R -09-05-14-9D2 WHEREAS, the City of Round Rock has duly advertised for bids for the Egger Acres and Dennis Drive Improvements Project, and WHEREAS, Nelson Lewis, Inc. has submitted the lowest responsible bid, and WHEREAS, the City Council wishes to accept the bid of Nelson Lewis, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City a contract with Nelson Lewis, Inc. for the Egger Acres and Dennis Drive Improvements Project. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider a resolution authorizing the Mayor to execute a construction contract with Nelson Lewis, Inc. for Egger Acres and Dennis Drive Improvements. Department: Staff Person: Justification: Engineering and Development Services Danny Halden, P.E., City Engineer On April 21, 2009, fifteen (15) bids were submitted for Egger Acres and Dennis Drive Improvements. S.D. Kallman, L.P. and City Staff have determined that Nelson Lewis, Inc. submitted the lowest and best bid and recommends award of this contract to this firm. Staff is recommending award of the base bid and add/deduct alternatives one thru eight (1-8). This contract is for construction services to install underground drainage improvements, pavement milling and resurfacing, and curb and gutter repairs. Funding: Cost: $1,237,883.00 Source of funds: 2002 G.O. Bonds Outside Resources: S.D. Kallman, L.P. Background Information: This project was previously bid in the summer of 2008. Because the bid price of approximately $2,000,000.00 significantly exceeded available funds, the City rejected all bids by resolution on September 11, 2008. Subsequently, the plans were revised to address the drainage improvements costs and to modify the pavement milling and resurfacing specifics. It is believed that the bid price today is substantially different from the summer of 2008 due to today's economic climate and the adjustments made to the plans. Public Comment: N/A
