Effective September 1, 2001, Texas Local Government Code Section 271.113 allows cities to use certain
methods other than competitive bidding in entering into contracts for construction of facilities. One
such method is "Competitive Sealed Proposals." Section 271.114 (a) mandates that the "governing body
of an entity that is considering a construction contract using a method specified by Section 271.113 (a)
other than competitive bidding must, before advertising, determine which method provides the best
value for the government entity." With the existing competitive market staff feels that the "competitive
sealed proposal" would provide the best value for building this project.

Background Information:
On August 13, 2009, City Council entered into an Architectural/Engineering agreement with BGK
Architects for designing and engineering the Intermodal Transit and Parking Facility. The mixed use
Intermodal Transit and Parking Facility, which will be located in southwest downtown, will provide safe
and easy access to transit for motor vehicles, bicycle users, and pedestrians. The facility will also
provide public parking for the southwest downtown area, as well as the commercial, office/residential
shell space. The design will be consistent with the City's history and role in downtown Round Rock,
incorporating human—scale urban design and transit—oriented design and promoting a safe interface
between pedestrians, bicyclists, automobiles, and transit vehicles.
