WHEREAS, the City of Round Rock has previously entered into a
Contract for Engineering Services ("Contract") with PBS&J for the
design of the extension of Creek Bend Boulevard from Creek Bend
Circle to Wyoming Springs Drive, and
WHEREAS, PBS&J has submitted Supplemental Contract No. 2 to
the Contract to modify the provisions for the scope of services and
to increase the fees, and
WHEREAS, the City Council desires to enter into said
Supplemental Contract No. 2 with PBS&J, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Contract No. 2 to the Contract with
PBS&J, a copy of same being attached hereto as Exhibit "A" and
incorporated herein for all purposes.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

This Supplemental Contract No. 2 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and PBS&J, hereinafter called the
"Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 23rd day of November, 2004 for the Creek Bend Drive (from Creek
Bend Cir. to Wyoming Springs Dr.) Project in the amount of $728,000.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services, to increase the compensation by $181,127.00 to a total of $909,127.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services, to increase the compensation by $198,376.00 to a total of $1,107,503.00; and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:
I.
Article 2, Engineering Services and Exhibit B, Engineering Services shall be amended as set
forth in the attached Addendum To Exhibit B. Exhibit C, Work Schedule shall be amended as
set forth in the attached Addendum To Exhibit C.
II.
Article 4, Compensation and Exhibit D, Fee Schedule shall be amended by increasing by
$198,376.00 the lump sum amount payable under the Contract for a total of $1,107,503.00, as
shown by the attached Addendum to Exhibit D.
IN WITNESS WHEREOF, the City and the Engineer have executed this Supplemental

ADDENDUM TO EXHIBIT B
Engineering Services
The changes to the scope of this project are as follows:
PHASE 2
The following is an understanding and outline of the scope of services that supports the Engineer's
Supplemental Work Authorization #2 fee schedule and cost proposal for the proposed City of Round
Rock Creek Bend roadway extension project located in Williamson County, Texas.
This scope of services reflects the work necessary to progress the current preliminary schematic
developed in Phase 1 through the environmental, mitigation, and water quality NEPA process. The
following supplemental expands the previously approved Phase 2 scope of services to include
enhanced environmental services.
FC 11 O TRAFFIC EVALUATIONS AND PROJECTIONS
The Engineer shall estimate the future traffic demand on the proposed Creek Bend Boulevard
extension from Wyoming Springs Drive to Bright Water Boulevard.
a) Initiation and Coordination
The Engineer will gather and review available data and identify the proposed roadway
major influence areas, competing roadways and feeder roadways. The proposed roadway
influence area is enclosed by Sam Bass Road, Parmer Lane, RM 620, and IH -35.
b) Data Collection and Analysis
The Engineer will assemble, review and analyze available traffic data, existing and future
planned land -use and special traffic generators within the project influence area. Based
on the review of the available data, additional traffic data requirements will be identified
consisting of Road Tube Counts (RTC). Traffic volumes will be measured for a typical
weekday Average Daily Traffic. An estimated six RTC locations are expected and these
count locations will be decided in coordination with the city. The Engineer will obtain
CAMPO travel demand model traffic estimates for opening year, 2015 and 2030
Planning Horizon. The Engineer will coordinate with Round Rock Independent School
District to gather or collect available bicycle and pedestrian traffic data.
c) Existing Traffic Pattern Assessment
The Engineer will analyze the existing traffic flow pattern on the related major roadways
(Hairy Man Road, Brightwater Boulevard, Wyoming Springs Drive, Sam Bass Road and
Creek Bend Boulevard). The Engineer will develop the criteria and methodology to
estimate the demand related to the residential area, special generators (school, hospital)
and through traffic. The developed criteria will also utilize Institute of Transportation
Engineers (ITE) trip generation rates to associate the current traffic demand to the land
use.
d) Build Condition Traffic Demand Estimation
The Engineer will forecast future traffic demand on the proposed Creek Bend Boulevard
extension for three scenarios (Opening Year, Year 2015 and Year 2030). The future
traffic estimate will be based on the estimated future trip generation and distribution due
to new development and the predicted change in traffic flow pattern due to the changed
network connectivity. The applied trip generation rates will be based on ITE
recommended trip generation. The developed technique will also utilize the observed
existing travel pattern, collected background traffic data and will perform the
reasonableness check of the estimated demand. A validation review with available
CAMPO traffic forecast will be performed. The Engineer will respond to comments
from the City prior to finalizing the report. The Engineer shall respond to comments on
the draft report.

