Cavital of Texas Highway, Building 2 Suite 100Austin TX 78746 PROJECT: Kensington Detention and Channel Improvements This Supplemental Contract No. 2 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and K Friese & Associates, Inc., hereinafter called the "Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 22nd day of October, 2015 for the Kensington Detention and Channel Improvements Project in the amount of $169,843.00; and WHEREAS, the City and Engineer executed Supplemental Contract No. I on October 2, 2017 to amend the scope of services and to increase the compensation by $10,478.11 to a total of $180,321.11; and WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by $4,000.00 to a total of $184,321.11; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Article 2. Engineering Services and Exhibit B._En Engineering Services shall be amended as set forth in the attached Addendum to Exhibit B. II. Article 4 Compensation and Exhibit D Fee Schedule shall be amended by increasing by $4,000.00 the lump sum amount payable under the Contract for a total of $184,321.11, as shown by the attached Addendum to Exhibit D. Sections 2.3 in the original contract shall add the following: 2.3.4 Dry Branch Borrow Study An additional borrow study will be conducted at Dry Branch as follows: • One Day of Test Pit Observations at two drop locations. Permission to access the Dry Branch project across existing property owner will be obtained by City of Round Rock. • Soil Sample Collection from Test Pits for laboratory testing. Visually classify and collect disturbed bulk samples for laboratory testing. It is anticipated the G to 8 test pits will be excavated in one day (with two load and unload locations). • Laboratory Testing. Laboratory testing will include Atterberg Limits determination, grain size analyses for USCS classification, and crumb dispersion testing — for possible use as borrow for the Kensington Pond project. • Reporting. The report will include test pit logs, results of laboratory test data, and a cover letter stating the engineering opinion of use of the tested soil material for Kensington embankment construction. The City previously entered into an Engineering Services Contract with K Friese & Associates, Inc. to design a regional stormwater detention pond and channel repairs for the Dry Branch Tributary 1 traversing through the Kensington Place neighborhood. The scope of services for the original contract included the design of the detention pond facility and the design of the channel improvements and repairs to the existing drop structures located within the channel for the Dry Branch Tributary 1. The design of the channel repairs and improvements have already been completed and constructed. This Supplemental Contract No. 2 is to provide an additional geotechnical study for the soils located at Dry Branch Tributaries Project to determine the possibly of these soils being used as borrow material for the Kensington Detention Project earthen berms. The current Engineering Services Contract provided for a maximum payment of $180,321; this supplement will increase the contract to a maximum of $184,321.
