The Stella Park Improvement Project is partially located over the Edwards Aquifer Recharge
Zone. In order to proceed with construction of the proposed park improvements (basketball
court, playscape, pavilion, looping trail, and park amenities) the City is filing an Exception
Request with the Texas Commission on Environmental Quality. Signature by the City
Manager is required for the application to be complete, as well as to authorize Aileen
Dryden to represent and act on behalf of the City during the duration of the project.
This project was identified in Year 4 of the PARD Repair and Replacement Program.
Department official met with the neighborhood twice over the past year to gather input on
the park master plan and improvement plan. The final improvement plan presented to the
neighborhood received positive feedback and the neighborhood was excited to see the
redevelopment efforts.

(relating to Types of Municipal Solid Waste Facilities).

ATTACHMENT C — PROJECT DESCRIPTION
The Stella Park Improvement Project can generally be described as the
redevelopment of approximately 2.62 acres of existing parkland with a
playscape, pavilion, half -court basketball court, and approximately 1/6 mile of
concrete trail. All existing park elements, including 2 metal playscapes w/ wood
borders, wood pavilion, concrete basketball court, and sand playground
surfacing, are approximately 25 years old and will be demolished and hauled off.
The existing asphalt tennis court, multi-purpose playfield, and 1/10 mile concrete
sidewalk will remain. Additional improvements in the project will include picnic
tables, benches, relocation of a drinking fountain, trash receptacles, and park
sign. The park is bisected by the boundary between the Edwards Aquifer
Recharge Zone and the Transition Zone. Most of the development proposed in
this plan occurs near this boundary or in the Transition Zone with the final
discharge point of all stormwater occurring in the Transition Zone.
In more detail, the project will involve removing approximately 1,395 sf of
impervious cover consisting of existing concrete slabs and railroad tie borders,
and installing approximately 9,458 sf of new impervious cover consisting of
concrete sidewalks, slabs, and curbs. The current pervious area on-site is
approximately 106,947 sf which will be only slightly reduced to 98,774 sf, or a
change of 8,173 sf or 6.92%. The planned maximum depth of disturbance for the
construction is to be less than two (2') feet. In general, finished grading of the
site will be very similar to what exists today, and therefore drainage will remain
as it exists today. Currently, approximately 98% of the site sheet flows southeast
across a vegetated area into a grass lined drainage swale at the southern end of
the site. The other 2% of the site drains east to a concrete drainage channel.
The grass lined drainage swale drains into the concrete drainage ditch at the far
southeast corner of the property. The design proposes to keep the same
drainage pattern and to utilize the existing vegetative buffer strips.
Due to the facts that the project will create a small net increase in impervious
cover, that the depth of the construction excavation will be minimal, and that the
majority of the storm water that falls on the completed project will sheet flow
across vegetated surfaces, an exception from the requirements of filing a Water
Pollution Abatement Plan (WPAP), performing a Geologic Assessment, and
providing permanent water quality controls for the project is being requested.

REGULATED ENTITY NAME: Stella Park Improvement Protect
Permanent best management practices (BMPs) and measures that will be used during and
after construction is completed.
1. X Permanent BMPs and measures must be implemented to control the discharge of
pollution from regulated activities after the completion of construction.
X These practices and measures have been designed, and will be constructed, operated,
and maintained to insure that 80% of the incremental increase in the annual mass
loading of total suspended solids (TSS) from the site caused by the regulated activity is
removed. These quantities have been calculated in accordance with technical
guidance prepared or accepted by the executive director.
X The TCEQ Technical Guidance Manual (TGM) was used to design permanent
BMPs and measures for this site.

address increased stream flashing, the creation of stronger flows and in -stream
velocities, and other in -stream effects caused by the regulated activity which increase
erosion that results in water quality degradation.
Responsibility for maintenance of permanent BMPs and measures after construction is

ATTACHMENT B - BMPs for Uaeradient Starmwater
Limited surface water, groundwater, or stormwater originates upgradient from the
site and Flows across the site. To the northwest, there is an existing roadway
with concrete curb and gutter. The roadway catches all upgradient stormwater
prior to it entering the site and diverts it around the project site. To the south of
the site, residential properties will contribute a small amount of stormwater that
will flow across the site. A silt fence will be installed at the southern -most edge of
the property line to filter any surface water or stormwater that originates on the
residential properties before it reaches the project site. Once on the site, the
stormwater will flow through the vegetated Swale allowing any impurities to be
filtered out before reaching the point of discharge at the drainage channel.