FC 12O ENVIRONMENTAL DOCUMENTATION
9. Geological Resources
c. Phase II Karst Feature Survey
The Engineer will conduct an investigation of the 16 karst features identified
during the Phase I survey. The investigation will be conducted in accordance with
USFWS draft protocols dated April 2002. Karst survey tasks to be completed are
described below:
i) Contractor Oversight
The Engineer will perform oversight of selected contractors to install security
fencing around selected karst features that will undergo hand excavation during the
Phase II investigation. The Engineer will provide staff to be present onsite to
oversee contractors during field activities. In addition, the Engineer will provide
staff to remove brush from the features in order to gain access for the Phase II
investigation. A minimum of four staff days to complete these efforts is
anticipated.
The Engineer shall be responsible for the cost of the brush removal contractor.
ii) Phase II Karst Feature Investigation
The Engineer will perform a hand excavation of selected karst features for the
primary intent of conducting a habitat assessment for federally listed karst
invertebrates. The survey will consist of removing rock and soil from natural karst
features to determine subsurface extent and the nature of the potential subsurface
void. All excavated material will be spread into the adjacent topsoil to be
incorporated into the soil. Rocks will be placed in the adjacent area so as not to
create favorable conditions for imported fire ant colonies.
Each excavation will be evaluated and a determination made to the presence of
habitat and the suitability of providing unique conditions for karst invertebrates to
occur. If suitable habitat is not encountered, the excavation will be backfilled with
rocks.
If suitable habitat is encountered, a biological collection will be performed by a
scientist permitted by the USFWS. The process involves three separate collections
over a period of 72 hours. Upon completion, the karst feature will be preserved in
its current condition.
iii) Phase II Karst Survey
The Engineer shall survey the Karst features identified within the study limits
during the Phase I Karst Survey and prepare graphic exhibit showing the karst
features relative to the schematic.

d. Geological Assessment
The Engineer will conduct a geologic assessment (as per TCEQ instructions -
0585) to determine the presence and sensitivity of natural and man-made
features which may provide point recharge to the Edwards Aquifer. The
purpose of the assessment is to identify all potential pathways for contaminant
movement to the Edwards Aquifer and provide geologic information so that the
appropriate Best Management Practice is proposed. The natural features may
also provide habitat for federally listed endangered karst invertebrates, or result
in structural concerns to the project. The tasks to be performed during the
geologic assessment are described below.
i) Background Geology
Published geologic reports will be reviewed and the information used to
establish the geologic conditions beneath the project site. Primary sources of
information will be geological reports published by the Bureau of Economic
Geology and U.S. Geological Survey. Other sources including fault and
lineament maps, and topographic maps will also be reviewed as available.
Relevant cave -related publications including published cave surveys will be
reviewed for any known features within a 1 -kilometer (km) radius of the
site.
ii) Aerial Photography Examination
Aerial photography of the project and surrounding areas may be
examined for evidence of fractures, lineaments, sinkholes, lithologic
contacts, and other potentially relevant karst features.
iii) Field Survey
The Engineer will conduct a walking survey of the project area to locate
and describe geologic and manmade features. The survey will be
conducted along transects that normally have 50 foot spacing, unless site
conditions require more closely spaced transects. The survey will be
conducted by a qualified geologist meeting TCEQ criteria for a karst
geologist. Identified features will be marked with flagging and
photographed, and their positions will be determined using a handheld
GPS instrument.
The feature will be closely evaluated to determine the features
characteristics including type, dimensions, trend, density, aperture,
infilling, and relative infiltration rate; and the physical setting (i.e.
topographic location). This information will be used to populate the
geologic assessment table (TCEQ-0585-table) to determine the features
sensitivity to recharge the Edwards Aquifer.
iv) Report Preparation
Karst feature survey findings will be included in the site assessment
report. The report will include the geologic assessment table with a
description of each feature that includes the dimensions, type, trend, and
geologic characteristics. The report will also include attachments that
summarize the soils at the site, a stratigraphic column illustrating the
stratigraphy of the area, and a narrative description of the site geology.
The report will also include a map illustrating the approximate location of
each karst feature.
The Engineer will respond to comments from the City, TxDOT Austin District,
TxDOT ENV, and TCEQ prior to finalizing the report.

