G-09-03-26-9B2 - 3/26/2009ORDINANCE NO. qe-001,03-2c-ctt52_ AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, CHANGING THE SPEED ZONE ON A PORTION OF F.M. 1325; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356 of the Texas Transportation Code authorizes the governing body of a municipality to alter, by ordinance, prima facie speed limits pursuant to an engineering and traffic investigation, and WHEREAS, an engineering and traffic investigation was conducted on a portion of F.M. 1325 (southbound) beginning at milepoint 0.553 to milepoint 0.848 and F.M. 1325 (northbound) beginning at milepoint 0.848 to milepoint 0.553 on the 14th day of November, 2008, and WHEREAS, a copy of said engineering and traffic study is attached hereto and incorporated herein for all purposes as Exhibit "A", and WHEREAS, the results of said engineering and traffic investigation indicate that the speed limit on a portion of F.M. 1325 (southbound) beginning at milepoint 0.553 to milepoint 0.848 and F.M. 1325 (northbound) beginning at milepoint 0.848 to milepoint 0.553 should be 50 miles per hour, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: O:\WDOX\ORDINANC\090312C2.DOC/rmc I. That Chapter 9, Section 9.502(8), of the Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding the following: (8) The maximum prima facie speed limit shall be fifty (50) miles per hour along the following streets: ON FROM TO F.M. 1325 Milepoint 0.553 Milepoint 0.848 (southbound) F.M. 1325 Milepoint 0.848 Milepoint 0.553 (northbound) IL A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. (Second Reading) Department: Staff Person: Justification: Transportation Services Tom Word, P.E., Chief of Public Works Operations The TxDOT District Traffic Engineering office completed a speed study on F.M. 1325 and has requested that the prima facie maximum speed limit of 70 -mph be reduced to 50 -mph, within the City of Round Rock city limits. Funding: Cost: N/A Source of funds: N/A Outside Resources: TxDOT Background Information: TxDOT is requesting the reduction of the speed limit from 70 -mph to 50 -mph for southbound lanes of F.M. 1325 beginning at a point 0.553 miles south of the centerline of SH 45 westbound frontage road to the City of Round Rock city limit, a point 0.848 mile south of the centerline of SH 45 westbound frontage road; for northbound lanes, beginning at the City of Round Rock city limit northward to a point 0.553 mile south of the centerline of SH 45 westbound frontage road. The total distance is 0.295 miles in each direction. Public Comment: N/A
