WHEREAS, Williamson County Amateur Radio Emergency Services
(WCARES) provides backup radio communication services to local
governmental entities in the event of disasters or emergencies, and
WHEREAS, the City of Round Rock and WCARES wish to enter into a
Memorandum of Understanding outlining the coordination of their
emergency communication operations, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a Memorandum of Understanding with the Williamson
County Amateur Radio Emergency Services, a copy of same being attached
hereto as Exhibit "A" and incorporated herein.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

CITY OF ROUND ROCK

I. INTRODUCTION
A. Background
The United States Congress formally established the Amateur Radio Service in
the Communications Act of 1934. Title 47, Code of Federal Regulations, Section
97.1 provides, in part, "The rules and regulations in this part are designed to
provide an amateur radio service having a fundamental purpose as expressed in
the following principles:
(a) Recognition and enhancement of the value of the amateur service
to the public as a voluntary non-commercial communication service,
particularly with respect to providing emergency communications."
B. Scope
This Memorandum of Understanding (MOU) between the City of Round Rock
(City) and the Williamson County Amateur Radio Emergency Service
(WCARES) is to support local area government officials with communication
services during emergency conditions.
C. Purpose
The parties enter into this MOU in order to enhance communications within the
City of Round Rock and between public service agencies, during emergencies and
disasters. This MOU shall describe cooperation during planning, tests, activation,
deactivation and response evaluation.
D. Operation
This MOU becomes effective upon signature by authorized representatives for the
parties. Under this MOU, identified representatives of the City are authorized to
activate the volunteer communications resources of WCARES.
EXHIBIT
The City recognizes that each of the individual amateur radio service licensees
has ultimate discretion and responsibility, in any given situation, to operate within
the terms and conditions of that individual's operating license and within the
scope of Part 97 of the Code of Federal Regulations and the City shall make no
willful attempt to violate the individual's operating license. The City also
recognizes that WCARES has similar understandings with other disaster
assistance agencies and units of general and special purpose government.
E. Description
WCARES is a volunteer organization of individually licensed amateur radio
service operators who, having passed a written examination, have demonstrated
their technical and operating skills in radio communications and are licensed by
the Federal Communications Commission.
II. IDENTIFICATION
WCARES volunteers will be identified by identification cards or badges by the Amateur
Radio Relay League of North America. The picture identification card or badge, a copy
of which is provide for in Appendix A, will identify the volunteer as a member of the
ARES and shall be signed by the current Emergency Coordinator for WCARES, as
identified in Appendix B.
III. IMPLEMENTATION PROCEDURES
A. Notification of WCARES
Upon notification or determination of an emergency condition or situation posing
an extraordinary threat to life and or property, an authorized individual of the City
of Round Rock shall contact WCARES through the identified individuals. Each
party shall keep a current list of those individuals, which is provided for in
Appendix B.
In the event of major disasters such as a tornado or flood which, by their very
nature, may disrupt lines of communication, notification by the City shall be
deemed to be automatic and available personnel shall respond without waiting for
notification.
In either event, the WCARES Emergency Coordinator and/or Assistant
Emergency Coordinator will contact the WCARES Operations Assistant
Emergency Coordinator for an activation of the Emergency Amateur Radio
Network in the City's emergency operations center, located at Round Rock
Central Fire Department, 203 Commerce, Round Rock, TX. All the rest of
WCARES members shall monitor the 145.130 or 146.64 repeater and wait for
further instructions. A copy of the WCARES organization chart is provided for in
Appendix C.

Upon cessation of the emergency condition, a deactivation order shall be issued
by an authorized individual of the City or upon request by an authorized
representative of WCARES.
B. Disaster Response Time
The parties to this MOU recognize that WCARES is a volunteer organization and
that response times for providing communications services will vary. In a major
disaster some delay in response time of more than an hour may be expected, as
the volunteers have been instructed to provide first for the welfare of their
families, property and work responsibilities.
C. WCARES Response
Upon notification by an authorized representative of the City of Round Rock, the
notified WCARES representative will institute activation and establish
communications as appropriate.
Upon arrival at the City's emergency operations center, WCARES will provide
backup communications needs for the City establishing radio stations at locations
described in the City of Round Rock Emergency Management Plan and as
provided for in Appendix D.
WCARES will activate available City -owned communications resources with
licensed WCARES operators (with personally owned radio equipment), and will
undertake resource mobilization efforts to provide reliable sustained
communications until termination of the test, emergency or disaster.
IV. TESTS
WCARES will conduct routine tests of its communications resources and participate, to
the extent possible, in Simulated Emergency Tests (SETS) and special events.
A. Weekly
1. One test of a repeater net on an authorized amateur radio frequency.
2. One test of a simplex net on an authorized amateur radio frequency.
B. Events Participation
1. Participation in City or Williamson County planned SETS, not to exceed
two times per year.
2. Periodic verification of equipment readiness exercises.
3
3. Public service activities upon request and agreement by the parties.
V. PLANNING
A. Authorized Representatives
For purposes of cooperative disaster planning, each party shall name authorized
individuals to assure that the plans are coordinated. The names of the authorized
representatives are provided for in Appendix E.
B. The City of Round Rock Emergency Management Plan
The City shall incorporate into the City of Round Rock Emergency Management
Plan provisions for communications services to be provided by WCARES.
C. Continuing Planning
The City and WCARES shall cooperate in periodic reviews and updates to the
City of Round Rock Emergency Management Plan.
VI. SUSPENSION, NOTICE AND REVIEW OF PARTICIPATION OF INDIVIDUAL
WCARES MEMBERS
A. Oral Suspension
An authorized representative of the City and/or the WCARES can temporarily
suspend, with a cause stated, the participation of an individual member of
WCARES by immediate oral notification.
B. Written Notice
An oral, temporary suspension must be substantiated by the acting authorized
representative in writing to the affected person and to all authorized parties within
seventy-two (72) hours.
C. Review; Reinstatement or Termination
The authorized representatives of the City of Round Rock and the WCARES must
convene a joint meeting within 30 days of the oral suspension with the aggrieved
parties to review and decide either the reinstatement or termination of the
member. The City retains the right to refuse admittance to City- owned or leased
facilities and/or use of City -owned equipment by the aggrieved party.

VII. AMENDMENTS TO THE MOU
This MOU may be amended upon 30 days written notification by either party.
VIII. TERM OF MOU
The term of this MOU shall be for one (1) year from the effective date of this MOU and
shall renew automatically, unless terminated.
This MOU may be terminated upon 30 days written notification by either party.
The effective date of this MOU is August , 2003.