e. Coordination with Texas Commission on Environmental Quality
In order to determine if a natural buffer will be required at any of the karst
features identified within the project area, the Engineer will initiate consultation
with the Texas Commission on Environmental Quality (TCEQ) regarding the
characterization of karst features identified in the project area. For the
purposes of the scope of services, the Engineer assumes attendance at two (2)
meetings with TCEQ, the City and TxDOT. The Engineer shall prepare the
meeting materials and minutes accordingly.
The Engineer will provide TCEQ with copies of the Phase I and Phase II Karst
Survey Reports. Following their review of the Karst Survey Reports, TCEQ will
make a determination of the sensitivity of the karst features.
The Engineer shall coordinate an on-site inspection of selected karst features
with TCEQ personnel to verify conditions of the karst features.
12. Cultural Resources
b. Non -Archaeological Historic Resource Studies
iii. Section 106 Coordination with Property Owner
The Engineer shall coordinate (prepare transmittal letters and provide deliverables)
the submittal of all Section 106 deliverables to the property owner.

15. Section 4(0 Properties
a. Record Boundary Exhibit: The Engineer will investigate and prepare a record boundary
exhibit showing the platted parkland, Clarence Sauls' boundary lines and County ROW
in the area impacted by the Hairy Man Road tie-in.
b. Parkland Boundary Survey: Dependent upon preliminary determination of the impact to
parkland, additional surveys will be performed for the purpose of determining boundary
and ROW limits within the affected area. If a ROW acquisition is necessary, the
Engineer shall prepare a parcel description and graphic exhibit for the ROW dedication
document. The Engineer will prepare a detailed exhibit to accompany the preliminary
schematic for presentation purposes.
c. Avoidance Alternatives: The Engineer shall evaluate options to avoid and minimize
impacts to the parkland.
d. Section 4(f) Evaluation: The Engineer will prepare a Section 4(f) Evaluation seeking
FHWA approval that the impact to the park qualifies as "de minimis". The Section 4(f)
evaluation shall contain and summarize all data necessary to support a Section 4(f)
document approval by FHWA (23 C.F.R. 771.127 (a) and 23 C.F.R. 771.135. In
accordance with the format provided by the State, the evaluation will document the
following:
i. Purpose and Need for the Proposed Action
ii. Description of the 4(f) Resources
iii. Impacts to the Resources
iv. Avoidance Alternatives (limited to a discussion of those developed in the
Categorical Exclusion)
v. Measures to Minimize Harm
vi. Coordination with Resource Agency/Owner
Following the review of the Draft Section 4(0 Evaluation by the City, TxDOT Austin
District and TxDOT ENV, the Engineer will respond to comments and submit the
revised draft for the FHWA review. The Engineer will respond to comments from
FHWA, incorporate the results of the public hearing, and submit the Final Section 4(0
Evaluation.

18. Right of Entry
a. Right -of -Entry (ROE) Coordination — Clarence Sauls' Tract
i) Access Gate Installation: The Engineer shall coordinate the selection of and
perform oversight of contractors to install an access gate to the property for field
surveys.
ii) Corridor Staking: The Engineer will stake the 500 -ft corridor limits on one
hundred foot stations.
iii) Brush Removal: The Engineer shall provide services to expedite the brush
removal process, minimize subcontractor brush removal expenses and overall
brush removal costs. The Engineer will assist the subcontractor in removing tree
trimmings from the site.
iv) Property Access Communication Plan and Entry Notification Process: The
Engineer shall develop and implement a communication plan and an entry
notification process to inform the property owner and City of all anticipated field
activities. This plan shall include written notice of upcoming weekly activities on
the Saul's tract, daily sign-in/sign-out procedures and daily communication with
the property owner advising him of the completion of daily work activities on his
property.
F. Public Involvement
1. Public Meeting
The magnitude of public interest and comments exceeded the original scope effort and
work that were budgeted for the public meeting. The scope effort includes the following
activities:
• The Engineer shall provide a court reporter to attend the public meeting.
• Additional effort is included for the Engineer to review and respond to all public
comments received as a part of the public meeting comments disposition.
• Additional effort for the Engineer to participate in up to two informal public meetings.

