R-05-09-08-11G1 - 9/8/2005 RESOLUTION NO. R-05-09-08-11G1 WHEREAS, the City, on February 24, 2005 entered into an Agreement with the Williamson County Humane Society, Inc. for pet licensing, fee collection, boarding, rabies observation, and the reclamation of impounded animals, and WHEREAS, the City and the Williamson County Humane Society, Inc. now desire to extend the Agreement for a period of an additional one (1) month, so that the term of said Agreement shall expire on October 31, 2005; WHEREAS, the City Council desires to enter into Supplemental Agreement No. 1 to the Agreement with the Williamson County Humane Society, Inc . , Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Agreement with the Williamson County Humane Society, Inc. , a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes . The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHEREAS, the City and the Humane Society executed the referenced "Agreement Between Williamson County Humane Society, Inc. and City of Round Rock,"hereinafter called the"Agreement,"on the 24th day of February, 2005; and WHEREAS, it has become necessary to extend the Agreement and provide for payment relating to such extension; NOW THEREFORE, premises considered, the City and the Humane Society agree that said Agreement is amended as follows: I. Section 2. Agreement Period shall be amended as follows: The period for performance of this Agreement shall be for one (1) month, commencing on October 1, 2005 and continuing thereafter until and through November 1, 2005. I1. Section 3. Fees Subsection G. Flat Fee shall be amended as follows: For the term of this Agreement, the City shall pay to the Humane Society the sum of Fifteen Thousand Four Hundred Sixteen and 67/100 Dollars ($15,416.67). III. This Supplemental Agreement No. 1 extends the term of the original Agreement for one (1) month immediately following the expiration of the original term of twelve (12) months, and provides for a total payment of$15,416.67 by the City to the Humane Society. There are no other changes in terms or conditions of the original Agreement.
