R-88-1080 - 1/14/1988RESOLUTION NO. 1080R WHEREAS, in exchange for financial assistance provided by the Williamson County Commissioner's Court, the City of Round Rock has agreed to provide fire protection services in a portion of the unincorporated area of Williamson County, and WHEREAS, the Council wishes to enter into a written agreement with the County to provide said fire protection, NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the Mayor is hereby authorized to execute an agreement with Williamson County to provide fire protection services, the terms and provisions of said agreement subject to the approval of the City Attorney. KNOW ALL MEN BY THESE PRESENTS THE COUNTY OF WILLIAMSON THAT Williamson County, Texas, hereinafter referred to as "County", and City of Round Rock, hereinafter referred to as "City" have entered into the following AGREEMENT 1. Pursuant to its power to provide financial assistance for fire protection in and for Williamson County, and its duty to protect the public health and welfare, the County agrees to grant the City the Sum of $36,000.00, in two (2) equal payments, one on or before February 28, 1988 and one on or before September 30, 1988, to defray the cost of equipment and labor required to provide the services described in paragraph 2. 2. City agrees to provide fire protection services in the unincorporated area of the County specifically assigned to City, and shall expend all of the grant amount for only these purposes during the calendar year 1988. 3. It is understood by City that County cannot commit funds for any future fiscal year, and that this Agreement does not, and cannot, commit County to renew or repeat this grant unless approved by future action of the Williamson County Commissioners' Court. 4. It is understood and agreed that County has no power to control or supervise the manner and means chosen by City to carry out the services specified in Paragraph 2, and that County shall have no liability for any of the acts of the City (whether intentional, negligent or otherwise). County's role in this Agreement begins and ends with the payment of the grant described in Paragraph 1. City agrees to hold the County harmless from any and all risk of loss from any acts or omissions of the City, its officers, employees or agents. City further agrees to indemnify the County for any loss or expense (including but not limited to attorney's fees) incurred as a result of a claim against the County by any person or entity based on this Agreement or on any such act or omission. STAFF RESOURCE PERSON: STAFF RECOMMENDATION: ECONOMIC IMPACT: In the past the County has given the City $4,124.00 for rural fire protection. These funds are passed onto the Round Rock Volunteer Fire Department to help offset some of their firefighting costs. The contribution from the County this year will be $36,000. These funds will also be distributed to Jollyville Company and Sam Bass Company of the RRVFD.