2. Public Hearing
Based on the level of public interest and comments received for the public meeting,
additional effort beyond the original scope effort and work budgeted for the public hearing
has been included. The scope effort includes the following activities:
• The Engineer shall provide a court reporter to attend the public hearing.
• Additional effort is included for the Engineer to review and respond to all public
comments received as a part of the public meeting comments disposition.
• The Engineer shall coordinate with and assist the City of Round Rock in the
preparation of a brief PowerPoint presentation of the project background for the public
hearing.

G. Environmental Coordination
1. Coordination Meetings
The Engineer shall prepare the meeting materials and minutes accordingly. A maximum
of eight (8) meetings shall be conducted with all interested parties (the City, TxDOT
Area Office, TxDOT Austin District, and TxDOT ENV).

• Meeting material (agenda, exhibits, handouts) and minutes.
2. Intensive Field Investigations Coordination
The Engineer shall prepare a memorandum describing the intensive archaeological, karst,
and threatened & endangered species habitat surveys to be performed for legal review. The
Engineer shall coordinate with the City to obtain legal interpretation and consent of
acceptable activities as per the ROE agreement.

H. Environmental Assessment Classification Letter
In accordance with guidance received by TxDOT ENV, the Engineer shall prepare an EA
classification letter for review and approval by FHWA that establishes the significance of the
environmental impacts under 23 CFR 771.119. The Engineer shall respond to up to two rounds
(Austin District and TxDOT ENV) of comments on the draft and finalize the letter for submittal
to FHWA.

ENVIRONMENTAL ASSUMPTIONS
• An Endangered Species permitting will not be required.
• The City of Round Rock or TxDOT shall provide the public hearing officer.

C. The additional work shall consist of revised limits of topographic, planimetric, and tree surveys.
The engineer shall expend additional efforts, as required, due to un -anticipated conditions in order
to expedite and complete topographic, planimetric and tree surveys in previously in -accessible
areas.

Background Information:
City Council approved resolution R -04-11-23-9C2 for Phase II engineering services on November
23, 2004 and resolution R -07-03-08-12B2 for supplemental contract #1 on March 8, 2007. This
supplemental contract increases the total contract amount to $1,107,503.00.
The extension of Creek Bend includes construction of a 4 -lane divided arterial roadway with
curb and gutter, a bridge over Brushy Creek, bicycle/pedestrian facilities within the right-of-way
and drainage and adjustments to utilities. This roadway extension will provide a new north -
south crossing of Brushy Creek west of IH 35, which will improve mobility, add travel capacity,
improve safety by providing an all-weather crossing of Brushy Creek between IH 35 and Parmer
Lane and improve emergency response times.

WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 23rd day of November, 2004 for the Creek Bend Drive (from Creek
Bend Cir. to Wyoming Springs Dr.) Project in the amount of $728,000.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services, to increase the compensation by $181,127.00 to a total of $909,127.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services, to increase the compensation by $198,376.00 to a total of $1,107,503.00; and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:

