WHEREAS, .a 9-1-1 Database is used by the City of Round Rock to
provide warnings and alert citizens regarding information in an
emergency situation where property or human life is in jeopardy, and
WHEREAS, Texas Health & Safety Code, Section 771.061(a), and
Texas Attorney General Open Records Decision 661, 1999 provide that the
9-1-1 Database information be used only in an emergency situation and
will be kept confidential and not available to the public for
inspection, and
WHEREAS, Rule 251.13 of the Commission on State Emergency
Communications ("Commission") requires that the City agree to maintain
the confidentiality of the 9-1-1 Database information, and
WHEREAS, in compliance with Rule 251.13 of the Commission, the
City wishes to enter into an Emergency Notification System Agreement
with the Capital Area Planning Council, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City an Emergency Notification System Agreement with the
Capital Area Planning Council, a copy of said Agreement being attached
hereto as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

CAPITAL AREA PLANNING COUNCIL
EMERGENCY NOTIFICATION SYSTEM AGREEMENT
This Agreement is entered into between the Capital Area Planning Council
(CAPCO) and the City of Round Rock, Texas , a political
subdivision of the State of Texas and herein referred to as the entity.
The (entity) City of Round Rock has expressed interest in
providing an emergency notification system to the citizens of their respective
area;
(ENS Provider) Dialogic Communications Corporation
provides a service to assist municipalities and other organizations with
emergency notification systems.
The State law provides and the Texas Attomey General has concluded,
that the 9-1-1 database information is confidential and is not available for public
inspection. (Texas Health & Safety Code, Section 771.061(a); Texas Attorney
General Open Records Decision 661, 1999. Release of the data contained in the
9-1-1 database is to be used for the purpose of warning or alerting citizens
regarding information in an emergency situation where property or human life is
in jeopardy and is to be maintained as confidential and not subject to public
inspection in accordance with Texas Health & Safety Code, Section 771.061(a).
The purpose of this agreement is to be in full compliance with Rule 251.13
stated by the Commission on State Emergency Communications (CSEC) "The
Use of the 9-1-1 Database for Emergency Notification Services."
In accordance with rule 251.13, all parties agree that the 9-1-1 database
will only be used in an emergency situation and will be kept confidential and not
available to the public for inspection.
Due to the confidential nature of the 9-1-1 database information and
privacy of citizens with unlisted and unpublished numbers, CAPCO will retain the
right to withdraw their assistance if the (entity) City of Round Rock
or (ENS Provider) Dialogic Communications Corp. , does not

The cost for the operation of the Emergency Notification System, to
include charges by (ENS Provider) Dialogic Communications Corp.
and the 9-1-1 Database provider, shall be paid for by the (entity) City of Round
Rock . Charges for activation of the system will be the sole
responsibility of the (entity) City of Round Rock
This Agreement supersedes any and all other agreements, either oral or in
writing between the parties hereto with respect to the subject matter hereof, and
no other agreement, statement or promises relating to the subject matter of this
Agreement which is not contained herein shall be valid or binding.
Programming of the Emergency Notification System should be such that
any activation of use of the system automatically include the CAPCO Emergency
Services Director. (Number will provided upon execution of agreement.)

The purpose for this agreement is to be in full compliance

must be entered into for the privacy of the citizens.