ATTACHMENT C - BMPs for On-site Stormwater
Permanent soil stabilization practices will be used in all disturbed areas, including
the use of sod and/or hydro -seed to establish permanent vegetation. Water
falling directly on or flowing across the site will travel over mostly vegetated area,
and through the vegetated swales to purify the water before leaving the site. The
majority of the stormwater flowing across the site will flow across a vegetated
(natural) filter strip at least 50' in length before flowing across a small section of
impervious surface. It will then continue on to the vegetated swale that is
approximately 425' in length before reaching the culvert headwall. Once the
stormwater enters the culvert, it will discharge into an existing drainage channel
which runs another +/- 1,700' before entering the City's storm drain system and
ultimately Brushy Creek.
The site is a gently sloping site (generally less than 2%), located above the 2 -
year storm elevation of the adjacent drainage, and will be maintained as a City -
owned neighborhood park. It is our opinion that the site meets the criteria for
natural vegetated filter strip, as identified in the Technical Guidance on Best
Management Practices, and will provide sufficient load removal to handle the
minimal new impervious cover created by the project.

necessary and if any weeds are present, the use of herbicides will
be kept to a minimum.
Seasonal Mowing:
The vegetative filter strip (turf area) will be mowed if it exceeds 18
inches in height using a mulching mower or if using a non -
mulching mower the grass clippings will be removed from the
vegetative filter strip area. All accumulation of trash and debris
will be removed prior to mowing.
Debris and Litter:
Trash and litter accumulated in the vegetative filter strip will be
kept clean on a regular basis.
Sediment:
Excess sediment that may build along the edge of the sidewalk or
trail and the vegetative filter area will be removed to allow positive
drainage and uniform overland flow. Excess sediment will be
removed by hand or with a flat bottomed shovel.
Lawn Care:
A healthy dense stand of Bermuda grass will be maintained on the
vegetative filter strip. Regular turf maintenance and mowing will
occur on a 14-21 day cycle.
Repairs/Retrofit:
If any eroded areas should develop, they will be filled, compacted
and re -seeded so that the final grade is level. Grass damaged
during the sediment removal process will be re -seeded to establish
vegetative cover. Bare spots that are identified will be restored by
re -seeding those areas.

ATTACHMENT A — SPILL RESPONSE ACTIONS
Material storage areas should be maintained to keep on-site material limited to
only that needed for the job at hand. Liquid containers will be kept closed when
fluids are not being used and drip pans will be under any containers with valves
or spigots attached. All spills of any size will be immediately contained and all
contaminated material placed into a proper container designed for transporting
the hazardous materials. Containers will be sent to an approved hazardous
materials site for proper disposal. There is a City fire station less than two (2)
miles from the site with hazmat trained personnel on duty.
The TCEQ will be contacted immediately as to the type and nature of all
significant hazardous materials spills. The TCEQ will be notified as to the
destination and travel days of any contaminated material.

Contractor shall be required to comply with all spill prevention and control
requirements of the Edwards Aquifer Rules: Technical Guidance on Best
Management Practices (Section 1.4.16).
1.4.16 Spill Prevention and Control
The objective of this section is to describe measures to prevent or reduce the
discharge of pollutants to drainage systems or watercourses from leaks and spills
by reducing the chance for spills, stopping the source of spills, containing and
cleaning up spills, properly disposing of spill materials, and training employees.
The following steps will help reduce the stormwater impacts of leaks and spills:
Education
(1) Be aware that different materials pollute in different amounts. Make sure that
each employee knows what a "significant spill' is for each material they use, and
what is the appropriate response for "significant' and "insignificant' spills.
Employees should also be aware of when spill must be reported to the TCEQ.
Information available in 30 TAC 327.4 and 40 CFR 302.4.
(2) Educate employees and subcontractors on potential dangers to humans and
the environment from spills and leaks.
(3) Hold regular meetings to discuss and reinforce appropriate disposal
procedures (incorporate into regular safety meetings).

