WHEREAS, the City of Round Rock has previously entered into an
Agreement for Engineering Services ("Agreement") with Chiang, Patel
& Yerby, Inc. for the preparation of schematics, environmental
documents, plans specifications, and estimates (PS&E) for the
reconstruction of Kiphen Road from the old MKT Railroad Right of Way
to CR 122 (Kiphen Road Phase II Project), and
WHEREAS, Chiang, Patel & Yerby, Inc. has submitted Supplemental
Agreement No. 5 to the Agreement for a change in the scope of
services, and
WHEREAS, the City Council desires to enter into said
Supplemental Agreement No. 5 with Chiang, Patel & Yerby, Inc., Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 5 to the Agreement
with Chiang, Patel & Yerby, Inc., a copy of same being attached
hereto as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

This Supplemental Agreement No. 5 to Agreement for Engineering Services is made by and
between the City of Round Rock, Texas, hereinafter called the "City" and Chiang, Patel & Yerby
Inc., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed an Agreement for Engineering Services,
hereinafter called the "Agreement", on the 26th day of September, 2002 for Kiphen Road from
the old MKT Railroad ROW to CR 122 (Kiphen Road Phase II Project) for the sum of
$842,309.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 1 on July 10, 2003
to amend the scope of services and to increase the compensation by $51,582.00 to a total of
$893,891.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 2 on May 26, 2005
to extend the Agreement and to modify the provision for notices to proceed; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 3 on November 22,
2005 to amend the scope of services and to increase the compensation by $122,157.00 to a total
of $1,016,048.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 4 on March 22, 2007
to amend the scope of services and to increase the compensation by $105,159.00 to a total of
$1,121,207.00; and
WHEREAS, it has become necessary to amend the Agreement to modify the provisions for the
scope of services and to increase the compensation by $108,528.00 to a total of $1,229,735.00;
and
NOW THEREFORE, premises considered, the City and the Engineer agree that said
Agreement is amended as follows:

ADDENDUM TO EXHIBIT B
Services to be provided by the Engineer
The changes to the scope of this project are as follows:
The Engineer shall provide the necessary engineering and technical services for the preparation of Plans, Specifications and
Estimates (PS&E) for extending the Kiphen Road (Phase II) project limits approximately 500' to the west. The revised
construction plans will describe the construction of a four -lane divided urban arterial roadway with a raised concrete curb
and gutter median. The Project also includes revisions to the intersection with existing Kiphen Road and the addition of a
driveway for future development.
The revised plans will contain the required drawings and details pertaining to grading, paving, signing, pavement marking,
delineation, sequence of construction, traffic control, illumination and drainage. The above-described plans will be
prepared in English units and shall be suitable for the bidding and award of a contract through the City of Round Rock's
construction contracting system. This project will be designed using English units of measure. Scales and submittals
referred to in this scope of services assume an 11" X 17" construction plan sheet.
The revised limits will incorporate part of the Kiphen Road Phase I design which is currently contained within the Texas
Department of Transportation's construction plans for FM 1460 (CSJ No. 2211-02-015). The revised plans will be modified
to construct only a portion of the Kiphen Phase I design contained in the TxDOT plan set. The new limits of work are
anticipated to begin near Station 25+00 (FM 1460 plan set) and tie into the Kiphen Road Phase II plans at Station 59+95.
Modifications include revisions to detours, grading, paving, signing, pavement marking, delineation, sequence of
construction, traffic control, illumination and drainage. In addition, the plans will include Water Utility Plans for 2-8" water
line connections along Kiphen Circle.
The designs included in the above described PS&E shall be in accordance with the requirements of the 1984 edition ITE's
GUIDELINES FOR URBAN MAJOR STREET DESIGN, the 2004 edition of AASHTO's A POLICY ON GEOMETRIC
DESIGN OF HIGHWAY AND STREETS, TEXAS MANUAL OF UNIFORM TRAFFIC CONTROL DEVICES
including Part VI.
The Engineer will establish a roadway geometry model and perform earthwork and paving quantity calculations with the
Bentley Microstation enhancement known as GEOPAK. The CADD and GEOPAK criteria files, which comprise the
geometry model, shall be provided to the City at the completion of the project.
Hydraulic designs and calculations for inlets and storm sewers will be performed using WINSTORM or an equivalent
program.
These additional services are described in the TASK OUTLINE shown below.
TASK OUTLINE
The Engineer will revise and/or add construction plans in the following items to accommodate the inclusion of the revised
project limits:
I. ROUTE AND DESIGN STUDIES (Function Code 110)
A. DATA COLLECTION
1. Collect and review available data for Kiphen Road and adjacent areas and roadways. The Engineer will also
perform field investigations to aid in this task. The Engineer will also review this data to determine the
applicability of each item to the project roadway.
2. Research and identify significant issues, as perceived by the City of Round Rock, or local officials who may
influence the location and selection of the roadway alignment and features.
3. Develop the roadway design criteria for the project to be discussed, revised and approved by the City prior to
commencing design activities.

