The recipient shall also complete the review procedures required under E.O. 12372 and 24 CFR Part 52 and receive written notification from HUD of the release of funds provided under this agreement for any new or revised activity for the planning or construction of water of sewer facilities not previously reviewed under E.O. 12372 and implementing regulations. High Priorities. Action Plans will be evaluated for consistency in the application of program funding to achieve the City's designated High Priority activities. This year's Action Plan shows 100 percent of activities meeting a High Priority designation. In compliance with 24 CFR 91.220 requirements, the Action Plan showed the quantitative goals and expected completions dates for each proposed activity. The City's 5-Year Strategy also contained projected housing and non-housing cumulative goals to be achieved over the five-year period covered by the plan. The City should keep in mind that all quantitative goals stated in both your Action Plan and 5-Year Strategy will establish the basis for performance evaluation when the City submits its end of the year CAPERs (Consolidated Annual Performance and Evaluation Reports). Proposed projects cited in your Listing of Proposed Projects (to be loaded into IDIS) have been reviewed from the standpoint of compliance with CDBG eligibility requirements based on the information stated at this time. The comments offered are to be considered action items requiring a response within 30 days of the date of this letter: Project No. 0004 Greenhill Park Redevelopment $55 000 The project description does not say in particular what the CDBG funds will be used for other than for"safety guidelines." Since this is not an expansion project, the description should provide more information about project funding and why the funding is needed. Project No. 0005 Fire Alarm System $10,000, This project is classified as a Public Facility. The project may be classified as a Public Facility rehabilitation, however, more information is needed on the ownership of the facility and if the facility is single purpose or multi- purpose in order to establish the project's overall beneficiaries. Project No. 0007 CHIP Program $7,500. Project funding will pay for a part-time person involved in re-enrollment of children in CHIP/Medicaid programs. To be eligible as a Public Service activity the service must be either a new service or a quantifiable increase in the level of an existing service (see 570.201(e). Please address the stated regulatory criteria in your response to this review letter. Project No. 0013 Transportation Voucher Program $7,000. Project funding will pay for taxi service for clients of the Round Rock Area Serving Center. Estimated accomplishments are 420 persons to be served. Estimated accomplishments should be in the form of unduplicated persons in order to demonstrate that the program will be run in a manner that prevents services being monopolized by only a few beneficiaries. Project Nos. 0007 thru 0015 Public Service Projects These projects represent several public service activities and all activities have been classified under the 570.208(a)(2) low/mod limited clientele National Objective section of the regulations. In order to identify the level of recordkeeping that is expected of the City for its various public service activities, we recommend that the City reference limited clientele subclassifications i.e. presumed benefit, 51 percent recordkeeping, or no recordkeeping "nature and location." The latter subclassification, 570.208(a)(2)(i)(D), will require prior approval and submission of a narrative explaining the basis for your determination. 2 Project Nos. 0004 thru 0006 Public Facilities Projects These public facilities projects are cited as having a National Objective of low-mod area benefit. Census tract data and the low mod percentage is shown, however, it is recommended that in the future the total low-moderate income population in relation to the total population of the census tracts be shown in order to see that the percentage was derived correctly. Also, the City is reminded that file documentation of low-mod area benefit activities should have a census tract map delineating the service area boundaries. Location of the project within a low-mod target area does not conclusively establish eligibility of a project under the National Objective of low-mod area benefit. It is noted, the Action Plan allocations for Public Services and Administration were within the 15 percent and 20 percent caps, respectively. Enclosed are Grant Agreements and Funding Approvals for each program, which constitute the contracts between the Department of Housing and Urban Development and the City of Round Rock. Please execute and return two copies of the form to this office. Failure to return the executed funding form within 60 days may be deemed to constitute rejection of the grant and cause for HUD to determine that funds are available for reallocation to other grantees. Should there be a need to establish or change the depository account where the grant funds are being wired to, a Direct Deposit sign-up form (SF-1199A) must be completed by both the City and involved financial institution and mailed to our Field Office. We want to remind the City that certain activities are subject to the provisions of 24 CFR Part 58 (Environmental Review Procedures for the CDBG Program). Funds for such activities may not be obligated or expended unless there is a written release of funds notification from our Field Office. To initiate this process for these activities, the City must submit to our office an executed HUD form 7015.15 - Request for Release of Funds and Certification.
