WHEREAS, the City of Round Rock previously requested the City of
Austin to release from its extraterritorial jurisdiction (ETJ) the
territory identified on the map attached as Exhibit "A" to this
Resolution, and
WHEREAS, on October 26, 2000, the City of Austin adopted
Resolution No. 001026-30 (a copy of which is attached hereto as Exhibit
"B") releasing said territory from its ETJ pursuant to Section 42.023
of the Texas Local Government Code, provided that the City of Round
Rock accept such territory into its ETJ, and
WHEREAS, the City Council wishes to accept such territory into
its ETJ, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the territory identified on the map attached as Exhibit "A"
to this Resolution, a total of approximately 26.4 acres of land is
hereby accepted into the City of Round Rock's ETJ under authority of
Section 42.023, Texas Local Government Code and in response to
Resolution 001026-30 of the City of Austin, and
BE IT FURTHER RESOLVED,
That the City Manager or his designee is authorized and directed
to revise the City of Round Rock's ETJ map to reflect the acceptance of
said territory.

The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended, and the Act.

RESOLUTION NO. 001026-30
WHEREAS, the City of Round Rock, Texas has requested the City of
Austin to release from its extraterritorial jurisdiction the territory identified on the
map and field notes attached as EXhibit "A" to this resolution; and
WHEREAS, this territory consists of approximately 26.4 acres; and
WHEREAS, the City of Routed Rock has expressed its intention to accept
. the territory identified on the map and field notes attached as Exhibit "A" to this
resolution into the extraterritorial jurisdiction of the City of Round Rock, so that
development of the property may proceed under development regulations of the
' City of Round Rock and so that the development may receive sewer service from
the City of Round Rock in accordance with the City's development regulations;
and
WHEREAS, principles of sound planning and regional cooperation incline
the Austin City Council to give due respect and consideration to the development
concerns of Austin's neighbor cities; and
WHEREAS, Section 42,023 of the Texas Local Government Code
authorizes the Austin City Council to release territory from the City of Austin's
extraterritorial jurisdiction by resolution; NOW, THEREFORE,

That the territory identified on the map and field notes attached as exhibit
"A" to this resolution, a total of approximately 26.4 acres of land, is hereby
released from the City of Austin's extraterritorial, jurisdiction under authority of
Section 42,023 of the Texas Local Govemment Code; provided however, that such
release is conditioned upon the acceptance by the governing body of the City of
Round Rock of this territory into the City of Round Rock's extraterritorial
jurisdiction; and
BE IT FURTHER RESOLVED:

SUBJECT: City Council Meeting — December 14, 2000
ITEM: 13.C.2. Consider a resolution accepting approximately 26.404 acres of land
released by the City of Austin into the City of Round Rock's
extraterritorial jurisdiction. This property is located along RM 620
south of the Brushy Creek Municipal Utility District. The owners of
the property, Tony Ltd. requested release from Austin's extraterritorial
jurisdiction to request annexation by the Brushy Creek MUD and
receive water and wastewater service from the MUD.