ADDENDUM TO EXHIBIT B
Engineering Services
The changes to the scope of this project are as follows:
PHASE 2
The following is an understanding and outline of the scope of services that supports the Engineer's
Supplemental Work Authorization #2 fee schedule and cost proposal for the proposed City of Round
Rock Creek Bend roadway extension project located in Williamson County, Texas.
This scope of services reflects the work necessary to progress the current preliminary schematic
developed in Phase 1 through the environmental, mitigation, and water quality NEPA process. The
following supplemental expands the previously approved Phase 2 scope of services to include
enhanced environmental services.
FC110 TRAFFIC EVALUATIONS AND PROJECTIONS
The Engineer shall estimate the future traffic demand on the proposed Creek Bend Boulevard
extension from Wyoming Springs Drive to Bright Water Boulevard.
a) Initiation and Coordination
The Engineer will gather and review available data and identify the proposed roadway
major influence areas, competing roadways and feeder roadways. The proposed roadway
influence area is enclosed by Sam Bass Road, Parmer Lane, RM 620, and IH -35.
b) Data Collection and Analysis
The Engineer will assemble, review and analyze available traffic data, existing and future
planned land -use and special traffic generators within the project influence area. Based
on the review of the available data, additional traffic data requirements will be identified
consisting of Road Tube Counts (RTC). Traffic volumes will be measured for a typical
weekday Average Daily Traffic. An estimated six RTC locations are expected and these
count locations will be decided in coordination with the city. The Engineer will obtain
CAMPO travel demand model traffic estimates for opening year, 2015 and 2030
Planning Horizon. The Engineer will coordinate with Round Rock Independent School
District to gather or collect available bicycle and pedestrian traffic data.
c) Existing Traffic Pattern Assessment
The Engineer will analyze the existing traffic flow pattern on the related major roadways
(Hairy Man Road, Brightwater Boulevard, Wyoming Springs Drive, Sam Bass Road and
Creek Bend Boulevard). The Engineer will develop the criteria and methodology to
estimate the demand related to the residential area, special generators (school, hospital)
and through traffic. The developed criteria will also utilize Institute of Transportation
Engineers (ITE) trip generation rates to associate the current traffic demand to the land
use.
d) Build Condition Traffic Demand Estimation
The Engineer will forecast future traffic demand on the proposed Creek Bend Boulevard
extension for three scenarios (Opening Year, Year 2015 and Year 2030). The future
traffic estimate will be based on the estimated future trip generation and distribution due
to new development and the predicted change in traffic flow pattern due to the changed
network connectivity. The applied trip generation rates will be based on ITE
recommended trip generation. The developed technique will also utilize the observed
existing travel pattern, collected background traffic data and will perform the
reasonableness check of the estimated demand. A validation review with available
CAMPO traffic forecast will be performed. The Engineer will respond to comments
from the City prior to finalizing the report. The Engineer shall respond to comments on
the draft report.

FC12O ENVIRONMENTAL DOCUMENTATION
9. Geological Resources
c. Phase II Karst Feature Survey
The Engineer will conduct an investigation of the 16 karst features identified
during the Phase I survey. The investigation will be conducted in accordance with
USFWS draft protocols dated April 2002. Karst survey tasks to be completed are
described below:
i) Contractor Oversight
The Engineer will perform oversight of selected contractors to install security
fencing around selected karst features that will undergo hand excavation during the
Phase II investigation. The Engineer will provide staff to be present onsite to
oversee contractors during field activities. In addition, the Engineer will provide
staff to remove brush from the features in order to gain access for the Phase II
investigation. A minimum of four staff days to complete these efforts is
anticipated.
The Engineer shall be responsible for the cost of the brush removal contractor.
ii) Phase II Karst Feature Investigation
The Engineer will perform a hand excavation of selected karst features for the
primary intent of conducting a habitat assessment for federally listed karst
invertebrates. The survey will consist of removing rock and soil from natural karst
features to determine subsurface extent and the nature of the potential subsurface
void. All excavated material will be spread into the adjacent topsoil to be
incorporated into the soil. Rocks will be placed in the adjacent area so as not to
create favorable conditions for imported fire ant colonies.
Each excavation will be evaluated and a determination made to the presence of
habitat and the suitability of providing unique conditions for karst invertebrates to
occur. If suitable habitat is not encountered, the excavation will be backfilled with
rocks.
If suitable habitat is encountered, a biological collection will be performed by a
scientist permitted by the USFWS. The process involves three separate collections
over a period of 72 hours. Upon completion, the karst feature will be preserved in
its current condition.
iii) Phase II Karst Survey
The Engineer shall survey the Karst features identified within the study limits
during the Phase I Karst Survey and prepare graphic exhibit showing the karst
features relative to the schematic.

