R-04-08-12-13D2 - 8/12/2004 RESOLUTION NO. R-04-08-12-13D2 WHEREAS, the City of Round Rock desires to retain professional lobbying services, and WHEREAS, Randy C. Cain, Attorney at Law, and Susan Rocha of Denton, Navarro, Rocha & Bernal have submitted a letter of agreement to provide said services, and WHEREAS, the City Council desires to enter into said letter of agreement with Randy C. Cain, Attorney at Law, and Susan Rocha of Denton, Navarro, Rocha & Bernal, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City a letter of agreement with Randy C. Cain, Attorney at Law, and Susan Rocha of Denton, Navarro, Rocha & Bernal for professional lobbying services, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes . The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Main Street Round Rock, Texas 78664 RE: Fee Agreement for 79th Legislative Session, Special Sessions, and Interim State Legislative Activities Dear Mayor, Jim and Steve, Randy and I would like to propose the following changes to our agreement for professional lobbying services for the City of Round Rock. Our discussions with all of you back in February centered around an increase in our compensation and an extension of the length of the contract. This letter, therefore, outlines the services proposed to be provided to the City of Round Rock, a Municipal Corporation ("CITY") by Randy Cain, Attorney at Law, and Susan Rocha of Denton, Navarro,Rocha& Bernal, a Professional Corporation("COUNSELORS"). Agreement for Legislative Support Services COUNSELORS will assist CITY in its state governmental relations by conducting all necessary research, information gathering, contacts and any other supporting activities relating to CITY's state legislative interests. As requested by CITY, COUNSELORS will continue to monitor current interim activities and hearings, and will review, analyze and monitor the 79th Legislative Session convening January 2005, along with any special sessions, and interim state legislative activities that follow. COUNSELORS will perform these services as requested by the City Attorney (or designee). Fee For the performance of these services, CITY agrees to pay Randy Cain the amount of$5,000.00 per month for the term of the agreement. For the performance of services, the CITY agrees to pay Susan Rocha the amount of$4,167.00 per month for the term of the agreement. The total amount of compensation shall be $110,000.00 per year of the initial term. EXHIBIT Expenses In addition to the above fee, CITY will, on written request from COUNSELORS supported by receipts or other adequate details, reimburse COUNSELORS for reasonable expenses, such as travel, long-distance telephone and courier charges, reasonably incurred in providing services under this agreement. The CITY must approve all travel expenses in advance. Term The initial term of this agreement will be from August 1, 2004 to July 31, 2006. CITY or COUNSELORS may terminate the agreement on thirty days written notice. Second Term The second term of this agreement will be from August 1,2006 to July 31, 2008. The fee set out in this agreement for Randy Cain and Susan Rocha shall be increased by 10 percent of the fee paid to Mr. Cain and Ms. Rocha individually. The City would like to continue using their services through 2008. Funding• Cost: $110,000 per year for 2004-2006 and $121,000 per year for 2006-2008 (10% increase) Source of funds: General Fund Outside Resources• N/A Background Information• The City has retained services since 2002 from Randy C. Cain and Susan Rocha. They have been instrumental with legislative issues such as Streamlined Sales Tax and higher education issues associated with the Round Rock Higher Education Center (RRHEC). In the next regular session, the public school finance lawsuit will be a major issue concerning city appraisal caps and also reviewing the revenue caps as well. Public Comment: N/A
