R-08-05-22-10A1 WHEREAS, Sections 395 . 053 and 395 . 054, Texas Local Government Code, require a municipality modifying impact fees to adopt a resolution setting a public hearing date to consider updates to the land use assumptions and capital improvements plan and amendments to the impact fees for the designated service area, and WHEREAS, the City has determined the land use assumptions, capital improvements plan and/or the impact fees need to be updated, and WHEREAS, it is necessary for the City Council to set a date, time, and place for the holding of the public hearing in order to comply with said Texas Local Government Code requirements for same, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That a public hearing to consider updates to the land use assumptions and capital improvements plan and amendments to the impact fees for the designated service area be held on the 10th day of the month of July, 2008, at 7 : 00 o' clock p.m. at 221 E. Main Street, Round Rock, Williamson County, Texas . Consider a resolution setting the date, time, and place for a Public Hearing regarding a proposed ordinance amending the land use assumptions, the capital improvements plan, and/or the water and wastewater impact fees. Department: Water and Wastewater Utilities Staff Person: Michael D. Thane, P.E., Director of Utilities Justification: The City last updated the water and wastewater impact fees in January 2005. At that time, the City made a commitment to review the existing impact fees that new customers are charged for tying into the water and wastewater systems every 2 to 3 years. As part of the process to update the impact fees, the City reviewed and updated the existing land use plan, annexation plan, and the water and wastewater system capital improvement/master plans. This resolution authorizes the Mayor to call a Public Hearing date to receive community input on the impact fee updating process. Posting for the public hearing must be posted no later than 30 days prior to the hearing to be held on July 10, 2008. Prior to the public hearing, the City's Capital Improvement Advisory Committee will submit its report and recommendations to the City Council for discussion during the first reading of the ordinance at the July 10th City Council meeting. Background Information: The current impact fees that are charged to new customers connecting to the City's water and wastewater system are: water$4,296 and wastewater$1,306 per Living Unit Equivalent. Public Comment: A presentation of the draft report of the proposed impact fees was made to the City's Capital Improvement Advisory Committee on May 14, 2008.