d. Geological Assessment
The Engineer will conduct a geologic assessment (as per TCEQ instructions -
0585) to determine the presence and sensitivity of natural and man-made
features which may provide point recharge to the Edwards Aquifer. The
purpose of the assessment is to identify all potential pathways for contaminant
movement to the Edwards Aquifer and provide geologic information so that the
appropriate Best Management Practice is proposed. The natural features may
also provide habitat for federally listed endangered karst invertebrates, or result
in structural concerns to the project. The tasks to be performed during the
geologic assessment are described below.
i) Background Geology
Published geologic reports will be reviewed and the information used to
establish the geologic conditions beneath the project site. Primary sources of
information will be geological reports published by the Bureau of Economic
Geology and U.S. Geological Survey. Other sources including fault and
lineament maps, and topographic maps will also be reviewed as available.
Relevant cave -related publications including published cave surveys will be
reviewed for any known features within a 1 -kilometer (km) radius of the
site.
ii) Aerial Photography Examination
Aerial photography of the project and surrounding areas may be
examined for evidence of fractures, lineaments, sinkholes, lithologic
contacts, and other potentially relevant karst features.
iii) Field Survey
The Engineer will conduct a walking survey of the project area to locate
and describe geologic and manmade features. The survey will be
conducted along transects that normally have 50 foot spacing, unless site
conditions require more closely spaced transects. The survey will be
conducted by a qualified geologist meeting TCEQ criteria for a karst
geologist. Identified features will be marked with flagging and
photographed, and their positions will be determined using a handheld
GPS instrument.
The feature will be closely evaluated to determine the features
characteristics including type, dimensions, trend, density, aperture,
infilling, and relative infiltration rate; and the physical setting (i.e.
topographic location). This information will be used to populate the
geologic assessment table (TCEQ-0585-table) to determine the features
sensitivity to recharge the Edwards Aquifer.
iv) Report Preparation
Karst feature survey findings will be included in the site assessment
report. The report will include the geologic assessment table with a
description of each feature that includes the dimensions, type, trend, and
geologic characteristics. The report will also include attachments that
summarize the soils at the site, a stratigraphic column illustrating the
stratigraphy of the area, and a narrative description of the site geology.
The report will also include a map illustrating the approximate location of
each karst feature.
The Engineer will respond to comments from the City, TxDOT Austin District,
TxDOT ENV, and TCEQ prior to finalizing the report.

e. Coordination with Texas Commission on Environmental Quality
In order to determine if a natural buffer will be required at any of the karst
features identified within the project area, the Engineer will initiate consultation
with the Texas Commission on Environmental Quality (TCEQ) regarding the
characterization of karst features identified in the project area. For the
purposes of the scope of services, the Engineer assumes attendance at two (2)
meetings with TCEQ, the City and TxDOT. The Engineer shall prepare the
meeting materials and minutes accordingly.
The Engineer will provide TCEQ with copies of the Phase I and Phase II Karst
Survey Reports. Following their review of the Karst Survey Reports, TCEQ will
make a determination of the sensitivity of the karst features.
The Engineer shall coordinate an on-site inspection of selected karst features
with TCEQ personnel to verify conditions of the karst features.

iii. Section 106 Coordination with Property Owner
The Engineer shall coordinate (prepare transmittal letters and provide deliverables)
the submittal of all Section 106 deliverables to the property owner.

