R -09-05-14-9G9 WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering Services ("Contract") with HDR Engineering, Inc. for the Kenney Fort Boulevard (Arterial A) Project, and WHEREAS, HDR Engineering, Inc. has submitted Supplemental Contract No. 3 to the Contract to modify the provisions for the scope of services, and WHEREAS, the City Council desires to enter into said Supplemental Contract No. 3 with HDR Engineering, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Contract No. 3 to the Contract with HDR Engineering, Inc., a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 14th day of April, 2005 for the Arterial A Project in the amount of $41,280.13; and WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on the 25th day of May, 2006 to modify the provisions for the scope of services and to increase the compensation by $378,836.00 to a total of $420,116.13; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on the 25th day of November, 2008 to modify the provisions for the scope of services and to increase the compensation by $912,053.00 to a total of $1,332,169.13; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $89,878.00 to a total of $1,422,047.13; and NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Article 2, Engineering Services and Exhibit B. Engineering Services shall be amended as set forth in the attached Addendum To Exhibit B. Sheets, City Attorney Supplemental Contract #3 Rev.12l01/08 400156687; 0199.0320 — TX02ARTA 84275 2 ADDENDUM TO EXHIBIT B Engineering Services The changes to the scope of this project are as follows: Arterial A -North of Joe Dimaggio to North of Chandler Creek — Lump Sum Fee The work to be performed by the Engineer under this section of supplemental agreement #3 shall consist of providing engineering services for Hydraulics, drainage, ROW, bridge design roadway geometries and preparation of 1 (one) set of Plans, Specifications, and Estimates (PS&E) for the construction of 3 lane Arterial A bridge over Chandler Creek and an extended pavement transition. This supplemental agreement will also provide for FEMA coordination and Hydraulic modeling in lieu of project coordination from the previous supplemental agreement. PS&E shall be prepared in accordance with the applicable requirements of TxDOT and CITY OF ROUND ROCK Specifications, Standards, and manuals (updated for revisions) and the TxDOT construction specifications. Deliverables Required of the ENGINEER The ENGINEER will be required to provide the following deliverable items for the Chandler Creek crossing: I. Bridge Hydraulic design and FEMA coordination. 2. Bridge Layout and Bridge Design and Detailing 3. Retaining Wall under Chandler Creek Bridge 4. Consider a resolution authorizing the Mayor to execute Supplemental Contract No. 3 for Engineering Services with HDR Engineering, Inc. for the Kenney Fort Boulevard (Arterial A) Project. Department: Staff Person: Justification: Transportation Services Tom Word, P.E.; Chief of Public Works Operations Supplemental Contract No. 3 will provide for engineering services related to hydraulics, drainage, right- of-way, bridge design roadway geometrics and PS&E preparation for the construction of a three -lane Arterial A bridge over Chandler Creek, as well as an extended pavement transition. Also provided by the Contract is FEMA coordination and hydraulic modeling. PS&E will be prepared in accordance with the TxDOT and City of Round Rock specifications and standards. Funding: Cost: $89,878.00 Source of funds: 4B Outside Resources: N/A Background Information: HDR Engineering, Inc. has been the design Engineer for the Arterial A project since its inception. Their continued efforts to provide a resolution of the project will provide consistent project knowledge and coordination with already familiar entities. The City Council approved a resolution authorizing the Mayor to enter into a contract with HDR Engineering, Inc. on April 14, 2005. Subsequently, the Council approved execution of Supplemental Contract No. 1 on May 25, 2006, and Supplemental Contract No. 2 on November 25, 2008.
