R -08-12-18-7F1 WHEREAS, Texas Local Government Code, Section 271.113(a) allows governmental entities to use certain methods other than competitive bidding in entering into contracts for construction of facilities, and WHEREAS, the City of Round Rock is considering using an alternative method other than competitive bidding for the construction of the City Hall Policy Center, and WHEREAS, the statute requires that a project -by -project determination be made as to what method provides the best value for the governmental entity in relation to a particular project, and WHEREAS, the Council has determined that this project would be best served by utilizing the "Construction Manager -At -Risk" method, and WHEREAS, Texas Local Government Code, Section 271.114(a) mandates a time requirement that the "governing body of a governmental entity that is considering a construction contract using a method specified by Section 271.113(a) other than competitive bidding must, before advertising, determine which method provides the best value for the governmental entity," and WHEREAS, the City Council desires to comply with all requirements of the statute, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, In accordance with Texas Local Government Code §271.114(a), the Council has determined that "Construction Manager -At -Risk" is the 0:\WDOX\RESOLUTI\R81218F1.DOC/rmC delivery method which provides the best value for the City for the construction of the City Hall Policy Center. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Funding: Cost: N/A Source of funds: N/A Outside Resources: Architectural Plus & Barnes Gromatzky Kosarek Architects Background Information: The City of Round Rock plans to build a New City Hall Policy Center to house Council Chambers, City Administration, Mayor and Council Officer, Public Information Offices, Boards and Commissions meeting spaces and miscellaneous support facilities. The construction team could be brought in the early part of the design to help with cost and design decisions. Since the City is funding a portion of the proposed project the City Council must make determination that the "Construction Manager at Risk" delivery method provides the best value for the City.