B. TEMPORARY DETOUR SCHEMATICS
1. The Engineer will prepare calculated horizontal and vertical geometrics for the temporary detour. Design will
be based on existing digital photography and vertical terrain information previously provided by the City.
2. The Engineer will develop a typical section in accordance with the City's design criteria for the temporary
detour.
3. Preliminary culvert sizing will be performed for the purposes of estimating vertical grade constraints on the
project roadway, as well as determining drainage easement requirements.
II. RIGHT-OF-WAY DATA AND UTILITY ADJUSTMENTS (Function Code 130)
A. UTILITY COORDINATION AND RESEARCH
1. Identify existing utilities in conflict with this project by researching existing plans, contacting utility
companies, field reconnaissance and survey.
2. The Engineer will provide plan and profiles, culvert layouts, and other sheets as required to utility providers to
assist them in their relocation efforts.
B. RELOCATION OF CITY UTILITIES
1. Upon determination of any relocation requirements for City of Round Rock owned utilities, the Engineer will
provide utility relocation plans and details through a supplemental agreement to this contract.
2. The Engineer will develop utility plans for inclusion into the PS&E package for the design of two
approximately 8" water lines that will service businesses south of Kiphen Road.
C. RIGHT-OF-WAY
1. The Engineer will establish right-of-way easements and locations for one temporary construction detour.
2. Acquire ROW information, research ROW information and coordinate parcel plats and metes and bounds.
3. Coordinate with subconsultant.
1II. ROADWAY DESIGN CONTROLS (Function Code 160)
A. REVISIONS TO ROADWAY PLANS
1. Index of sheets will be revised to include new plan sheets.
2. Project layouts will be revised to show the new limits of the project.
3. Typical sections will be revised to indentify limits of various pavement thicknesses.
4. Design cross sections will be revised to include extended project limits and updated detour profile to
determine cut and fill quantities. These will be provided upon contractor's request in "roll" format or on
individual plan sheets. The Geopak design software package will be utilized to produce these cross sections.
5. Vertical geometry will be revised to include Kiphen Phase I geometry. Two existing driveways will be
modified including grading and additional drainage features. Proposed driveways from Kiphen Phase II will
be added to the plan set.
6. Horizontal alignment will be revised to include Kiphen Phase I geometry. Modifications to the horizontal data
sheet will be prepared.

