R -10-07-22-10D3 WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering Services ("Contract") with Jacobs Engineering Group, Inc. for the Due Diligence Analysis for the BCRUA's Deep Water Intake Facility Site Project, and WHEREAS, Jacobs Engineering Group, Inc. has submitted Supplemental Contract No. 2 to the Contract to modify the provisions for the scope of services, and WHEREAS, the City Council desires to enter into said Supplemental Contract No. 2 with Jacobs Engineering Group, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Contract No. 2 to the Contract with Jacobs Engineering Group, Inc., a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. Furnish any existing data, maps, reports, plans, etc. that may pertain to the project as requested by the ENGINEER. 2. The Cities shall take the lead role in all environmental permitting efforts for this project. The ENGINEER and its subconsultant shall assist these efforts as directed by the Cities. This scope does not include effort for a Section 404 (Clean Water Act) Permit application or threatened and endangered species investigations. In the event this effoit is warranted, we will request this as Additional Services. 3. Although OWNER reviews and comments may be generated by members of each city, the OWNER will make an effort to consolidate commits before presenting to the ENGINEER. 4. To meet the proposed schedules all OWNER reviews shall be timely. 5. The Cities will take the lead role in all Public Relations / Public Involvement efforts for this project. The ENGINEER shall assist these efforts as directed by the Cities. ADDENDUM TO EXHIBIT B ENGINEERING SERVICES GENERAL The objective of this supplemental agreement is to perform Engineering Services to continue the due diligence analysis to identify a site for the BCRUA Phase 2 Deep Intake, Pump Station, and Pipeline. This scope of work will include further feasibility investigation of Alternative 8 as described in the Due Diligence Analysis of the BCRUA Deep Intake Final Draft Report dated April 21, 2010. The primary elements of this analysis include: • Coordination with regulatory agencies and land owners • Detailed feasibility analysis of constructing the pump station on Site 8 • Detailed feasibility analysis of constructing just a maintenance building and intake on/near Site 4. This information will supplement information previously obtained during the initial portion of the Due Diligence Study. Specific services included in this Supplemental Agreement No. 2 are described herein: SCOPE OF WORK A. Project Management & Stakeholder Coordination 1. External Stakeholder Meetings. Meet with regulatory, permitting agencies, and landowners (Travis County, LCRA, Village of Volente, etc.) along with BCRUA to discuss technical solutions, land requirements, impacts, and potential mitigation strategies related to each site. Includes a total of six (6) meetings and preparation of support materials limited to reproduction of existing exhibits, modifications to existing exhibits and layouts, modifications to cost estimates, general correspondence (ernails, phone calls, etc.), and limited field visits. 2. Internal BCRUA Meetings. Attend up to four (4) meetings with DOC, city managers, Board members, and/or the general manager. 3. Previous meetings performed. Meet with new board members to review background and status of BCRUA Regional Water System project and prepare one (1) presentation to Board on initial results of Due Diligence Study (previously performed). 4. Project Administration and Control. Manage overall scope, schedule, and budget of project and coordinate activities of sub -consultants. Coordinate with environmental and real estate professionals and provide supporting information as required. 1 B. Site 8 Pump Station As a part of the detailed feasibility analysis of Alternative 8, the following tasks shall be performed to further investigate the feasibility of locating the deep intake pump station facility at Site 8 located near the Cedar Park WTP: 1. Perform detailed layout of pump station, similar to layout previously generated for Site 4, to determine property required for purchase. 2. Generate up to four architectural renderings of the pump station. Renderings may be of Site 8, Site 4, or both, at BCRUA's request. 3. Evaluate requirements to take Cedar Park and LCRA (Leander) floating intake off-line if pump station is located at Site 8. 4. Update Alternative 8 costs generated in the initial Due Diligence Study based findings above. C. Site 4 Intake and Maintenance Building As a part of the detailed feasibility analysis of Alternative 8, the following tasks shall be performed to further investigate the layout of the maintenance building and intake at Site 4 located in near Bernard Street in the Village of Volente: 1. Identify exact intake buffer boundaries and coordinate with TCEQ to determine if a variance could be obtained to reduce the taking of waterfront property. 2. Coordinate with U.S. Army Corps of Engineers to determine what USACE 404 permit requirements would apply to screen opening size on the intake to determine if an air burst system is required. 3. Determine type of valve actuators required and subsequently what associated equipment is needed in the maintenance building. 4. Identify chemical feed requirements including chemical storage, piping, pumping, and feed points. 5. Perform detailed layout of maintenance building, chemical feed/air piping, and intake with approved buffer on Site 4 to determine property requirements and associated estimated purchase price. 6. Update Alternative 8 costs generated in the initial Due Diligence Study based findings above. D. Report and Presentations 1. Draft report - Update the Final Draft report for the Due Diligence Analysis for the BCRUA Deep Water Intake dated April 21, 2010 to include information generated from the scope of work described herein. Provide 15 copies of draft report for review. Conduct one (1) meeting with BCRUA DOC (in addition to above) to review report and receive comments. 2. Final report -- Incorporate comments from BCRUA DOC, city managers, Board, and general manager and produce 20 copies of final report. 3. Board presentation — prepare and present results of analysis at one (1) BCRUA Board meeting. 