R-90-1519 - 9/27/1990 RESOLUTION NO. 1519R WHEREAS, the 620 Oakwood Joint Venture desires to locate an area identification sign on City right-of-way, and WHEREAS, in accordance with Section 3 . 1411(10) , Code of Ordinances, 1990 Edition, City of Round Rock, Texas, the 620 Oakwood Joint Venture desires to enter into a license agreement with the City to utilize public right-of-way for the purpose of locating an area identification sign thereon, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the Mayor is hereby authorized and directed to execute on behalf of the City a license agreement with 620 Oakwood Joint Venture, a copy of said license agreement being attached hereto and incorporated herein for all purposes. City hereby grants to 620 Oakwood, its successors and assigns (subject to the restrictions against assignment contained herein) the right, privilege and permission to place an approved Area Identification Sign on property owned, managed or controlled by City, described as follows: The median in the right-of-way of Oakwood Boulevard at Round Rock Avenue (RM 620) as indicated on Exhibit "A" attached hereto. This permission is given to 620 Oakwood as an accommodation with no monetary consideration, and is revocable at any time by either party on thirty (30) days written notice. 620 Oakwood acknowledges the legal title of City to the above- described property and agrees never to deny such title or to claim title in its name. 620 Oakwood will exercise the privilege granted herein at its own riek and agrees that 620 Oakwood will never claim any damages against City for any injuries or damages suf'f'ered because of the exercise of such privilege regardless of the fault or negligence of City, and 620 Oakwood will indemnify City against all liability for damages and expenses resulting from, arising out of, or in any way connected with,.the exercise of the privilege'by 620 Oakwood, and 620 Oakwood assignees, permtees, or other persons using the property at the invitation, of 620 Oakwood. This license shall not be assigned or transferred by 620 Oakwood unlesq said agreement is approved by the City Council. STAFF RESOURCE PERSON: Joe Vining STAFF RECOMMENDATION: Approval This resolution will authorize the location of an Area Identification Sign in the median of Oakwood Boulevard near RM620. This action will also result in removal of the existing Hearthstone sign at this same corner.
