R -08-12-04-9C3 WHEREAS, Section 43.065(a) of the Texas Local Government Code requires that, within certain specified statutory timeframes, the City Council of the City of Round Rock must direct the City's Planning Director to prepare a service plan that provides for the extension of full municipal services to the areas which are proposed for annexation, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the City Council hereby directs the City's Planning Director to prepare a service plan that provides for the extension of full municipal services to the following area proposed for annexation, said property being further described in Exhibit attached hereto and incorporated herein for all purposes. (1) Park Valley Drive Right -of -Way. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider a resolution directing the Planning Director to prepare a service plan for the proposed annexation of the Park Valley Drive Right -of -Way Tract. Department: Staff Person: Justification: Planning and Community Development Jim Stendebach, Planning and Community Development Director The Tract of land, known as the Park Valley Drive Right -of -Way Tract, consists entirely of public right-of-way, extending west and north of Wyoming Springs Drive to the Fern Bluff MUD. The Tract contains approximately 2.0 acres, and abuts previously annexed tracts on three sides. The City wishes to annex this right-of-way in order to provide maintenance of the roadway. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: This tract of land is located within the City of Round Rock's ETJ and in Williamson County. Public Comment: Two public hearings are scheduled to be held on April 9, 2009, and April 23, 2009. On February 11, 2009, written notices will be sent by certified mail to the property owners of the proposed annexed lands and to all public and private utility providers that could be affected. On March 25, 2009, written notices will be sent to the public school districts. Published notice of the April 9, 2009, and April 23, 2009 public hearings will appear in the Round Rock Leader on March 28, 2009, and April 11, 2009, respectively, and will be posted on the City's Website on March 25, 2009, and April 9, 2009, respectively. Lastly, the City Secretary will post the Council's agenda, which will include the public hearings of April 9, 2009 and April 23, 2009, on April 3, 2009 and April 17, 2009, respectively.
