R -08-06-12-10B1 WHEREAS, the City of Round Rock, ("City") has previously entered into an Agreement Concerning Creation and Operation of The Meadows at Chandler Creek Municipal Utility District ("Agreement") dated May 10, 1984 whereby the City consented to the creation of the District, and WHEREAS, the Agreement provides that the City must approve any changes to Land Use Designations within the District, and WHEREAS, CAMCO Land, Ltd., the owner of property within the District has submitted a proposed amended. Land Use Plan to.the City for its review and approval, and WHEREAS, the City's Planning and Zoning Commission has reviewed the Land Use Plan and has recommended its approval, and WHEREAS, the City and CAMCO Land, Ltd. desire to enter into an Agreement and Development Plan for a 2.132 acre tract, in the Meadows of Chandler Creek Municipal Utility District, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City an Agreement and Development Plan for a 2.132 acre tract, in the Meadows of Chandler Creek Municipal Utility District, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. THE STATE OF TEXAS COUNTY OF WILLIAMSON THIS AGREEMENT and Development Plan is made and entered into by and between the City of Round Rock, Texas, a Texas municipal corporation, having its offices at 221 East Main Street, Round Rock, Texas 78664 (hereinafter referred to as the City), and CAMCO Land, Ltd., (hereinafter referred to as the Owner, whether one or more). WHEREAS, the Owner has submitted a request to the City to amend a Land Use Plan previously approved in an Agreement concerning Creation and Operation of the Meadows at Chandler Creek Municipal Utility District, dated May 10, 1984, and WHEREAS, on May 14, 2008, the City' s Planning and Zoning Commission recommended approval of the Owner' s request to amend said Plan, NOW THEREFORE BY THIS AGREEMENT WITNESSETH that, in consideration of the covenants and conditions set forth herein, the City and the Owner agree as follows: GENERAL PROVISIONS 1. Conformity with Development Plan All uses and development within the Property shall generally conform to the Development Plan set forth in Section II herein. 2. Changes and Modifications No changes or modifications will be made to this Agreement or the Development Plan unless all provisions pertaining to changes or modifications as stated below are followed. 3. Miscellaneous Provisions 3.1 Necessary Documents and Actions. Each party agrees to execute and deliver all such other and further instruments and undertake such actions as are or may become necessary or convenient to effectuate the purposes and intent of this Agreement. 1. 3.2 Severabilitv. In case one or more provisions contained herein are deemed invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provisions hereof and in such event, this Agreement shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein. 3.3 Entire Agreement. This Agreement constitutes the entire agreement of the parties and supersedes any prior or contemporaneous oral or written understandings or representations of the parties respecting the subject matter hereof. 3.4 Applicable Law. This Agreement shall be construed under and in accordance with the laws of the State of Texas. 3.5 Venue. All obligations of the parties created hereunder are performable in Williamson County, Texas and venue for any action arising hereunder shall be in Williamson County. 3.6 No Third Party Beneficiaries. Nothing in this Agreement, express or implied, is intended to confer upon any person or entity, other than the parties hereto (and their respective successors and assigns), any rights, benefits or remedies under or by reason of this Agreement. 3.7 Duplicate Originals. This Agreement may be executed in duplicate original, each of equal dignity. 3.8 Notices. DEVELOPMENT PLAN 1. Definitions Words and terms used herein shall have their usual force and meaning, or as defined in the Code of Ordinances, City of Round Rock, Texas, as amended, hereinafter referred to as the Code. 2. Property This Development Plan (Plan) covers the real property more particularly described in Exhibit A. attached hereto. 3. Purpose The purpose of this Plan is to insure a development that 1) is equal to or superior to development that would occur under the standard ordinance requirements , and 2) does not have an undue adverse affect upon adjacent property, the character of the neighborhood, traffic conditions, parking, utilities or any other matters affecting the public health, safety and . 4. Permitted Uses. The Property shall be used and developed for the uses set forth herein. 3. 4.1 General Commercial - Limited (C -1a). as described in the Code. with the following modifications: The following uses shall be prohibited: • Bed and Breakfast • Overnight Accommodations • Self-service car washes (the customer provides the labor and no self- propelled wash racks are provided) • Commercial Parking • Passenger Terminals • Vehicle Sales, Rental or Leasing facilities The following uses are allowed: • Full service car wash (the business provides the labor and cars are washed utilizing a self-propelled wash rack) • Urgent care medical clinic, with regular service hours not beginning before 7:OOAM and not extending past 9:OOPM 4.2 Additional Requirements for construction in General Commercial - Limited (C -1a): Earth tone color schemes shall be compatible with adjacent developments. Translucent vinyl awnings are prohibited. Approved awnings, with a minimum soffit distance of four (4) feet, must be 4:12 pitch or greater with materials equal to that approved for 3:12 sloped roofing. Roofing shall be tile, slate or non -reflective prefinished standing seam metals. (Galvalume is not permitted). All roofs shall be required to be sloping. Single sloped roofs are not acceptable unless constructed with continuous parapets and approved continuous awnings at all walls. Should mechanical equipment be placed on the roof it shall be completely screened from view in all directions. Roof pitches not behind parapets shall be 3:12 or greater. Horizontal wall articulations for single wall distances less than 150 feet must be a minimum of twelve (12) inches offset from the face of the primary wall and be a minimum of 24 inches in width. Should the minimum articulation be used, distances between articulations shall be no further than 40 feet. 4. 5. Changes to Agreement and Development Plan. 5.1 Minor Changes. Minor changes to this Agreement or Plan which do not substantially change this Plan may be approved administratively, if approved in writing, by the Director of Public Works, the Director of Planning and Community Development, and the City Attorney. 5.2 Ma'or Changes. Major changes shall be resubmitted following the same procedure required by the original application. Department: Staff Person: Justification: Planning and Community Development Jim Stendebach, Planning and Community Development Director The City Council has the authority, through a consent agreement with the Meadows of Chandler Creek MUD, to approve land use plan amendments within the MUD. The current land use plan was approved on January 23, 1992. The tract is located at the corner of two arterial roads, which meets the general plan's criteria for commercial zoning. The surrounding area at the intersection was designated for limited commercial, office and other similar uses when amendments to the MUD Land Use Plan were adopted in 2004 and 2006. The tract shall be subject to design standards similar to those required on adjacent limited commercial tracts. The MUD Board is in support of the land use amendment. Translucent vinyl awnings are prohibited. Approved awnings, with a minimum soffit distance of four (4) feet, must be 4:12 pitch or greater with materials equal to that approved for 3:12 sloped roofing. Roofing shall be tile, slate or non -reflective prefinished standing seam metals. (Galvalume is not permitted). All roofs shall be required to be sloping. Single sloped roofs are not acceptable unless constructed with continuous parapets and approved continuous awnings at all walls. Should mechanical equipment be placed on the roof it shall be completely screened from view in all directions. Roof pitches not behind parapets shall be 3:12 or greater. Horizontal wall articulations for single wall distances less than 150 feet must be a minimum of twelve (12) inches offset from the face of the primary wall and be a minimum of 24 inches in width.