2 ADDITIONAL SERVICES The following Additional Services are NOT included in the Scope of Work and will not be performed unless specifically authorized by the Owner: A. General Support Services Provide additional technical support to BCRUA as required based on initial discussions with regulatory, permitting agencies, and landowners (Travis County, LORA, Village of Volente, etc.). This could include, but is not limited to, additional meetings, evaluation of multiple options for pump station and/or maintenance building layout, investigation of alternative intake layouts, additional architectural renderings, assistance with conducting public meeting(s), or evaluation of noise levels at the pump station site(s). CLARIFICATIONS AND EXCLUSIONS 1. The following services are NOT included in this scope of work: a. Environmental consulting by outside sub -consultants. It is our understanding that the environmental consultant will contract directly with the BCRUA. b. Surveying c. Geotechnical services d. Support for Texas Parks & Wildlife Chapter 26 Hearing required for taking of park property. e. Real estate acquisition and/or appraisal services. f. Public involvement other than preparing technical material and attendance at meetings as noted in the scope. g. Noise emissions evaluation to estimate probable pump station noise levels. h. Decision analysis model. 2. Presentation graphics for public meetings are limited to adaptations of graphics or figures prepared previously or as part of the above scope of work. Preparation of other, original materials inay be included in the study as an additional service. 3. It is assumed that the intake will be located at Site 4 as shown in the Due Diligence Analysis Final Draft Report dated 4/21/2010. Any deviations from this location or any evaluation of alternative Locations is not included in this scope of work. SCHEDULE 1. It is assumed that all services will be performed within a 120 day time period. Project Administration and Control. Manage overall scope, schedule, and budget of project and coordinate activities of sub -consultants. Coordinate with environmental and real estate professionals and provide supporting information as required. 1 B. Site 8 Pump Station As a part of the detailed feasibility analysis of Alternative 8, the following tasks shall be performed to further investigate the feasibility of locating the deep intake pump station facility at Site 8 located near the Cedar Park WTP: 1. Perform detailed layout of pump station, similar to layout previously generated for Site 4, to determine property required for purchase. 2. Generate up to four architectural renderings of the pump station. Renderings may be of Site 8, Site 4, or both, at BCRUA's request. 3. Evaluate requirements to take Cedar Park and LCRA (Leander) floating intake off-line if pump station is located at Site 8. 4. Update Alternative 8 costs generated in the initial Due Diligence Study based findings above. C. Site 4 Intake and Maintenance Building As a part of the detailed feasibility analysis of Alternative 8, the following tasks shall be performed to further investigate the layout of the maintenance building and intake at Site 4 located in near Bernard Street in the Village of Volente: 1. Identify exact intake buffer boundaries and coordinate with TCEQ to determine if a variance could be obtained to reduce the taking of waterfront property. 2. Coordinate with U.S. Army Corps of Engineers to determine what USACE 404 permit requirements would apply to screen opening size on the intake to determine if an air burst system is required. 3. Determine type of valve actuators required and subsequently what associated equipment is needed in the maintenance building. 4. Identify chemical feed requirements including chemical storage, piping, pumping, and feed points. 5. Perform detailed layout of maintenance building, chemical feed/air piping, and intake with approved buffer on Site 4 to determine property requirements and associated estimated purchase price. 6. Update Alternative 8 costs generated in the initial Due Diligence Study based findings above. D. Report and Presentations 1. Draft report - Update the Final Draft report for the Due Diligence Analysis for the BCRUA Deep Water Intake dated April 21, 2010 to include information generated from the scope of work described herein. Provide 15 copies of draft report for review. Conduct one (1) meeting with BCRUA DOC (in addition to above) to review report and receive comments. 2. Final report -- Incorporate comments from BCRUA DOC, city managers, Board, and general manager and produce 20 copies of final report. 3. Board presentation — prepare and present results of analysis at one (1) BCRUA Board meeting. 2 ADDITIONAL SERVICES The following Additional Services are NOT included in the Scope of Work and will not be performed unless specifically authorized by the Owner: A. General Support Services Provide additional technical support to BCRUA as required based on initial discussions with regulatory, permitting agencies, and landowners (Travis County, LCRA, Village of Valente, etc.). This could include, but is not limited to, additional meetings, evaluation of multiple options for pump station and/or maintenance building layout, investigation of alternative intake layouts, additional architectural renderings, assistance with conducting public meeting(s), or evaluation of noise levels at the pump station site(s). CLARIFICATIONS AND EXCLUSIONS 1. The following services are NOT included in this scope of work: a. Environmental consulting by outside sub -consultants. It is our understanding that the environmental consultant will contract directly with the BCRUA. b. Surveying c. Geotechnical services d. Support for Texas Parks & Wildlife Chapter 26 Hearing required for taking of park property. e. Real estate acquisition and/or appraisal services. f. Public involvement other than preparing technical material and attendance at meetings as noted in the scope. g. Noise emissions evaluation to estimate probable pump station noise levels. h. Decision analysis model. 2. Presentation graphics for public meetings are limited to adaptations of graphics or figures prepared previously or as part of the above scope of work. Preparation of other, original materials may be included in the study as an additional service. 3. It is assumed that the intake will be located at Site 4 as shown in the Due Diligence Analysis Final Draft Report dated 4/21/2010. Any deviations from this location or any evaluation of alternative locations is not included in this scope of work. SCHEDULE 1. It is assumed that all services will be performed within a 120 day time period.