7. Roadway plan and profile will be revised to include Kiphen Phase I driveways, medians, intersections and
alignments.
8. Supplementary grading sheets will be revised showing critical vertical information for the proper grading of
intersections, driveways and around drainage features.
9. Miscellaneous paving detail sheets will be revised showing such items as driveway details, curb end details,
and any other details as may be necessary.
IV. DRAINAGE (Function Code 161)
A. REVISIONS TO STORM SEWERS, EROSION CONTROL AND SW3P
1. Major drainage areas will be identified and hydrologic information will be calculated within the revised limits.
An exterior drainage area map will be produced depicting this information and culvert structure locations.
The Engineer shall prepare the drainage area maps at a scale of 1"=200' or as necessary to fit on standard
sheets. Storm water detention will not be required on this project.
2. Interior drainage area maps will be created at a scale of 1"=100' within the revised limits. These maps will
depict drainage area boundaries and flow direction arrows. Each area will be identified with a unique number
to be used to find run-off information from the calculation sheets. Design run-off shall be based on the
expected ultimate developed state of each area (ultimate flow).
3. Within the revised limits, run-off to each inlet and inlet hydraulic information will be calculated in accordance
with the City of Austin's drainage criteria and shown on the run-off and inlet computation sheets. A clear
roadway width (not impacted by spread of water in the gutter) of twelve feet in each travel direction shall be
maintained for the ultimate 25 year flow. Depth of 25 year ultimate flow shall not exceed curb height of six
(6) inches.
4. Storm sewers will be analyzed and computations will be prepared for the storm sewer design within the
revised limits.
5. Within the revised limits, storm sewers and inlets will be designed to intercept and transport the ultimate 25
year flow at a minimum, with the ultimate 100 year flow contained within the defined rights-of-way or
easements.
6. Storm sewer outfall points will be confirmed through the above hydraulic design and the Engineer will
finalize drainage easements requirements within the revised limits. The Engineer will design and detail
drainage outfall channels in accordance with the City of Austin drainage design criteria. Maintenance access
to each outfall shall be addressed in the design.
7. Drainage and erosion control plan sheets will be prepared depicting locations of inlets, manholes, storm
sewers, culverts, utilities, channel improvements, and ditch locations and flowlines as required within the
revised limits. These plans will also show erosion controls measures required for construction of the project.
Erosion control measures will be described for the project in its entirety, but will not be divided by traffic
control phase. The anticipated design components of the erosion control plans to be utilized on this project
are silt fence, sand bags, rock filter dams, sediment traps, and construction exits. These sheets will be
prepared at a scale of 1"=50'.
8. Within the revised limits, storm sewer profiles will be prepared at a scale of 1"=50' H and 1"=5' V. Storm
sewer profiles will show pipe size and type, slope, existing and proposed ground lines above the pipe,
pertinent hydraulic information including hydraulic grade lines (HGL) for storm sewers flowing full or under
pressure, and locations and sizes of inlets and junctions. HGL for 25 year storm shall be a minimum of six (6)
inches below the theoretical gutter flowline elevation at inlets.

9. A Storm Water Pollution Prevention Plan (SW3P) will be prepared for this job in accordance with TCEQ
regulations within the revised limits. This sheet will consist of the TxDOT SW3P text sheet that summarizes
erosion control measures.
10. The Engineer will develop plans for temporary drainage facilities necessary to allow staged construction of
the project within the revised limits. Required temporary drainage structures will be designed for a 2 -year
frequency event. No specific design details or calculation will be included in the plan sheets other than
structure size, flow line elevations and approximate structure location. Temporary drainage ditches between
temporary drainage structures and outfall locations will be evaluated and designated in the plans as a typical
ditch section. Notes shall be included in the plan to maintain positive drainage for these temporary ditches.
V. SIGNING AND PAVEMENT MARKINGS (Function Code 162)
A. REVISIONS TO SIGNING AND PAVEMENT MARKINGS
1. Signing and pavement marking layouts will be revised to include the new project limits.
2. Detail sheets for small signs will be revised to include the new project limits.
3. Pavement marking details will be revised to include the new project limits.
VI. MISCELLANEOUS ROADWAY (Function Code 163)
A. REVISIONS TO TRAFFIC CONTROL
1. Traffic control layouts will be prepared showing revisions to the overall layout of each phase of the
construction.
2. Detailed traffic control plans will be revised including typical sections, detour profiles, location of work areas,
temporary paving, temporary shoring, signing, barricades and other details will be required to describe the
traffic control plan. The Engineer will be required to ensure that proper drainage can be maintained during
each phase of construction.
3. The detailed narrative for the sequence of construction will be revised as necessary for the planned revisions.
B. REVISIONS TO ILLUMINATION
1. Illuminations plans will be revised including design and development of plan sheets along Kiphen Road
within the extended limits to accommodate changes to the roadway plan limits.
2. Voltage and luminance calculations will be run and analyzed to ensure the redesign meets all specifications
and requirements.

