G-09-03-26-9B1 - 3/26/2009ORDINANCE NO. 4"oct, v2 Zh�clg AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.1816(24), AND ADDING SECTION 9.1821, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING STOPPING, STANDING, OR PARKING OF VEHICLES; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.1816(24), Code of Ordinances, 1995 Edition, City of Round Rock, Texas, is hereby amended to read as follows: 9.1816 PARKING PROHIBITED IN CERTAIN DESIGNATED LOCATIONS When signs are erected giving notice thereof, no person shall at any time park a vehicle upon any of the following described streets or parts of streets: (24) Lamar Drive between Old Settlers Boulevard and Commerce Boulevard (a) It shall hereafter be unlawful for any person to stop, stand or park a motor vehicle, vehicle, trailer, or automobile, as those terms are defined by Section 502.001 of the Texas Transportation Code, V.T.C.A, on the east side of Lamar Drive between Old Settlers Boulevard and Commerce Boulevard. (b) It shall hereafter be unlawful for any person to stop, stand or park a motor vehicle, vehicle, trailer, or automobile, as those terms are defined by Section 502.001 of the Texas Transportation Code, V.T.C.A, on the west side of Lamar Drive from its intersection with Old Settlers Blvd. to 190 feet south of Old Settlers Blvd. (c) Any such vehicle or trailer parked in such prohibited area shall be a nuisance per se and shall deemed to be a traffic and public safety hazard. Any vehicle or trailer parked in violation of this Section may be removed by a police officer or at his or her direction and retained until such time as any towing and storage fees are paid; provided however that the prohibited parking area shall be posted with an official sign giving notice of the prohibition and of the fact that such area is a tow away zone. II. That Chapter 9, Section 9.1800, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding Section 9.1821 which shall read as follows: 0:\WDOX\ORDINANC\090312C1.DOC/rmc 9.1821 PARKING ADJACENT TO FIRE STATIONS Prohibiting the stopping, standing or parking of vehicles within 20 feet of the driveway entrance to a fire station and on the side of a street opposite the entrance to a fire station within 75 feet of the entrance for the following fire stations: Fire Stations 1, 2, 3 and 7. III. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 9, Section 9.1816(24) and adding Section 9.1821, Code of Ordinances, regarding stopping, standing or parking of vehicles on Lamar Boulevard and near certain fire stations. (Second Reading) Department: Staff Person: Justification: Transportation Services Tom Word, P.E., Chief of Public Works Operations Amending the No Parking Zone on a specified portion of Lamar Drive will provide a safer environment due to previous land configurations. Also, with addition of the same restrictions at Fire Stations 1, 2, 3 and 7 this amendment will ensure that the roadways surrounding these Stations remain unobstructed, thus allowing clear passage for emergency vehicles within 20 feet of the driveway entrance and 75 feet on the opposite side of the street from the entrance. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: At the June 26, 2008 City Council meeting, Council approved an ordinance establishing a No Parking Zone on this same portion of Lamar Drive. At that time Lamar Drive had been recently re -striped to allow for three lanes of traffic; one lane for southbound vehicles, one lane for a northbound left turn lane and one lane for a northbound right turn lane. The amendment of this ordinance to no stopping, standing or parking of vehicles is in response to large transport vehicles parking for an exorbitant amount of time to load and unload cargo on this section of Lamar Drive.
