WHEREAS, the City of Round Rock, Texas (the "City") is a
participating and founding member of the Brushy Creek Regional
Utility Authority, Inc., (the "BCRUA"), and
WHEREAS, the BCRUA has duly advertised for bids for the
construction of the Brushy Creek Regional Water Treatment Plant -
Phase 1A Project, and
WHEREAS, Pepper -Lawson Construction, L.P. has submitted the
lowest responsible bid, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS,
That the City Council hereby authorizes the Brushy Creek
Regional Utility Authority to enter into a contract with Pepper -
Lawson Construction, L.P. for the construction of the Brushy Creek
Regional Water Treatment Plant - Phase 1A Project.
The City Council hereby finds and declares that written notice
of the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to
the public as required by law at all times during which this
Resolution and the subject matter hereof were discussed, considered
and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

ITEM: 11E1. Consider a resolution authorizing the Brushy Creek Regional Utility (BCRUA) to
execute a contract with Pepper -Lawson Construction, L.P. for the Brushy Creek
Regional Water Treatment Plant — Phase 1A Project.

Justification:
This contract is for the construction of the new BCRUA Water Treatment Plant, Phase 1A, as designed by
Camp, Dresser & McKee, Inc. On August 18, 2009, the BCRUA received five bids on this project from
seven pre -qualified bidders. The bid amounts ranged from $47,323,000 to $49,784,857, which were
below the Engineer's opinion of probable cost of $58,542,000. The low bid was received from Pepper -
Lawson Construction, L.P. The Engineer, BCRUA, and Staff from Round Rock, Cedar Park, and Leander
recommend awarding the project to Pepper -Lawson Construction, L.P. The construction cost is
allocated to the Cities based on their ultimate capacity in the WTP. Round Rock's allocated percentage
is 35% which totals $16,563,050 of the project cost.

Background Information:
The purpose of these improvements is to treat water that will be delivered from Lake Travis via a 78"
raw water line to the BCRUA Water Treatment Plant. The City of Round Rock's percentage is 38.56%,
based on an ultimate capacity in the system of 40.8 million gallons per day (mgd). The regional system
will ultimately be constructed for a capacity of 106 mgd to be allocated between the Cities of Cedar
Park, Leander, and Round Rock.
