Justification:
Effective September 1, 2001, Texas Local Government Code Section 271.113 allows cities to use
certain methods other than competitive bidding in entering into contracts for construction of
facilities. One such method is "Construction Manager at Risk." Section 271.114 (a) mandates
that the "governing body of an entity that is considering a construction contract using a method
specified by section 271.113 (a) other than competitive bidding must, before advertising,
determine which method provides the best value to the government entity."

Background Information:
The City of Round Rock plans to build a New City Hall Policy Center to house Council Chambers,
City Administration, Mayor and Council Officer, Public Information Offices, Boards and
Commissions meeting spaces and miscellaneous support facilities. The construction team could
be brought in the early part of the design to help with cost and design decisions. Since the City
is funding a portion of the proposed project the City Council must make determination that the
"Construction Manager at Risk" delivery method provides the best value for the City.
