R-03-10-09-13G1 - 10/9/2003RESOLUTION NO. R -03-10-09-13G1 WHEREAS, the City of Round Rock has previously entered into a contract ("Contract") with Martin K. Eby Construction Co., Inc. for the construction of the Water Treatment Plant Expansion, Phase V, and WHEREAS, the Council has determined that it is necessary to make changes to the plans or specifications of the Contract due to unforeseen circumstances, and WHEREAS, it has been determined that it is necessary to change said Contract in accordance with the attached Contract Change Order No. 3, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Contract Change Order No. 3 to the Contract with Martin K. Eby Construction Co . , Inc., a copy of said change order being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at alltimes during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider a resolution authorizing the Mayor to execute Change Order No. 3 with Martin K. Eby Construction Company, Inc. for the construction of the Water Treatment Plant Expansion, Phase V. Tom Word, Chief of P.W. Operations Toni Clark, Director of Utilities Martin K. Eby Construction Company is currently under contract with the City to construct a 24 -MGD expansion to the City's Water Treatment Plant, including an additional high service pumping capacity, and a new chlorine storage and feed facility. This will be the third Change Order to the contract and is due to unforeseen conditions, value-added additions and modifications and entry road improvements that were a condition of the additional land agreement between the City and Texas Crushed Stone. The cost of the roadway improvements required under the Texas Crushed Stone agreement is $143,699.00. Other substantial costs associated with this change order include $85,736 for needed drainage improvements, $3,022 for additional breathing apparatus in the new Chlorine Facility for safety purposes and $503.00 to relocate an air release valve. CDM prepared and reviewed the proposed Change Order to Martin K. Eby Construction Company Inc. contract with the City and recommends approval. Staff concurs and recommends Council approval of this resolution in the amount of $324,143.00. With this Change Order No. 3 and Change Orders No. 1 and 2 the original contract amount of $15,229,552.50 will be increased by 2.26% or $344,087.00, which is well under the 9.0% budgeted amount for project contingencies.
