside the City Limits, the proposed amendment to the Land Use Plan ties the proposed
uses to the City's zoning districts in order to simplify the changes and to ensure that all of the
proposed buildings will meet the compatibility standards and development regulations (such as
landscaping & screening requirements, building design guidelines, etc.) specified in the Zoning
Ordinance.

Background Information:
The City Council approved the Consent Agreement creating the Meadows at Chandler Creek MUD
in May 1984. The Consent Agreement required that a Land Use Plan be developed for the MUD.
This Plan was approved by the City Council in January 1992. The amendment to the Land Use
Plan requested by the Apostolic Church was originally presented to the Planning and Zoning
Commission on July 7, 2004. At this meeting, the Commission asked the applicant to postpone
the request and meet with the surrounding neighborhood to address their concerns. After making
some adjustments to the proposed land use plan with the assistance of City Staff, representatives
from the Church met with the Meadows of Chandler Creek neighborhood association on Thursday
evening, September 9, to discuss the proposed development. On September 15, 2004, the
Planning and Zoning Commission rendered a favorable recommendation to amend the Meadows
at Chandler Creek Land Use Plan as proposed.
Public Comment:
Public Notice and a public hearing were held in accordance with the City of Round Rock's Zoning
Ordinance. A public hearing was held on September 15, 2004, at the regular meeting of the
Planning and Zoning Commission. Because this application is for a land use change, Staff has
treated it as an in-City zoning change and has sent out notification to neighboring property
owners accordingly.
