R-2014-1856 WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering Services ("Contract") with Atkins North America, Inc. for the Creek Bend Boulevard Project; and WHEREAS, Atkins North America, Inc. has submitted Supplemental Contract No. 7 to the Contract to modify the provisions for the scope of services; and WHEREAS, the City Council desires to enter into said Supplemental Contract No. 7 with Atkins North America, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Contract No. 7 to the Contract with Atkins North America, Inc., a copy of same being attached hereto as Exhibit"A" and incorporated herein for all purposes. ("Engineer") ADDRESS: 6504 Bridge Point Parkway, Suite 200,Austin, TX 78730 PROJECT: Creek Bend Boulevard This Supplemental Contract No. 7 to Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City" and Atkins North America, Inc., hereinafter called the"Engineer". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract", on the 26th day of January, 2012 for the Creek Bend Boulevard Project in the amount of$179,898.43; and • WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on July 12, 2012 to amend the scope of services and to increase the compensation by $805,808.42 to a total of $985,706.85; and WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on December 14, 2012 to amend the scope of services and to increase the compensation by$21,570.57 to a total of $1,007,277.42; and WHEREAS, the City and Engineer executed Supplemental Contract No. 3 on March 8, 2013 to amend the scope of services and to increase the compensation by $49,900.00 to a total of $1,057,177.42; and WHEREAS, the City and Engineer executed Supplemental Contract No. 4 on August 22, 2013 to amend the scope of services and to increase the compensation by $160,332.84 to a total of $1,217,510,26; and WHEREAS, the City and Engineer executed Supplemental Contract No. 5 on October 15, 2013 to amend the provisions for the scope of services; and WHEREAS,the City and Engineer executed Supplemental Contract No. 6 on March 13,2014 to amend the scope of services and to increase the compensation by $82,089.99 to a total of $1,299,600.25; and Supplemental Contract Rev.12/01/08 0119.7202; 00311551 84275 1 WHEREAS, it has become necessary to amend the Contract to modify the provisions for the scope of services and to increase the compensation by$186,383.73 to a total of$1,485,983.98; NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: I. Landscaping is to be added to the medians, lighting • will be extended to Sam Bass Road, and the existing fences along the right of way from Creek Bend Circle to Sam Bass Road will be replaced with a precast concrete fence. Creek Bend Boulevard will be milled and overlayed from Pena Cove to Sam Bass Road, Minor utility adjustments may be required. TASK 1: SURVEYING 1. Verify existing horizontal and vertical control. Inland will perpetuate the control to the northerly limits of the project and place benchmarks at 500' intervals within the corridor. 2. Supplemental topographic and planimetric mapping of the proposed corridor extended to Sam Bass Road. This will include mapping of existing curbs, pavements, visible and exposed utilities, structures, drainage facilities and other improvements that may affect design criteria. This task is considered as "topo lite"and Will be the minimum data acquisition necessary for DTM generation. TASK 2: ROUTE STUDY—Not Included with this Supplemental TASK 3: ENVIRONMENTAL STUDIES 1. Prepare up to two cave closure plans and coordinate approval with TCEQ. TASK 4: PRELIMINARY DESIGN/30% PLANS—Not Included with this Supplemental TASK 5: PROJECT MANAGEMENT 1. The plans will incorporate the plant palette provided by the City, in accordance with the Creek Bend Boulevard Landscape Enhancement Criteria. 2. Precast concrete fence plans for approximately 1,200 linear feet of precast concrete fence from Creek Bend Circle to Sam Bass Road, 3. Associated notes, details and specifications for the landscape, irrigation and precast concrete fence plans. 4. Construction cost for the planting, irrigation, and precast concrete fence. 5. Address one round of review comments from the City. TASK 14: CONSTRUCTION PHASE SERVICES 1. Attend monthly meetings with the City and the Contractor to appraise and answer general questions and provide clarification that pertains to the plans and construction of Creek Bend Boulevard. 1'age 2 of 4 2. Review shop drawings. Shop drawings will be reviewed based on the following procedures: • Review the drawings for conformity to the plans, specifications and special • provisions, as well as conformity to any subsidiary standards or criteria referred to by the plans, specifications or special provisions. • If the drawing is found to be in conformity, or an alternate design is adequate and acceptable, the drawing shall be marked "No Exceptions Taken" with signature, date and statement that "Review is only for general conformance with the design concept of the contract documents. Markings or comments shall not be construed as relieving the contractor from compliance with the project plans and specifications, nor departures there-from. The Contractor remains solely responsible for details and accuracy, for confirming and correlating all quantities and dimensions, for selecting fabrication processes, for techniques of assembly, for safety and for satisfactory performance of his work." • If there are only minor corrections, the incorrect information shall be crossed out and the correct information shall be written next to the crossed out information. All redlines shall be done in indelible red ink. The submittal shall be returned marked "Make Correction as Noted" and no re-submittal shall be required. • If the corrections are more significant and the Engineer does not concur with the information on the drawings, then the submittal shall be marked "Amend and Resubmit." The drawings must then be resubmitted for a second review. • If the drawings are found not to be in conformity, the drawings shall be marked "Rejected See Remarks." An explanation of why the submittal was disapproved shall be provided iii enough detail for the Contractor to be able to make the corrections for re-submittal. • A cover letter shall be returned with the reviewed drawings containing: (1) A description of the submittal (2) The status of the submittal (3) A listing of sheet numbers and titles reviewed (4) If the design reviewed was an alternate design, a notation declaring that an alternate design was presented and what criteria were used to determine if the alternate design is adequate and acceptable (5) If the submittal was not "accepted without exception" an explanation of the exceptions • Show drawings reviews include the following: (1) Prestressed Concrete Girder Sheets — Optional Design, Index, Bearing Pad, Erection Details, Fabrication Details, Standards, WWF Option (2) Retaining Wall Fabrication Details — Wall geometry, Casting details, connections, corner, inlet, coping, and TRF details. (3) Culvert/Manhole/Inlet/Concrete Fence Fabrication Details Page 3 of 4 3. Review forming details. Forming details will be reviewed based on the same procedures outlined in section for review and approval of shop drawings. Formwork review details include sheets for Bent 2 &3, Bent 4, and curved rail sheets. 4. Respond to up to 15 requests for information (RFIs) that will on average take 4 hours each to address. The engineer shall document each question in sufficient detail, formulate a response and submit a written version of the response to the State for distribution to all involved parties. 5. Provide minor redesign for up to 5 design changes (major redesign should be handled with a contract supplement). Minor redesign shall consist of anything anticipated to take less than 16 hours to complete. Anything anticipated to take more than 16 hours should be handled through a contract supplement. 6. Develop up to 5 change orders that will on average take 16 hours each to prepare. Change orders documents will be submitted to the City in electronic format. 7. Assemble as-built plans based upon redesign requests performed under Task 14 item 5. Two (2) hard copies and an electronic version of the final as-built plans wilt be submitted to the City upon project completion. DELIVERABLES 1. Up to two cave closure plans approved by TCEQ 2. Additional typical section, plan and profile, illumination, pavement marking and erosion control sheets necessary for 100%plans for extension of project to Sam Bass Rd. 3. Updated quantity sheets and project layout and benchmark location map for 100%plans for extension of project to Sam Bass Rd. 4. Landscaping, irrigation and precast concrete fence 100%PS&E. 5. Reviewed shop drawing and forming details, responses to RFIs, minor redesign plan revisions, constructability review responses, change orders and as-built plans.
