ZIL • 2.40P—Z& RESOLUTION PROVIDING FOR THE LOCAL CANVASS OF PRECINCT RETURNS, AND DECLARING THE VOTING TOTALS AND RESULTS OF THE CITY OF ROUND ROCK'S GENERAL AND SPECIAL ELECTION OF MAY 10, 2008 WHEREAS, the City Council of the City of Round Rock ordered a general and special election to be held May 10, 2008 for the purpose of electing Mayor, Councilmember Place 1 and Councilmember Place 4, and for filling a vacancy for Councilmember Place 2 (unexpired term), and for submitting to voters certain proposed amendments to the Home Rule Charter of the City; and WHEREAS, the City Council has investigated all matters pertaining to the election, including the ordering, giving notice, officers,holding, and making returns of the election; and WHEREAS, the election officers who held the election have duly made the returns of the result thereof, and the returns have been duly delivered to this City Council; and WHEREAS, in accordance with Chapter 67 of the Texas Election Code, the City Council has canvassed the election returns. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: 1. That the City Council officially finds and determines that the election was duly ordered, the proper notice of the election was duly given, that proper election officers were duly appointed prior to the election, that the election was duly held, that the City has complied with the Federal Voting Rights Act and the Texas Election Code, that due returns of the result of the election have been made and delivered, and that the City Council has duly canvassed the returns, all in accordance with the law and the ordinance calling and conducting the election. 2. That the City Council officially finds and determines that the following votes were cast by the resident, qualified electors of the City who voted at the election held for the purpose of electing Mayor: Alan McGraw 2,076 votes 00138710/jkg 3. That the City Council officially finds and determines that the following votes were cast by the resident, qualified electors of the City who voted at the election held for the purpose of electing Councilmember Place 1: John Moman 886 votes Rufus Honeycutt 1,568 votes 4. That the City Council officially finds and determines that the following votes were cast by the resident, qualified electors of the City who voted at the election held for the purpose of electing Councilmember Place 4: Carlos T. Salinas 1,774 votes 5. That the City Council officially finds and determines that the following votes were cast by the resident, qualified electors of the City who voted at the election held for the purpose of electing Councilmember Place 2 (unexpired term): George White 1,822 votes 6. That the City Council officially finds and determines that the following votes were cast by the resident, qualified electors of the City who voted at the election held for the purpose of submitting to voters certain proposed amendments to the Home Rule Charter of the City: PROPOSITION NO. 1 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, PROVIDING FOR ASSISTANT(S) TO THE MAYOR AND COUNCIL APPOINTED BY THE CITY MANAGER, WHICH ASSISTANT(S) SHALL BE DIRECTED AND SUPERVISED BY THE CITY MANAGER, MAYOR, AND COUNCIL. Total Votes Received Yes, the above described Charter amendment shall be adopted 1,824 votes No, the above described Charter amendment shall not be adopted 719 votes PROPOSITION NO. 2 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, REMOVING PUBLICATION REQUIREMENTS AND ADDING A PROVISION THAT THE COUNCIL MAYA BY ORDINANCE ESTABLISH ADDITIONAL PUBLICATION REQUIREMENTS. 2 Total Votes Received Yes, the above described Charter amendment shall be adopted 1,499 votes No, the above described Charter amendment shall not be adopted 988 votes PROPOSITION NO. 3 AMENDMENT TO THE HOME RULE CHARTER OF THE CITY OF ROUND ROCK, TEXAS, PROVIDING THAT THE CHARTER REVIEW COMMISSION SHALL PRESENT ITS FINDINGS AND PROPOSALS TO COUNCIL IN A WRITTEN REPORT CONFORMING TO CERTAIN REQUIREMENTS AND BEING SIGNED BY AT LEAST A MAJORITY OF ITS MEMBERS. Total Votes Received Yes, the above described Charter amendment shall be adopted 2,236 votes No, the above described Charter amendment shall not be adopted 314 votes 7. That the City Council officially finds, determines and declares the result of the election to be that Alan McGraw was elected as Mayor. 8. That the City Council officially finds, determines and declares the result of the election to be that Rufus Honeycutt was elected as Councilmember Place 1. 9. That the City Council officially finds, determines and declares the result of the election to be that Carlos T. Salinas was elected as Councilmember Place 4. 10. That the City Council officially finds, determines and declares the result of the election to be that George White was elected as Councilmember Place 2 (unexpired term). 11. That the City Council officially finds, determines and declares the result of the election to be that all propositions passed, and declares that all charter amendments are adopted in accordance with Texas Local Government Code, Section 9.005(b). 12. That the provisions of this Resolution are severable; and in case any one or more of the provisions hereof or the application thereof to any person or circumstance should be held to be invalid, unconstitutional, or ineffective as to any person or circumstance, then the remainder of this Resolution nevertheless shall be valid, and the application of any such invalid provision to persons or circumstances other than those as to which it is held invalid shall not be affected thereby. 3 13. That the City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all in accordance with and as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act.
