WHEREAS, the City of Round Rock desires to retain professional
appraisal services regarding the acquisition of right-of-way for the
A.W. Grimes Boulevard Project, and
WHEREAS, Paul Hornsby & Company has submitted a proposal to
provide said services, and
WHEREAS, the City Council desires to accept said proposal from
Paul Hornsby & Company, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a proposal from Paul Hornsby & Company for appraisal
services regarding the acquisition of right-of-way for the A.W. Grimes
Boulevard Project, a copy of said proposal being attached hereto as
Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

At your request, I am pleased to provide this proposal for appraisal services on the above -
captioned property. Terms of the assignment are summarized below.
Real Estate to be Appraised:
2404 Rio Grande Street • Austin,
1) Whole Property (Cirkiel): Approximately 5.84
acres of land improved with a ±9,476 SF office
building and a 2,388 SF single family residence
located along the south line of U.S. Highway
79, just east of its intersection with FM1460.
Part To Be Acquired: An irregular shaped area
of land containing 1.20 acres, located along the
eastern border of the whole property.
Remainder: The remainder will consist of
relatively narrow tract of land, approximately
4.64 acres in size, located at the southwest
comer of U.S. Highway 79 and the proposed
extension A.W. Grimes Boulevard. The noted
improvements will be in close proximity to the
proposed right of way of A.W. Grimes
Boulevard.
2) Whole Property (M & M Equities IV, Inc.):
Approximately 7.838 acres of land located
along the south line of U.S. Highway 79, just
east of its intersection with FM1460.

Purpose of the Appraisal:

Fee:
To estimate just compensation for the proposed
acquisitions.
To assist the client in negotiations involving the
acquisition of right-of-way for the extension of A.W.
Grimes Boulevard (Phase II).
The appraisals will be developed and the reports will
be prepared in conformity with and subject to the
requirements of the Uniform Standards of
Professional Appraisal Practice (USPAP) of the
Appraisal Foundation and the Code of Professional
Ethics and Standards of Professional Appraisal
Practice of the Appraisal Institute.
We will undertake complete appraisals, the results of
which will be set forth in summary appraisal reports
as defined by Standard Rule 2-2(b) of USPAP.

The fee for each appraisal is payable upon

concurrently. With the exception of the Cirkiel Tract,
the quoted fees assume appraisal of land only.
Should improvements need to be appraised, the fee
would be raised to a mutually agreed amount.

Time spent in addition to the initial appraisals,
including, without limitation, meetings, depositions,
mediation, arbitrations, trial and preparation for
testimony, will be paid monthly, as incurred, at the
following hourly rates:
Paul Hornsby: $235/hour
Staff Appraisers: $125-$200/hour
Research Assistant: $85/hour
Completion: As soon as possible, but not later than 60 days from
authorization.
If these terms are acceptable, please indicate by executing this agreement and returning one
copy to me. I look forward to working with you on this assignment.
