R-2017-4650 - 7/25/2017 RESOLUTION NO. R-2017-4650 WHEREAS, Texas Governor Greg Abbot has called a Special Session of the Texas Legislature to begin on July 18, 2017; and WHEREAS, the City Council for the City of Round Rock("City")requests that the Williamson County delegation oppose certain legislation that is harmful to the City and its citizens; and WHEREAS,the City Council strongly believes that local issues are best addressed by local duly elected representatives, and not by representatives elected to the state legislature and state-wide office holders; and WHEREAS, the City Council wishes to authorize the City's representatives to oppose any legislation that limits the existing authority of the City to govern its own affairs and oppose the imposition of any state mandates that do not provide for a commensurate level of state funding, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Williamson County delegation be requested to assist the City with the following legislative proposals, and that the Mayor, Councilmembers, City Manager, City Attorney, City staff members, and the City's legislative representatives be authorized to testify on behalf of the City for or against the following proposals as appropriate: 1. Property Tax—To oppose any change that reduces local control of the procedures for adopting, assessing, and spending local property tax revenues. 2. Spending Caps—To oppose any change that reduces local control over spending by imposing a cap of local spending. 3. Tree Protection — To oppose any change that reduces local control and ability to protect trees and the environment. 0112.1704;00382233 4. Annexation — To oppose any legislation that would limit the City's authority related to annexation, zoning, regulating property development, and eminent domain. 5. "Bathroom Bill"—To oppose any legislation that would limit or restrict the City's authority to regulate the use of bathrooms on a local level. 6. Pre-emption of local regulations - To oppose any "broad-based law" that restricts local governments' regulatory authority. BE IT FURTHER RESOLVED, That the Mayor, Councilmembers, City Manager, City Attorney, City staff members, and the City's legislative representatives be authorized to testify in opposition to any legislation that would limit or erode the City's power to self-govern, or in any way be of detriment to the City's authority to exercise the powers prescribed by the citizens of the City in their elected officials and oppose the imposition of any state mandates that do not provide for a commensurate level of state funding. The City Council hereby finds and declares that written notice of the date,hour,place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended.