VII. DESIGN VERIFICATION, CHANGES AND ALTERATIONS (Function Code 351)
A. REVISIONS TO CONSTRUCTION PHASE SERVICES
1. The Engineer will continue Construction Phase Services as outlined in the original Agreement. Due to
planned revisions, the project schedule has been extended for approximately (5) five months. The Engineer
will continue Construction Phase Services for an additional (5) five months beyond the current construction
schedule.

the West of OId Settlers Boulevard (Kiphen Road) Phase II. The construction plans have been
revised to reflect the construction of a four -lane divided urban arterial roadway with a raised
concrete curb and gutter median.

Background Information:

Road) Phase I design. The new limits of work are anticipated to begin near Station 51+80 and tie

This Supplemental Agreement No. 5 to Agreement for Engineering Services is made by and
between the City of Round Rock, Texas, hereinafter called the "City" and Chiang, Patel & Yerby
Inc., hereinafter called the "Engineer".
WHEREAS, the City and Engineer executed an Agreement for Engineering Services,
hereinafter called the "Agreement", on the 26th day of September, 2002 for Kiphen Road from
the old MKT Railroad ROW to CR 122 (Kiphen Road Phase II Project) for the sum of
$842,309.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 1 on July 10, 2003
to amend the scope of services and to increase the compensation by $51,582.00 to a total of
$893,891.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 2 on May 26, 2005
to extend the Agreement and to modify the provision for notices to proceed; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 3 on November 22,
2005 to amend the scope of services and to increase the compensation by $122,157.00 to a total
of $1,016,048.00; and
WHEREAS, the City and Engineer executed Supplemental Agreement No. 4 on March 22, 2007
to amend the scope of services and to increase the compensation by $105,159.00 to a total of
$1,121,207.00; and
WHEREAS, it has become necessary to amend the Agreement to modify the provisions for the
scope of services and to increase the compensation by $108,528.00 to a total of $1,229,735.00;
and
NOW THEREFORE, premises considered, the City and the Engineer agree that said
Agreement is amended as follows:

ADDENDUM TO EXHIBIT B
Services to be provided by the Engineer
The changes to the scope of this project are as follows:
The Engineer shall provide the necessary engineering and technical services for the preparation of Plans, Specifications and
Estimates (PS&E) for extending the Kiphen Road (Phase II) project limits approximately 500' to the west. The revised
construction plans will describe the construction of a four -lane divided urban arterial roadway with a raised concrete curb
and gutter median. The Project also includes revisions to the intersection with existing Kiphen Road and the addition of a
driveway for future development.
The revised plans will contain the required drawings and details pertaining to grading, paving, signing, pavement marking,
delineation, sequence of construction, traffic control, illumination and drainage. The above-described plans will be
prepared in English units and shall be suitable for the bidding and award of a contract through the City of Round Rock's
construction contracting system. This project will be designed using English units of measure. Scales and submittals
referred to in this scope of services assume an 11" X 17" construction plan sheet.
The revised limits will incorporate part of the Kiphen Road Phase I design which is currently contained within the Texas
Department of Transportation's construction plans for FM 1460 (CSJ No. 2211-02-015). The revised plans will be modified
to construct only a portion of the Kiphen Phase I design contained in the TxDOT plan set. The new limits of work are
anticipated to begin near Station 25+00 (FM 1460 plan set) and tie into the Kiphen Road Phase II plans at Station 59+95.
Modifications include revisions to detours, grading, paving, signing, pavement marking, delineation, sequence of
construction, traffic control, illumination and drainage. In addition, the plans will include Water Utility Plans for 2-8" water
line connections along Kiphen Circle.
The designs included in the above described PS&E shall be in accordance with the requirements of the 1984 edition ITE's
GUIDELINES FOR URBAN MAJOR STREET DESIGN, the 2004 edition of AASHTO's A POLICY ON GEOMETRIC
DESIGN OF HIGHWAY AND STREETS, TEXAS MANUAL OF UNIFORM TRAFFIC CONTROL DEVICES
including Part VI.
The Engineer will establish a roadway geometry model and perform earthwork and paving quantity calculations with the
Bentley Microstation enhancement known as GEOPAK. The CADD and GEOPAK criteria files, which comprise the
geometry model, shall be provided to the City at the completion of the project.
Hydraulic designs and calculations for inlets and storm sewers will be performed using WINSTORM or an equivalent
program.
These additional services are described in the TASK OUTLINE shown below.
TASK OUTLINE
The Engineer will revise and/or add construction plans in the following items to accommodate the inclusion of the revised
project limits:
I. ROUTE AND DESIGN STUDIES (Function Code 110)
A. DATA COLLECTION
1. Collect and review available data for Kiphen Road and adjacent areas and roadways. The Engineer will also
perform field investigations to aid in this task. The Engineer will also review this data to determine the
applicability of each item to the project roadway.
2. Research and identify significant issues, as perceived by the City of Round Rock, or local officials who may
influence the location and selection of the roadway alignment and features.
3. Develop the roadway design criteria for the project to be discussed, revised and approved by the City prior to
commencing design activities.

