WHEREAS, the City of Round Rock entered into a contract on August
14, 2003 with Chasco Contracting entitled "Agreement Between Owner and
Construction Manager at Risk Where Construction Manager at Risk Is Also
the Constructor," and such contract is for improvements to the Dell
Diamond/United Heritage Facility, and
WHEREAS, the terms of such contract require submission by Chasco
Contracting of "Amendment No. 1 to Agreement Between Owner and
Construction Manager at Risk," which Amendment No. 1 is to set forth
the Guaranteed Maximum Price as defined in the contract, and
WHEREAS, the City Council wishes to accept such Amendment No. 1
to the referenced Agreement, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City, Amendment No. 1 with Chasco Contracting for the
Guaranteed Maximum Price as stated therein, and same is for
construction improvements to the Dell Diamond/United Heritage Facility,
a copy of said Amendment No. 1 being attached hereto as Exhibit "A" and
incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
publicus required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

General Note:
Unless otherwise noted below, all sections are per plans and specifications shown on the GMP
document list. Qualifications or modifications from this list are noted below:
DESIGN SERVICES
• Architectural and engineering services are not included in this estimate
• Construction Managers price does not include any cost for professional engineering. All
professional engineering shall be by the Engineer of Record or is covered under a separate
agreement between Round Rock Baseball and the structural steel and precast concrete
suppliers.
GENERAL REQUIREMENTS
Supervision and Administration
• Project supervision includes a Project Superintendent with Project Management, Safety
Coordinator, Estimating and Administrative Assistant as necessary to complete the project
as scheduled
• Document Reproduction as required for shop drawings
• Postage and delivery service of Construction Manager's services only
• Project Meetings and preconstruction meetings for construction activities will be held on an
as needed basis as determined by the Construction Manager and will be coordinated with
the Architect
• Project schedules and reports will be submitted as needed or requested by the Owner and
will be in the Construction Manager's standard format
Submittal Procedures
• Architect has 5 working days for review, and must be returned to Construction Manager no
later than 7 working days from receipt of submittal as required to maintain progress of the
project
• Product data, shop drawings and samples will be submitted under the Construction
Managers standard format and will be coordinated with A/E
Substitutions
• Substitutions shall be considered throughout the duration of the project if in the best interest
of the Owner

Project Schedule, Weather and Work Hours
Schedule
• The substantial completion date is April 1, 2004 and is based on receiving a "Notice To
Proceed" by no later than September 26, 2003
Weather
• Days for inclement weather are not calculated into the schedule and extensions of time to
complete the contract would be added to the duration of the project as per the contract
agreement
Work Hours
• Normal working days are Monday through Friday, excluding holidays

Building Inspections
• Inspections will be provided as required by local jurisdiction
Materials Testing
• All costs for laboratory testing of new construction materials will be borne by the Owner
except for cost associated with re -testing
• Geotechnical assessments and reports are assumed to have been completed and are not
included in this estimate
Jobsite Equipment
• Scaffolding and hoisting for construction access
• Equipment for excavation, structural steel and concrete construction
• Small tools and equipment as required by trade
Contract Modification Procedures
• All Change Proposals will be submitted on Construction Managers standard format and as
per the contract documents
Applications for Payment
• Applications for Payment shall be submitted on the AIA G702 / G703
• Price does not include using Architect's itemized Cost Data Report Form 757A and 757B
and is excluded
Closeout
• All closeout documents and procedures will be conveyed to the Owner and will be carried
out in accordance with the Construction Managers standard procedures
• Prior to substantial completion, Owner and Construction Manager will walk thru the project
to identify items to be completed prior to substantial completion
• Upon substantial completion of the work, the Owner and Construction Manager shall walk
the project and prepare a punch list which will describe all of the items to be performed by
the Construction Manager to bring the project to full completion. When the Construction
Manager performs these to the Owner's satisfaction, the project shall be deemed to be one
hundred percent (100%) completed
