WHEREAS, the U.S. Department of Justice, has grant funds
available to cities for various law enforcement projects, and
WHEREAS, grant funds are available through the Office of
Justice Programs Bureau of Justice Assistance under the Edward Byrne
Memorial Justice Assistance Grant Program, and
WHEREAS, the City Council wishes to make application for the
available funds for the purchase of mobile communication terminals,

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City various documents in the application packet for
the Edward Byrne Memorial Justice Assistance Grant, a copy of said
Application being attached hereto as Exhibit "A" and incorporated
herein for all purposes.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered

Program Narrative
We are requesting funds for equipment to assist our detectives. Mobile
Communications Terminals (MCTs) are used by police officers to access the
Computer Aided Dispatch (CAD) system and the Record Management System
(RMS) remotely. These systems provide access to critical information about
criminals. Officers may communicate via their MCT with other units equipped
with MCTs and with CAD users. Officers can self -initiate themselves onto an
activity, perform status and location changes, generate report numbers,
and perform numerous inquiries relating to the current status of calls and units.
A call for service can be handled silently from dispatch through completion. MCTs
also provide necessary safety features for emergency situations.
These MCTs would be for the Criminal Investigations Division (CID) of the police
department. Providing detectives with MCTs is not currently in our operating
budget. The purchase of these MCTs would enhance officer safety and provide
information access benefits to our detectives.
Supplying Mobile Communication Terminals to detectives supports the Police
Department's strategic goal to expand logistical capabilities through research,
development, and utilization of effective technologies to enhance police service.
This equipment will provide CID officers access to critical Department
information systems for more effective coordination of cases.
Budget Narrative
With these funds, the Police Department seeks to purchase two Mobile
Communication Terminals (MCT) for the Criminal Investigations Division.
Costs include:
• 2 Mobile Communication Terminals at $4,530 each. Total $9,060
• 2 OSSI Visual MCT and Netmotion VPN software licenses
at $2,135 each. Total $4,270
• 2 Docking Stations/Mounting Hardware at $1,375 each. Total $2,750

planning and coordinating the apprehension of criminals in the City
of Round Rock.
Strategy: The strategy for achieving this goal is through the utilization of
effective technologies to enhance police service. Mobile
Communication Terminals will provide our detectives with the
necessary technology and equipment to access critical information in
a timely manner.

judgment rendered against them for commission of fraud or a criminal offense in connection with

theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen

3. DRUG-FREE WORKPLACE (GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug -Free Workplace Act of 1988, and implemented at 28 CFR Part 83, Subpart F, for
grantees, as defined at 28 CFR Sections 83.620 and 83.650:
A. The applicant certifies that it will or will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is prohibited in the grantee's workplace and specifying the
actions that will be taken against employees for violation of such prohibition;
(b) Establishing an on-going drug-free awareness program to inform employees about
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation, and employee assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations occurring in the
workplace;
(c) Making it a requirement that each employee to be engaged in the performance of the grant be given a
copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of employment
under the grant, the employee will
(1) Abide by the terms of the statement; and
(2) Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring
in the workplace no later than five calendar days after such conviction;
(e) Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph
(d)(2) from an employee or otherwise receiving actual notice of such conviction. Employers of convicted
employees must provide notice, including position title, to: Department of Justice, Office of Justice

Brief description of proposed grant program:
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program is the primary provider of
federal criminal justice funding to state and local jurisdictions. JAG funds support all components
of the criminal justice system, from multijurisdictional drug and gang task forces to crime
prevention and domestic violence programs, courts, corrections, treatment, and justice
information sharing initiatives. JAG funded projects may address crime through the provision of
services directly to individuals and/or communities and by improving the effectiveness and
efficiency of criminal justice systems, processes, and procedures.
Applicants are limited to units of local government appearing on the FY 2009 JAG Allocations
List. The procedure for allocating JAG funds is a formula based on population and crime
statistics, in combination with a minimum allocation to ensure that each state and territory
receives an appropriate share. The City of Round Rock is on that list and is eligible for an
individual allocation of $13,336.
With these funds, the Police Department seeks to purchase two Mobile Communication
Terminals (MCT) for the Criminal Investigations Division. Costs include:
• 2 Mobile Communication Terminals at $4,530 each, totaling $9,060.
• 2 OSSI Visual MCT and Netmotion VPN software licenses at $2,135 each, totaling $4,270
• 2 Docking Stations/Mounting Hardware at $1,375 each, totaling $2,750.

No, this is a continuation of an existing program started in the LE Fund in the 2008-09 Fiscal
Year.
If at all, how is this program currently being provided?
Providing detectives with MCTs is not something we've previously done. We began this program
through the LE Fund because of the officer safety and information access benefits our detectives
receive from this equipment.

We will look for other funding sources.
After the assets from the grant are received or purchased, will these assets need additional
funding (e.g. repair & maintenance, fuel, etc.) for the following years? If so, please explain with

Annual OSSI Software maintenance is $400 per MCT. Annual Netmotion Software maintenance
is $50 per MCT.

