G-08-09-25-13A1 - 9/25/2008ORDINANCE NO. �' v✓" J " GA( AN ORDINANCE AMENDING CHAPTER 10, SECTION 10.204, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, BY AMENDING THE WATER AND WASTEWATER IMPACT FEES, AND ADOPTING NEW LAND USE ASSUMPTIONS AND CAPITAL IMPROVEMENT PLAN; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Sec. 395.052, Tex. Local Gov't Code, requires a municipality imposing impact fees to review and evaluate its current land use assumptions and capital improvements plan at least every five (5) years (dating from the day the initial capital improvements plan is adopted); and WHEREAS, the last time such land use assumptions and capital improvements plan were review, evaluated and updated was two (2) years ago; and WHEREAS, the City Council has reviewed, evaluated, and now wishes to adopt updated land use assumptions and a capital improvements plan in order to comply with said Texas Local Government Code requirements for same; Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: I. Chapter 10, Section 10.204(2)(a), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended to read as follows: 0:\WDOX\ORDINANC\080925A1.DOC/s1s (2) Land Use Assumptions. (a) The updated Land Use Assumptions contained within the June 2008 Update of the Water and Wastewater Impact Fees of the City of Round Rock dated March, 2008, are hereby adopted and incorporated by reference and shall be kept of record in the office of the City Secretary. II. Chapter 10, Section 10.204(3)(a), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended to read as follows: (3) Water and Wastewater Impact Fee Service Area (a) The Water and Wastewater Impact Fee Service Area, the boundaries of which are depicted on the map contained within the June 2008 Update of the Water and Wastewater Impact Fees of the City of Round Rock, is hereby adopted and incorporated by reference and shall be kept of record in the office of the City Secretary. Chapter 10, Section 10.204(4)(a), Code of Ordinances (1995 Edition), City of Round Rock is hereby amended to read as follows: (4) Impact Fee Capital Improvements Plan For Water And Wastewater Facilities (a) The Impact Fee Capital Improvements Plan For Water and Wastewater Facilities contained within the 2008 Update of the Water and Wastewater Impact Fees of the City of Round Rock dated June, 2008, is adopted and incorporated in this section by reference and shall be kept on record in the office of the City Secretary. Iv. Chapter 10, Sections 10.204(6)(b) and (c), Code of Ordinances (1995 Edition), City of Round Rock are hereby amended to read as follows: (6) Impact Fees Per Service Unit (b) Beginning on January 1, 2009, the City shall assess and collect per service unit to be served by the City's water system a Water Impact Fee of Four Thousand Four Hundred Forty-six Dollars ($4,446.00). 2 (c) Beginning on January 1, 2009, the City shall assess and collect per service unit to be served by the City's wastewater system a Wastewater Impact Fee of Two Thousand Three Hundred Eighty-three Dollars ($2,383.00). V. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Water and Wastewater Impact Fees for new customers connecting to the City's water and wastewater systems. (Second Reading) Department: Staff Person: Justification: Water and Wastewater Utilities Michael D. Thane, Director of Utilities The City last updated the water and wastewater impact fees in January 2005. At that time, the City made a commitment to review the existing impact fees that new customers are charged for tying into the water and wastewater systems every 3 years. To update the impact fees, it requires the City to review and update the existing land use plan, annexation plan, and the water and wastewater system capital improvement/master plans. Since the latest plan updates, there are several projects that will be required that will have a direct influence on the new impact fees. On the water system, the City has finalized plans for Lake Travis to be the next source of water. On the wastewater system, a wastewater treatment plant expansion will be required in the future. In addition, the annexation plan for the northeast part of Round Rock has been updated which will require necessary improvements to both the water and wastewater systems in the upcoming years. These improvements, as well as other smaller projects, have been included in our Updated Water and Wastewater System Master Plans and in the new impact fee calculation. Background Information: The current impact fees that are charged to new customers connecting to the City's water and wastewater system are $4,296 for water and $1,306 for wastewater for each Living Unit Equivalent. Public Comment: A presentation of the final report of the proposed impact fees was made to the City's Capital Improvements Advisory Committee on June 18, 2008. The committee's comments are provided in the final report. A presentation and public testimony was conducted at the July 10, 2008 City Council Meeting and the first reading of the ordinance was approved at the September 11, 2008 City Council Meeting.
