R-08-05-08-10A1 - 5/8/2008 RESOLUTION NO. 08-05-08-10A1 WHEREAS, the City of Round Rock ( "City" ) desires to construct a water tank and related facilities ( "Project" ) on a portion of property that it currently owns and which fronts on FM 1431; and WHEREAS, the Project requires the use of easements across a portion of public land designated for future use as a park, namely Mayfield Park; and WHEREAS, the City will require the permanent use of the parklands for the easements, and improvements to the water system of the City of Round Rock; and WHEREAS, in accordance with Sec. 26 . 002 of the Texas Parks and Wildlife Code, after due notice and publication, a public hearing on the aforesaid proposed easements was held on the 8th day of May, 2008 ; and WHEREAS, Sec . 26 . 001 of the Texas Parks and Wildlife Code requires that prior to the City of Round Rock approving the use of the easements across the aforesaid public lands, the City must determine that (1) there is no feasible and prudent alternative to the use of such lands and (2) the System includes all reasonable planning to minimize harm to the land; and WHEREAS, the City desires to formally approve the Project and authorize it to proceed; and WHEREAS, the City desires to establish an easement upon and across a 1 .451 acre parcel where the water tank and related facilities that are part of this Project are to be constructed; Now Therefore O:\W DOX\RE5O LUTI\R805 O8 A l.DOC/dc BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, 1) That there is no feasible and prudent alternative to the use of easements across Mayfield Park for the Project, and 2) That the plans for the Project include all reasonable planning to minimize any harm to said parks . IT IS FURTHER RESOLVED, That the City Council hereby approves the Project and authorizes and directs that it proceed to completion at the location identified in the Exhibit to the Declaration of Water Storage Tank and Water Line Easement. IT IS FURTHER RESOLVED, That the Mayor is hereby authorized and directed to execute on behalf of the City, a Declaration of Water Storage Tank and Water Line Easement, a copy being attached hereto as Exhibit "A" and incorporated herein for all purposes . Consider a resolution approving and authorizing the R.M. 1431 Water Tank Construction Project to proceed and authorizing the Mayor to execute a Declaration of Water Storage Tank and Water Line Easement in Mayfield Park. Department: Water and Wastewater Utilities Staff Person: Michael D. Thane, Water and Wastewater Utility Director Justification: The R.M. 1431 Elevated Water Storage Tank and associated water line site consists of 1.42 acres that is located on the northeast corner of the 245.4 acre "Mayfield Park" property. This property is public land that is designated for a future park. As part of Section 26 of the Texas Parks and Wildlife Code, it is required that prior to the City of Round Rock approving the use of the easements across the above-mentioned public land, the City must determine that (1) there is no feasible and prudent alternative to the use of such land and (2) the City has included all reasonable planning to minimize harm to the land. HDR has completed the design along with the required Topographic Survey, a Karsts Survey and the Texas Commission on Enviromental Quality (TCEQ) project approval submittal. Once construction of the facilities is completed, the site will be landscaped with native plants to include; Texas Mountain Laurel, Yaupon Holly, Texas Red Buds and Agarita along the east side of the site to return the site to as natural a state as possible. Funding: Cost: N/A Source of funds: N/A Outside Resources: HDR, Engineering, Inc. -CONTINUED ON NEXT PAGE- Background Information: The City Council approved a resolution authorizing the Mayor to execute a Contract for Professional Services with HDR, Engineering for the R.M. 14312.0 MG Elevated Water Storage Tank to be located on the site that is under consideration herein. With this 2.0 MG Elevated Water Storage Tank improvement, the City can meet its obligations to the City of Cedar Park under the Interlocal Agreement for Emergency Water Supply, as approved by the City Council on May 24, 2007. Per this Interlocal Agreement, Cedar Park has contributed $1,000,000 toward this project. The 2.0 MG Elevated Water Storage Tank improvement gives the City the ability to provide the City of Cedar Park with 2.5 million gallons per day (mgd) of potable water by the summer of 2008 and 4.0 mgd of potable water by the summer of 2009. This elevated water tank is scheduled to be in service by June 2009. In 2004, the City previously granted the Brushy Creek M.U.D. a 50-foot wide Raw Water Line Easement containing 3.913 acres out of the same 245.4 acre "Mayfield Park" property.
