WHEREAS, the City of Round Rock has previously entered into a
contract for engineering services ( "Contract" ) with Baker-Aicklen &
Associates, Inc. for the reconstruction of Chisholm Trail from Chisholm
Trail Hotel Centre to Wolle Lane, and
WHEREAS, Baker-Aicklen & Associates, Inc. has submitted
Supplemental Agreement No. 6 to the Agreement for Engineering Services
for a change in the scope of services, and
WHEREAS, the City Council desires to enter into said Supplemental
Agreement No. 6 with Baker-Aicklen & Associates, Inc . , Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 6 to the Agreement for
Engineering Services with Baker-Aicklen & Associates, Inc . , a copy of
same being attached hereto as Exhibit "A" and incorporated herein.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

This Supplemental Agreement No. 6 to Agreement for Engineering Services is made by and
between the City of Round Rock, Texas, hereinafter called the "City" and Baker-Aicklen &
Associates, Inc., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract', dated the 27th day of April, 2000 for the Reconstruction of Chisholm Trail
Project for a total compensation of$83,450.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 1 dated the 26th day
of April, 2001 to change the scope of services, extend the termination date of the Agreement
from June 30, 2001 to April 30, 2002 and to amend the compensation for a total of$87,450.00;
and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 2 dated the 25th day
of April, 2002 to extend the termination date of the Agreement from April 30, 2002 to April 30,
2003; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 3 dated the 10th day
of October, 2002 to change the scope of services and to amend the compensation for a total of
$116,280.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 4 dated the 24th day
of April, 2003 to change the scope of services, extend the termination date of the Agreement
from April 30, 2003 to April 30, 2004 and to amend the compensation for a total of$123,995.00;
and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 5 dated the 25th day
of March, 2004 to extend the termination date of the Agreement; and
WHEREAS, it has become necessary to change the scope of services and to amend the
compensation,

NOW THEREFORE, premises considered, the City and the Engineer agree that said
Agreement is amended as follows:
I.
Article 2, Scone Of Services To Be Performed By Engineer and Exhibit B, Services To Be
Performed By The Engineer shall be amended as set forth in the attached Addendum To Exhibit
B.
II.
Article 4 Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$4,000.00 the lump sum amount payable under the Agreement for a total of $127,995.00, as
shown by the attached Addendum to Exhibit D.
III.
Article 7,Notice to Proceed shall be amended to read as follows:
The Engineer shall not proceed with any task listed on Exhibit B until the City has issued
a written Notice to Proceed regarding such task. The City shall not be responsible for work
performed or costs incurred by Engineer related to any task for which a Notice to Proceed has
not been issued.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental
Agreement in duplicate.
