AN ORDINANCE AMENDING CHAPTER 11, SECTIONS 11.415.2, 11.418, AND 11.800, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING COMMUNITY RECREATIONAL FACILITIES; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 11, Section 11.415.2, Subsection (2)(a), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: 11.415.2 PF -3 (PUBLIC FACILITIES - HIGH INTENSITY) DISTRICT (2) Permitted Uses (a) The following uses are permitted by right: Use Cemeteries, Mausoleums, Columbaria, Memorial Parks Community Recreational Facilities Community Service Day Care Governmental Facilities Hospitals Office, Public Office, Medical Parks, Community Parks, Linear/Linkages Parks, Neighborhood Place of Worship Research and Development II. That Chapter 11, Section 11.415.2(4), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding a new subsection (g) which shall read as follows: 0:\wdox\SCC1nC5\0112\0905\MUNICIPAL\00154353. DOC/rmc 11.415.2 PF -3 (PUBLIC FACILITIES - HIGH INTENSITY) DISTRICT (4) Public Facilities Design Standards The following design standards apply to all buildings in the PF -3 (Public Facilities - High Intensity) district. These standards are intended to ensure an attractive built environment in Round Rock. These standards supplement any district -specific standards. Alternate design standards may be approved by the Zoning Administrator to permit a more flexible or creative design. (g) The use of a steel framed fabric tension structure or a tensile fabric membrane structure shall be allowed for Community Recreational Facility buildings which contain a minimum of 40,000 square feet of enclosed area. The provisions contained in paragraphs (a), (b), (c), (d) and (e) of this Section shall not apply to such buildings. That Chapter 11, Section 11.418, Subsection (2)(a), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to read as follows: 11.418 OS (OPEN SPACE) DISTRICT (2) Permitted Uses (a) The following uses are permitted by right: Use Park, Community Park, Community Recreational Facilities Park, Linear/Linkages Park, Neighborhood Park, Regional/Metropolitan Iv. That Chapter 11, Section 11.418(4), Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended by adding a new subsection (b) which shall read as follows: 11.418 OS (OPEN SPACE) DISTRICT (4) Open Space Design Standards The following design standards apply to all buildings in the OS (Open Space) District. Alternative design standards may be approved by the Zoning Administrator in order to permit a more flexible or creative design. 2 (b) The use of a steel framed fabric tension structure or a tensile fabric membrane structure shall be allowed for Community Recreational Facility buildings which contain a minimum of 40,000 square feet of enclosed area. That Chapter 11, Section 11.802, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to amend the definition of "Community Recreational Facilities" to read as follows: 11.802 DEFINITIONS Term Defmition Community recreational facilities Any parks, playgrounds and sports, recreation or other community buildings owned and/or operated by the City or other governmental agency, but not including country clubs or golf courses, but not including miniature golf courses, driving ranges or similar forms of commercial amusement. VI. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. 3 Alternative 1. Consider an ordinance amending Chapter 11, Code of Ordinances, regarding community recreational facilities. (First Reading) Department: Staff Person: Justification: Planning and Community Development Jim Stendebach, Planning and Community Development Director The proposed amendment would allow large Community Recreational Facilities to be constructed as fabric tension buildings, which currently do not meet the design standards of the PF -3 (Public Facilities — High Intensity) or OS (Open Space) districts. The buildings will instead meet special standards for appearance. The amendment would apply only to buildings owned or operated by the City which contain a minimum of 40,000 square feet of enclosed area. The West Side Recreation Center planned for a site adjacent to the Krebsbach Pool off of Deepwood Drive would be a fabric tension structure and the amended regulations would apply. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: The Planning and Zoning Commission recommended approval of the proposed revision at their meeting on March 11, 2009, after requesting assurance that the building would be subject to adequate regulations regarding its appearance. Public Comment: Public notice was posted and a public hearing held in accordance with the City of Round Rock's Zoning Ordinance at the Planning and Zoning Commission meeting on March 11, 2009.
