WHEREAS, §8 . 503 Code of Ordinances (1995 Edition) provides for
the reimbursement for the oversizing of water mains, and
WHEREAS, Forest Creek Condominiums, Ltd. has submitted a
reimbursement request for the oversizing of water mains associated with
the Forest Creek Townhomes development, and
WHEREAS, the City Council wishes to approve said reimbursement,
Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the City Council hereby authorizes the reimbursement to
Forest Creek Condominiums, Ltd. of $4, 680 . 00, which is the cost of
oversizing water mains associated with the Forest Creek Townhomes
development .
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

The purpose of this letter is to provide you with information regarding reimbursements
from the City of Round Rock that you may be eligible for over sizing certain waterlines
within the above referenced project. Per the City of Round Rock's Development Code
and more specifically the Water and Wastewater Oversize Policy,"If a development is
required to oversize utility lines in excess of the developments direct needs,the
development will be given credit.for the amount oversized."It is the opinion of Randall
Jones Engineering,Inc.that the .l2"water line Located within County Road 122 was
oversized beyond the needs of this development.Typically an 8"would have been
sufficient and adequate to serve the 59 units within this development.Therefore,in
accordance with the City's policy you may request reimbursement of$2.60 per. inch
diameter oversized,per linear foot of line installed. For this project,450 feet of 12"line
was constructed. The reimbursement calculation is$2.60/inch-foot x 4"x 450 feet=
$4,680.00.
Approved construction plans are on file at the City of Round Rock for this project that
show the water line location and sizing. Please let us know if you need any additional
information regarding this reimbursement request.

The following items must be furnished/completed in order for the City to formally accept
the public improvements constructed in conjunction with the above-referenced
subdivision. Upon satisfactory submission/completion of the following items,we will be
able to process the water main oversize reimbursement requested and also issue the
certificate of occupancy(CO) for the project.
1. Complete a small portion of sidewalk along Co. Rd. 122 near the
northwest corner of the townhomes site.
2. Furnish a sidewalk easement to the City of Round Rock for portions of
sidewalk that are outside the public right-of-way of Forest Creek Drive.
3. Furnish the City an itemized construction cost schedule for the following
improvements:
A. 450 linear feet of 12"water main along Co. Rd. 122.
B. Two 8"compound water meter installation.
C. One 12"gate valve.
D: Two 8"gate valves.
E. 676 linear feet of 8"wastewater main.
F. Six wastewater manholes.
4. Submission of a subdivision inspection fee to the City equal to 1.5%of the
total construction costs of the items in 3 above.

ITEM: *11.C.1. Consider a resolution approving a reimbursement to Forest Creek
Condominiums, Ltd. for the cost of oversizing water mains associated
with the Forest Creek Townhomes development.

Justification:
The 12" waterline located within CR 122 was oversized beyond the needs of the Forest Creek
Townhome development. Staff recommends reimbursement to Forest Creek Condominiums, Ltd.
for the oversizing as provided for under Chapter 8 of the Round Rock Code of Ordinances.
Funding:
Cost: $4,680.00

Background Information:
With development of Forest Creek Townhomes subdivision, 450 feet of 12" water main was
extended along CR 122 north from the Forest Creek Drive intersection. The engineer for the
developer has certified that an 8" water main would have been sufficient for the Townhome
development and therefore oversizing was provided. The oversized main provides benefits for
other developments in the Forest Creek area. Even though the water main was completed
around the end of 2001, the City was unauthorized to accept the main because all requirements
under Chapter 8 of the Round Rock Code of Ordinances had not been met. The outstanding
requirements have recently been satisfied and the water main has been accepted by the City.
Therefore, the City is now authorized to consider an oversize reimbursement.
