G-08-11-13-11C16 - 11/13/2008ORDINANCE NO. -Ub-!1-(3-1EC(6 AN ORDINANCE AMENDING CHAPTER 11, SECTION 11.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING ON -STREET PARKING; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 11, Section 11.502, Subsection (5)(a), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: (5) Downtown Development Area Special Requirements (a) The property owners of all properties located within the Downtown Development Area which are zoned C-1 (General Commercial) and are adjacent to streets with rights-of-way 80 feet wide or greater, other than Round Rock Avenue, Mays Street, and the east side of South Lampasas Street from Bagdad Street to the alleyway between Bagdad Street and East Main Street, shall be permitted to utilize said rights-of-way for on -street parking spaces to meet the City's parking requirements. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. Consider an ordinance amending Chapter 11, Section 11.502(5)(a), Code of Ordinances (1995 Edition) regarding on -street parking on Lampasas Street. (First Reading) Department: Planning and Community Development Staff Person: Jim Stendebach, Planning and Community Development Director Justification: Proposed Amendment: - to allow on -street parking on the west side of South Lampasas Street in the Downtown Development Area. The Downtown Development Area was established in the early 1990's to accommodate infill development within the area bounded by IH -35 to the west, Brushy Creek to the north, Lake Creek to the south and the western edge of the P.A. Holder survey (just east of College Street). The Downtown Development Area allows on -street parking provided the parking is on streets with 80 foot wide or greater rights -of way. When the district was established, the area along South Lampasas Street from the alleyway between Bagdad Ave. and East Main extending south to Bagdad was excluded from the on -street parking provision. However, staff was unable to identify a specific reason for this exclusion. During our discussions with various City departments and previous staff members, two possible reasons were identified. The first was related to Fire Department access. Specifically, the thought was that this area was excluded to provide a designated on -street fire lane. However, there has since been a fire lane provided across the street adjacent to the City's parking garage. Additionally, the Fire Department has stated that they do not have a concern with the proposed on -street parking. Secondly, the Transportation Services Department theorized that the prohibition of on -street parking may have been the result of a perceived conflict with the parking garage. After their review of this scenario, Transportation is in support of the ordinance to allow parking on the west side of South Lampasas and is not concerned with vehicular conflicts. The configuration of future on - street parking is subject to approval of the Public Works Department Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A - CONTINUED ON NEXT PAGE - Background Information: Currently, there is a site plan submitted for the site immediately adjacent to this area. The applicant for this project has requested the ability to provide on -street parking in this location. If this text amendment is approved, the on -street parking configuration will be addressed during the Development Review Committee (DRC) site plan review process. Public Comment: Public notice was posted and a public hearing was held in accordance with the City of Round Rock's Zoning Ordinance at the Planning and Zoning Commission meeting on September 30, 2008.
