AN ORDINANCE AMENDING CHAPTER 9, SECTION 9.504, CODE OF ORDINANCES (1995 EDITION), CITY OF ROUND ROCK, TEXAS, ADOPTING A TEMPORARY CONSTRUCTION SPEED ZONE FOR A PORTION OF OLD SETTLERS BOULEVARD; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, Section 545.352 of the Texas Transportation Code establishes prima facie reasonable and prudent speed limits for streets and highways situated in the state of Texas, and WHEREAS, Section 545.356(b) of the Texas Transportation Code gives the governing body of a municipality the same authority as the Texas Transportation Commission to alter prima facie speed limits when a highway is under repair, construction or maintenance, and WHEREAS, Chapter 2, Section 3 of the Procedures for Establishing Speed Zones adopted by the Texas Transportation Commission states that normal speed studies are not required on sections of a highway under construction, and WHEREAS, construction will soon commence on Old Settlers Boulevard from Chandler Creek to Fairview Drive, Now Therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS: I. That Chapter 9, Section 9.504, Code of Ordinances (1995 Edition), City of Round Rock, Texas, is hereby amended to add subsection (2) which shall read as follows: O:\wdox\SCC1ntS\0112\0905\MUNICIPAL\090910A4.DOC/rmc 9.504 TEMPORARY CONSTRUCTION SPEED ZONES (2) During construction of Old Settlers Boulevard, the temporary maximum prima facie speed limit shall be thirty-five (35) miles per hour on Old Settlers Boulevard from Chandler Creek to Fairview Drive. This temporary speed limit shall expire upon completion of Old Settlers Boulevard from Chandler Creek to Fairview Drive, and the maximum prima facie speed limit shall thereafter be forty-five (45) miles per hour. II. A. All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. B. The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. C. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Ordinance was adopted was posted and that such meeting was open to the public as required by law at all times during which this Ordinance and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Consider an ordinance authorizing a temporary 35 -mph construction speed zone on OId Settlers Boulevard from Chandler Creek to Fairview Drive. (Second Reading) Department: Staff Person: Justification: Transportation Services Tom Word, P.E., Chief of Public Works Operations This ordinance will temporarily reduce the current speed limit on OId Settlers Boulevard from 45 -mph to 35 -mph from Chandler Creek to Fairview Drive during construction. This is part of the intersection realignment project on A.W. Grimes at Old Settlers Boulevard. Funding: Cost: N/A Source of funds: N/A Outside Resources: N/A Background Information: This portion of OId Settlers Boulevard, which is a main eastbound/westbound thoroughfare, is currently under construction. High traffic volume, coupled with construction present a safety factor. By temporarily reducing the speed limit from 45 -mph to 35 -mph during the construction phase safety and speed concerns will be alleviated. Public Comment: N/A
