G-09-07-23-9A1 - 7/23/2009ORDINANCE NO. q,01-1.14-4,3-4/Ai AN ORDINANCE AMENDING CHAPTER 6, SECTION 6.502, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, REGARDING TEMPORARY FOOD ESTABLISHMENTS; AND PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 6, Section 6.502, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to amend the definition of "Temporary Food Establishment" to read as follows: 6.502 DEFINITIONS The following definitions shall apply in the interpretation and enforcement of this Section: (10) Temporary Food Establishment shall mean a Food Establishment that operates in conjunction with a special event or celebration that: i) operates for more than four (4) hours in a single day, serves potentially hazardous foods, and is open to the general public; or ii) operates for a period of no less than two (2) consecutive days and no more than fourteen (14) days. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that 0:\wdox\SCClnts\0112\0905\MUNICIPAL\090723A1.DOC/rmc such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance amending Chapter 6, Section 6.502, Code of Ordinances, regarding temporary food establishments. (Second Reading) Department: Staff Person: Justification: Administration Steve Sheets, City Attorney Kay Kelley, Supervisor, Retail Food Program at the Williamson County Health district sent a letter to the City Attorney's office dated June 3, 2009. The letter outlined recent complaints received by the Health Department related to unsanitary food storage and preparation at one day events. Currently vendors operating at one day events are exempt from the Health District permitting process, and therefore, vendors at these events are not inspected prior to operating. In order to meet its goal of protecting the health of the citizens of Round Rock, the Health District recommends that the City amend its definition of Temporary Food Establishment, so that vendors at one day events may become subject to the Health District permitting and inspection process. The Council approved the Georgetown version of the ordinance on first reading only at the July 9, 2009 City Council meeting. Attached is a revised ordinance for approval on second reading.