(4) Establish a continuing education program to indoctrinate new employees.
(5) Have contractor's superintendent or representative oversee and enforce
proper spill prevention and control measures.
General Measures
(1) To the extent that the work can be accomplished safely, spills of oil,
petroleum products, substances listed under 40 CFR parts 110,117, and 302,
and sanitary and septic wastes should be contained and cleaned up immediately.
(2) Store hazardous materials and wastes in covered containers and protect from
vandalism.
(3) Place a stockpile of spill cleanup materials where it will be readily accessible.
(4) Train employees in spill prevention and cleanup.
(5) Designate responsible individuals to oversee and enforce control measures.
(6) Spills should be covered and protected from stormwater runon during rainfall
to the extent that it doesn't compromise clean up activities.
(7) Do not bury or wash spills with water.
(8) Store and dispose of used clean up materials, contaminated materials, and
recovered spill material that is no longer suitable for the intended purpose in
conformance with the provisions in applicable BMPs.
(9) Do not allow water used for cleaning and decontamination to enter storm
drains or watercourses. Collect and dispose of contaminated water in
accordance with applicable regulations.
(10) Contain water overflow or minor water spillage and do not allow it to
discharge into drainage facilities or watercourses.
(11) Place Material Safety Data Sheets (MSDS), as well as proper storage,
cleanup, and spill reporting instructions for hazardous materials stored or used
on the project site in an open, conspicuous, and accessible location.
(12) Keep waste storage areas clean, well organized, and equipped with ample
cleanup supplies as appropriate for the materials being stored. Perimeter
controls, containment structures, covers, and liners should be repaired or
replaced as needed to maintain proper function.
Cleanup
(1) Clean up leaks and spills immediately.
(2) Use a rag for small spills on paved surfaces, a damp mop for general
cleanup, and absorbent material for larger spills. If the spilled material is
hazardous, then the used cleanup materials are also hazardous and must be
disposed of as hazardous waste.

(3) Never hose down or bury dry material spills. Clean up as much of the material
as possible and dispose of properly. See the waste management BMPs in this
section for specific information.
Minor Spills
(1) Minor spills typically involve small quantities of oil, gasoline, paint, etc. which
can be controlled by the first responder at the discovery of the spill.
(2) Use absorbent materials on small spills rather than hosing down or burying
the spill.
(3) Absorbent materials should be promptly removed and disposed of properly.
(4) Follow the practice below for a minor spill:
(5) Contain the spread of the spill.
(6) Recover spilled materials.
(7) Clean the contaminated area and properly dispose of contaminated materials.
Semi -Significant Spills
Semi -significant spills still can be controlled by the first responder along with the
aid of other personnel such as laborers and the foreman, etc. This response may
require the cessation of all other activities.
Spills should be cleaned up immediately:
(1) Contain spread of the spill.
(2) Notify the project foreman immediately.
(3) If the spill occurs on paved or impermeable surfaces, clean up using "dry"
methods (absorbent materials, cat litter and/or rags). Contain the spill by
encircling with absorbent materials and do not let the spill spread widely.
(4) If the spill occurs in dirt areas, immediately contain the spill by constructing an
earthen dike. Dig up and properly dispose of contaminated soil.
(5) If the spill occurs during rain, cover spill with tarps or other material to prevent
contaminating runoff.
Signiflcant/Hazardous Spills
For significant or hazardous spills that are in reportable quantities:
(1) Notify the TCEQ by telephone as soon as possible and within 24 hours at
512-339-2929 (Austin) or 210-490-3096 (San Antonio) between 8 AM and 5 PM.
After hours, contact the Environmental Release Hotline at 1-800-832-8224. It is
the contractor's responsibility to have all emergency phone numbers at the
construction site.

(2) For spills of federal reportable quantities, in conformance with the
requirements in 40 CFR parts 110,119, and 302, the contractor should notify the
National Response Center at (800) 424-8802.
(3) Notification should first be made by telephone and followed up with a written
report.
(4) The services of a spills contractor or a Haz-Mat team should be obtained
immediately. Construction personnel should not attempt to clean up until the
appropriate and qualified staffs have arrived at the job site.
(5) Other agencies which may need to be consulted include, but are not limited
to, the City Police Department, County Sheriff Office, Fire Departments, etc.

Vehicle and Equipment Maintenance
(1) If maintenance must occur onsite, use a designated area and a secondary
containment, located away from drainage courses, to prevent the runon of
stormwater and the runoff of spills.
(2) Regularly inspect onsite vehicles and equipment for leaks and repair
immediately
(3) Check incoming vehicles and equipment (including delivery trucks, and
employee and subcontractor vehicles) for leaking oil and fluids. Do not allow
leaking vehicles or equipment onsite.
(4) Always use secondary containment, such as a drain pan or drop cloth, to
catch spills or leaks when removing or changing fluids.
(5) Place drip pans or absorbent materials under paving equipment when not in
use.
(6) Use absorbent materials on small spills rather than hosing down or burying
the spill. Remove the absorbent materials promptly and dispose of properly.
(7) Promptly transfer used fluids to the proper waste or recycling drums. Don't
leave full drip pans or other open containers lying around.
(8) Oil filters disposed of in trashcans or dumpsters can leak oil and pollute
stormwater. Place the oil filter in a funnel over a waste oil -recycling drum to
drain excess oil before disposal. Oil filters can also be recycled. Ask the oil
supplier or recycler about recycling oil filters.
(9) Store cracked batteries in a non- leaking secondary container. Do this with all
cracked batteries even if you think all the acid has drained out. If you drop a
battery, treat it as if it is cracked. Put it into the containment area until you are
sure it is not leaking.