The U.S. Department of Justice, Office of Justice Programs' (OJP) Bureau of Justice Assistance (BJA) is
funding applications under the Edward Byrne Memorial Justice Assistance Grant (JAG) Program: FY 2009
Local Allocation. The Edward Byrne Memorial Justice Assistance Grant (JAG) Program is the primary
provider of federal criminal justice funding to state and local jurisdictions. JAG funds support all
components of the criminal justice system, from multijurisdictional drug and gang task forces to crime
prevention and domestic violence programs, courts, corrections, treatment, and justice information
sharing initiatives. JAG funded projects may address crime through the provision of services directly to
individuals and/or communities and by improving the effectiveness and efficiency of criminal justice
systems, processes, and procedures. Specifically, under this solicitation, applicants are limited to units of
local government appearing on the FY 2009 JAG Allocations List. The procedure for allocating JAG funds
is a formula based on population and crime statistics, in combination with a minimum allocation to
ensure that each state and territory receives an appropriate share. The City of Round Rock is on that list
and is eligible for an individual allocation of $13,336.

. Abstract
Program Narrative
We are requesting funds for equipment to assist our detectives. Mobile
Communications Terminals (MCTs) are used by police officers to access the
Computer Aided Dispatch (CAD) system and the Record Management System
(RMS) remotely. These systems provide access to critical information about
criminals. Officers may communicate via their MCT with other units equipped
with MCTs and with CAD users. Officers can self -initiate themselves onto an
activity, perform status and location changes, generate report numbers,
and perform numerous inquiries relating to the current status of calls and units.
A call for service can be handled silently from dispatch through completion. MCTs
also provide necessary safety features for emergency situations.
These MCTs would be for the Criminal Investigations Division (CID) of the police
department. Providing detectives with MCTs is not currently in our operating
budget. The purchase of these MCTs would enhance officer safety and provide
information access benefits to our detectives.
Supplying Mobile Communication Terminals to detectives supports the Police
Department's strategic goal to expand logistical capabilities through research,
development, and utilization of effective technologies to enhance police service.
This equipment will provide CID officers access to critical Department
information systems for more effective coordination of cases.
Budget Narrative
With these funds, the Police Department seeks to purchase two Mobile
Communication Terminals (MCT) for the Criminal Investigations Division.
Costs include:
• 2 Mobile Communication Terminals at $4,530 each. Total $9,060
• 2 OSSI Visual MCT and Netmotion VPN software licenses
at $2,135 each. Total $4,270
• 2 Docking Stations/Mounting Hardware at $1,375 each. Total $2,750

1. It has the legal authority to apply for federal assistance and the institutional, managerial, and financial

2. DEBARMENT, SUSPENSION, AND OTHER RESPONSIBILITY MATTERS (DIRECT RECIPIENT)
As required by Executive Order 12549, Debarment and Suspension, and implemented at 2 CFR Part
2867, for prospective participants in primary covered transactions, as defined at 2 CFR Section
2867.20(a):
A. The applicant certifies that it and its principals:
(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, sentenced to a
denial of Federal benefits by a State or Federal court, or voluntarily excluded from covered transactions
by any Federal department or agency;
(b) Have not within a three-year period preceding this application been convicted of or had a civil
judgment rendered against them for commission of fraud or a criminal offense in connection with
obtaining, attempting to obtain, or performing a public (Federal, State, or local) transaction or contract
under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement,
theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen
property;
(c) Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (1)(b) of this
certification; and
(d) Have not within a three-year period preceding this application had one or more public transactions
(Federal, State, or local) terminated for cause or default.
B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall
attach an explanation to this application.
3. DRUG-FREE WORKPLACE (GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug -Free Workplace Act of 1988, and implemented at 28 CFR Part 83, Subpart F, for
grantees, as defined at 28 CFR Sections 83.620 and 83.650:
A. The applicant certifies that it will or will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is prohibited in the grantee's workplace and specifying the
actions that will be taken against employees for violation of such prohibition;
(b) Establishing an on-going drug-free awareness program to inform employees about
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation, and employee assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations occurring in the
workplace;
(c) Making it a requirement that each employee to be engaged in the performance of the grant be given a
copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of employment
under the grant, the employee will
(1) Abide by the terms of the statement; and
(2) Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring
in the workplace no later than five calendar days after such conviction;
(e) Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph
(d)(2) from an employee or otherwise receiving actual notice of such conviction. Employers of convicted
employees must provide notice, including position title, to: Department of Justice, Office of Justice
Programs, ATTN: Control Desk, 810 7th Street, N.W., Washington, D.C. 20531. Notice shall include the
identification number(s) of each affected grant;
(f) Taking one of the following actions, within 30 calendar days of receiving notice under subparagraph

appropriate agency;
(g) Making a good faith effort to continue to maintain a drug-free workplace through implementation of
paragraphs (a), (b), (c), (d), (e), and (f).

No, this is a continuation of an existing program started in the LE Fund in the 2008-09 Fiscal
Year.

Providing detectives with MCTs is not something we've previously done. We began this program
through the LE Fund because of the officer safety and information access benefits our detectives
receive from this equipment.

We will look for other funding sources.
After the assets from the grant are received or purchased, will these assets need additional
funding (e.g. repair & maintenance, fuel, etc.) for the following years? If so, please explain with

Annual OSSI Software maintenance is $400 per MCT. Annual Netmotion Software maintenance
is $50 per MCT.