B. TEMPORARY DETOUR SCHEMATICS
1. The Engineer will prepare calculated horizontal and vertical geometries for the temporary detour. Design will
be based on existing digital photography and vertical terrain information previously provided by the City.
2. The Engineer will develop a typical section in accordance with the City's design criteria for the temporary
detour.
3. Preliminary culvert sizing will be performed for the purposes of estimating vertical grade constraints on the
project roadway, as well as determining drainage easement requirements.
II. RIGHT-OF-WAY DATA AND UTILITY ADJUSTMENTS (Function Code 130)
A. UTILITY COORDINATION AND RESEARCH
1. Identify existing utilities in conflict with this project by researching existing plans, contacting utility
companies, field reconnaissance and survey.
2. The Engineer will provide plan and profiles, culvert layouts, and other sheets as required to utility providers to
assist them in their relocation efforts.
B. RELOCATION OF CITY UTILITIES
1. Upon determination of any relocation requirements for City of Round Rock owned utilities, the Engineer will
provide utility relocation plans and details through a supplemental agreement to this contract.
2. The Engineer will develop utility plans for inclusion into the PS&E package for the design of two
approximately 8" water lines that will service businesses south of Kiphen Road.
C. RIGHT-OF-WAY
1. The Engineer will establish right-of-way easements and locations for one temporary construction detour.
2. Acquire ROW information, research ROW information and coordinate parcel plats and metes and bounds.
3. Coordinate with subconsultant.
III. ROADWAY DESIGN CONTROLS (Function Code 160)
A. REVISIONS TO ROADWAY PLANS
1. Index of sheets will be revised to include new plan sheets.
2. Project layouts will be revised to show the new limits of the project.
3. Typical sections will be revised to indentify limits of various pavement thicknesses.
4. Design cross sections will be revised to include extended project limits and updated detour profile to
determine cut and fill quantities. These will be provided upon contractor's request in "roll" format or on
individual plan sheets. The Geopak design software package will be utilized to produce these cross sections.
5. Vertical geometry will be revised to include Kiphen Phase I geometry. Two existing driveways will be
modified including grading and additional drainage features. Proposed driveways from Kiphen Phase II will
be added to the plan set.
6. Horizontal alignment will be revised to include Kiphen Phase I geometry. Modifications to the horizontal data
sheet will be prepared.