ATTACHMENT C - SEQUENCE OF MAJOR ACTIVITIES
1. Contractor will schedule phases of construction that do not exceed the
work which can be completed within a week, not including the weekend.
2. Excavations will be closed for weekends, holidays, and any other days
when work is not scheduled to proceed.
3. Install all of the project construction signage.
4. Install temporary erosion and sedimentation controls per plan.
5. Install the temporary construction entrance to the site.
6. Install the concrete truck wash out area, per plan.
7. Perform Items 8 through 20 as applicable.
8. Excavate areas to be worked (approximately 12,500 sq. ft. disturbed
through excavation and grading).
9. Haul away all spoils as excavated.
10. Grade and compact sub -grade.
11. Deliver, install and compact Flexible base material as needed.
12. Form, install steel, pour, and finish concrete as needed.
13. Deliver, install and compact backfill.
14. Deliver, install playscape elements.
15. Deliver, install site furnishings (benches, picnic tables, trash receptacles).

*Note: Contractor will use a portion of the existing turf area/sports field during
construction to maneuver equipment and materials around the project site. All
areas of turf that are disturbed during construction will be raked, aerated and re-

ATTACHMENT D - TEMPORARY BEST MANAGEMENT PRACTICES AND
MEASURES (TBMP'Sl
TBMP's proposed to be utilized in the temporary Storm Water Pollution Plan
(SW3P) during the construction of the proposed Stella Park Improvement
Project:
1. Construction phases are to be completed in the same work week to
minimize exposure.
2. Perimeter silt fence to be installed around site
3. Rock berm constructed at opening of culvert to filter impurities
4. Construction entrance/exit will be installed
5. Temporary concrete truck washout area will be installed and removed
prior to completion.
6. Check and re -set run-off control measures at the end of each work day
and before a predicted storm event.
7. Provide and maintain covered trash and debris containers.
8. Control employee and equipment parking.

ATTACHMENT I - INSPECTION AND MAINTENANCE FOR TBMP'S
All temporary erosion and sedimentation control measures must be maintained to
have an effective operating condition. Inspection of TBMP's will be required
every 14 days or after a rainfall event greater than 0.5 inches. If site inspections
identify TBMP's are not operating effectively, maintenance shall be performed as
necessary to maintain the continued effectiveness of storm water controls.
After construction is complete, the park facility will be regularly inspected and
maintained on a two week rotation minimum. Maintenance of the park includes
regular mowing practices, clearing of debris, and general up keep of the site.
Park amenities such as pavilions, benches, and picnic tables are inspected for
soundness twice every week. In the event a repair/retrofit needs to be made,
depending on the situation, maintenance crews will restrict access to the site and
make repairs. Every effort will be made to disturb as little area as possible. All
disturbed areas will be re -vegetated and maintained.

ATTACHMENT J - SCHEDULE OF INTERIM AND PERMANENT SOIL
STABILIZATION PRACTICES
Permanent soil stabilization practices will be used, including the use of sod
and/or hydro -seed to establish permanent vegetation. Stabilization measures
shall be on-going as each phase of construction activities progresses. All
erosion and sedimentation controls will remain in place until permanent
vegetation is established.

FOR RECHARGE AND TRANSITION ZONE EXCEPTION REQUEST FORM

We request an exception from filing a Water Pollution Abatement Plan (WPAP)
providing permanent water quality controls due to a small increase in new
impervious cover and an exception to the Geologic Assessment due to the small
area and depth of proposed soil disturbance. The exception request will allow
the City to redevelop approximately 2.62 acres of parkland with a new playscape,
pavilion, half -court basketball court, and approximately 1/6 mile of 5' wide
concrete trail with other park amenities, including benches and picnic tables. The
total amount of planned impervious cover will be approximately 19,320 square
feet, which is a change of 8,173 sf from the existing impervious cover. The
approximate flow length across vegetated area from the new impervious cover to
the discharge point is approximately 50+ feet. The project is small enough that
the construction time will be short (3 months). It is our opinion that the large
vegetated area will have sufficient load removal to handle the minimal new
impervious cover created by this project.

ATTACHMENT B— DOCUMENTATION OF EQUIVALENT WATER QUALITY
PROTECTION
Equivalent water quality protection for this construction will be achieved with the
existence of the vegetated area to where the new impervious cover will be
graded. The construction will produce a small net increase in impervious cover
(8,173 sf). The vegetated area on the project site and downstream of the project
site provide a vegetative buffer/filtration strip of approximately 50+ feet which will
have sufficient load removal to handle the minimal, new impervious cover
created by this project.