15. Section 4(0 Properties
a. Record Boundary Exhibit: The Engineer will investigate and prepare a record boundary
exhibit showing the platted parkland, Clarence Sauls' boundary lines and County ROW
in the area impacted by the Hairy Man Road tie-in.
b. Parkland Boundary Survey: Dependent upon preliminary determination of the impact to
parkland, additional surveys will be performed for the purpose of determining boundary
and ROW limits within the affected area. If a ROW acquisition is necessary, the
Engineer shall prepare a parcel description and graphic exhibit for the ROW dedication
document. The Engineer will prepare a detailed exhibit to accompany the preliminary
schematic for presentation purposes.
c. Avoidance Alternatives: The Engineer shall evaluate options to avoid and minimize
impacts to the parkland.
d. Section 4(f) Evaluation: The Engineer will prepare a Section 4(f) Evaluation seeking
FHWA approval that the impact to the park qualifies as "de minimis". The Section 4(i)
evaluation shall contain and summarize all data necessary to support a Section 4(f)
document approval by FHWA (23 C.F.R. 771.127 (a) and 23 C.F.R. 771.135. In
accordance with the format provided by the State, the evaluation will document the
following:
i. Purpose and Need for the Proposed Action
ii. Description of the 4(f) Resources
iii. Impacts to the Resources
iv. Avoidance Alternatives (limited to a discussion of those developed in the
Categorical Exclusion)
v. Measures to Minimize Harm
vi. Coordination with Resource Agency/Owner
Following the review of the Draft Section 4(0 Evaluation by the City, TxDOT Austin
District and TxDOT ENV, the Engineer will respond to comments and submit the
revised draft for the FHWA review. The Engineer will respond to comments from
FHWA, incorporate the results of the public hearing, and submit the Final Section 4(0
Evaluation.

18. Right of Entry
a. Right -of -Entry (ROE) Coordination — Clarence Sauls' Tract
i) Access Gate Installation: The Engineer shall coordinate the selection of and
perform oversight of contractors to install an access gate to the property for field
surveys.
ii) Corridor Staking: The Engineer will stake the 500 -ft corridor limits on one
hundred foot stations.
iii) Brush Removal: The Engineer shall provide services to expedite the brush
removal process, minimize subcontractor brush removal expenses and overall
brush removal costs. The Engineer will assist the subcontractor in removing tree
trimmings from the site.
iv) Property Access Communication Plan and Entry Notification Process: The
Engineer shall develop and implement a communication plan and an entry
notification process to inform the property owner and City of all anticipated field
activities. This plan shall include written notice of upcoming weekly activities on
the Saul's tract, daily sign-in/sign-out procedures and daily communication with
the property owner advising him of the completion of daily work activities on his
property.
F. Public Involvement
1. Public Meeting
The magnitude of public interest and comments exceeded the original scope effort and
work that were budgeted for the public meeting. The scope effort includes the following
activities:
• The Engineer shall provide a court reporter to attend the public meeting.
• Additional effort is included for the Engineer to review and respond to all public
comments received as a part of the public meeting comments disposition.
• Additional effort for the Engineer to participate in up to two informal public meetings.

2. Public Hearing
Based on the level of public interest and comments received for the public meeting,
additional effort beyond the original scope effort and work budgeted for the public hearing
has been included. The scope effort includes the following activities:
• The Engineer shall provide a court reporter to attend the public hearing.
• Additional effort is included for the Engineer to review and respond to all public
comments received as a part of the public meeting comments disposition.
• The Engineer shall coordinate with and assist the City of Round Rock in the
preparation of a brief PowerPoint presentation of the project background for the public
hearing.

G. Environmental Coordination
1. Coordination Meetings
The Engineer shall prepare the meeting materials and minutes accordingly. A maximum
of eight (8) meetings shall be conducted with all interested parties (the City, TxDOT
Area Office, TxDOT Austin District, and TxDOT ENV).
Deliverables
• Meeting material (agenda, exhibits, handouts) and minutes.
2. Intensive Field Investigations Coordination
The Engineer shall prepare a memorandum describing the intensive archaeological, karst,
and threatened & endangered species habitat surveys to be performed for legal review. The
Engineer shall coordinate with the City to obtain legal interpretation and consent of
acceptable activities as per the ROE agreement.
Deliverables
• Intensive Field Investigations Requiring ROE Consent Memorandum.
H. Environmental Assessment Classification Letter
In accordance with guidance received by TxDOT ENV, the Engineer shall prepare an EA
classification letter for review and approval by FHWA that establishes the significance of the
environmental impacts under 23 CFR 771.119. The Engineer shall respond to up to two rounds
(Austin District and TxDOT ENV) of comments on the draft and finalize the letter for submittal
to FHWA.

ENVIRONMENTAL ASSUMPTIONS
• An Endangered Species permitting will not be required.
• The City of Round Rock or TxDOT shall provide the public hearing officer.

The engineer shall expend additional efforts, as required, due to un -anticipated conditions in order