7. Roadway plan and profile will be revised to include Kiphen Phase I driveways, medians, intersections and
alignments.
8. Supplementary grading sheets will be revised showing critical vertical information for the proper grading of
intersections, driveways and around drainage features.
9. Miscellaneous paving detail sheets will be revised showing such items as driveway details, curb end details,
and any other details as may be necessary.
IV. DRAINAGE (Function Code 161)
A. REVISIONS TO STORM SEWERS, EROSION CONTROL AND SW3P
1. Major drainage areas will be identified and hydrologic information will be calculated within the revised limits.
An exterior drainage area map will be produced depicting this information and culvert structure locations.
The Engineer shall prepare the drainage area maps at a scale of 1"=200' or as necessary to tit on standard
sheets. Storm water detention will not be required on this project.
2. Interior drainage area maps will be created at a scale of 1"=100' within the revised limits. These maps will
depict drainage area boundaries and flow direction arrows. Each area will be identified with a unique number
to be used to find run-off information from the calculation sheets. Design run-off shall be based on the
expected ultimate developed state of each area (ultimate flow).
3. Within the revised limits, run-off to each inlet and inlet hydraulic information will be calculated in accordance
with the City of Austin's drainage criteria and shown on the run-off and inlet computation sheets. A clear
roadway width (not impacted by spread of water in the gutter) of twelve feet in each travel direction shall be
maintained for the ultimate 25 year flow. Depth of 25 year ultimate flow shall not exceed curb height of six
(6) inches.
4. Storm sewers will be analyzed and computations will be prepared for the storm sewer design within the
revised limits.
5. Within the revised limits, storm sewers and inlets will be designed to intercept and transport the ultimate 25
year flow at a minimum, with the ultimate 100 year flow contained within the defined rights-of-way or
easements.
6. Storm sewer outfall points will be confirmed through the above hydraulic design and the Engineer will
finalize drainage easements requirements within the revised limits. The Engineer will design and detail
drainage outfall channels in accordance with the City of Austin drainage design criteria. Maintenance access
to each outfall shall be addressed in the design.
7. Drainage and erosion control plan sheets will be prepared depicting locations of inlets, manholes, storm
sewers, culverts, utilities, channel improvements, and ditch locations and flowlines as required within the
revised limits. These plans will also show erosion controls measures required for construction of the project.
Erosion control measures will be described for the project in its entirety, but will not be divided by traffic
control phase. The anticipated design components of the erosion control plans to be utilized on this project
are silt fence, sand bags, rock filter dams, sediment traps, and construction exits. These sheets will be
prepared at a scale of 1"=50'.
8. Within the revised limits, storm sewer profiles will be prepared at a scale of 1"=50' H and 1"=5' V. Storm
sewer profiles will show pipe size and type, slope, existing and proposed ground lines above the pipe,
pertinent hydraulic information including hydraulic grade lines (HGL) for storm sewers flowing full or under
pressure, and locations and sizes of inlets and junctions. HGL for 25 year storm shall be a minimum of six (6)
inches below the theoretical gutter flowline elevation at inlets.

9. A Storm Water Pollution Prevention Plan (SW3P) will be prepared for this job in accordance with TCEQ
regulations within the revised limits. This sheet will consist of the TxDOT SW3P text sheet that summarizes
erosion control measures.
10. The Engineer will develop plans for temporary drainage facilities necessary to allow staged construction of
the project within the revised limits. Required temporary drainage structures will be designed for a 2 -year
frequency event. No specific design details or calculation will be included in the plan sheets other than
structure size, flow line elevations and approximate structure location. Temporary drainage ditches between
temporary drainage structures and outfall locations will be evaluated and designated in the plans as a typical
ditch section. Notes shall be included in the plan to maintain positive drainage for these temporary ditches.
V. SIGNING AND PAVEMENT MARKINGS (Function Code 162)
A. REVISIONS TO SIGNING AND PAVEMENT MARKINGS
1. Signing and pavement marking layouts will be revised to include the new project limits.
2. Detail sheets for small signs will be revised to include the new project limits.
3. Pavement marking details will be revised to include the new project limits.
VI. MISCELLANEOUS ROADWAY (Function Code 163)
A. REVISIONS TO TRAFFIC CONTROL
