R-04-11-23-9D1 WHEREAS, §8 . 610 (4) Code of Ordinances (1995 Edition) provides for the reimbursement for the oversizing of water mains, and WHEREAS, Villages at Warner Ranch PUD, L.P. has submitted a reimbursement request for the oversizing of water mains associated with the Warner Ranch development (within future Thibodeaux Drive right-of- way between Jazz Street and Warner Ranch Drive) , and WHEREAS, the City Council wishes to approve said reimbursement, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City Council hereby authorizes the reimbursement to Villages at Warner Ranch PUD, L.P. of $3, 567 . 20, which is the cost of oversizing water mains associated with Warner Ranch 1B development (within future Thibodeaux Drive right-of-way between Jazz Street and Warner Ranch Drive) . The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. This City of Round Rock has accepted this project recently. Via our phone conversation with Brian Baird,the City of Round Rock has stated that your staff can recommend reimbursement for the waterline constructed that consists of a 12"waterline and is approximately 343 linear feet long. We request a reimbursement for the over-sizing of this line totaling$3,567.20. Villages at Warner Ranch PUD, LP has the rights to and is due any reimbursement for oversizing and has not assigned those rights away to another. Specifically, the reimbursement due for Warner Ranch Phase 1B Subdivision are calculated as follows: $2.60 x 4"x 343 linear feet=$3,567.20. Consider a resolution approving a reimbursement to Villages at Warner Ranch PUD, L.P. for the cost of oversizing water mains associated with the Warner Ranch development. (within future Thibodeaux Drive ROW between Jazz Street and Warner Ranch Drive) Department: Engineering and Development Services Staff Person: Tom Word, Chief of Public Works Operations Justification: The developer of Warner Ranch installed 343 linear feet of 12-inch water main within a 15- foot waterline easement within the future Thibodeaux Drive ROW. According to documentation from the developer's engineer, an 8-inch main would have been sufficient for the needs of the development. The main was oversized to a 12-inch to provide service for future development in the area and for system redundancy that the City feels is prudent because of the multifamily developments that currently exist and are planned for the future. Funding: Cost: $3,567.20 Source of funds: Oversize Account Outside Resources: Carter & Burgess Villages at Warner Ranch PUD, LP Background Information: The City requested as part of the Warner Ranch water system improvements, a 12-inch line be extended from the Remington Heights Subdivision to connect to a 16-inch waterline in the Warner Ranch Drive ROW. According to engineering documentation provided at the time of platting, an 8-inch line would have been sufficient for the needs of the development. Public Comment: N/A
