R -10-08-18-3A A RESOLUTION OF THE CITY OF ROUND ROCK, TEXAS, CALLING A SPECIAL ELECTION FOR NOVEMBER 2, 2010 FOR THE PURPOSE OF EXPANDING THE PURPOSES FOR WHICH PROCEEDS OF EXISTING SALES AND USE TAX MAY BE USED; DESIGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR EARLY VOTING AND ELECTION DAY VOTING; PROVIDING FOR PERFORMANCE OF REQUIRED ADMINISTRATIVE DUTIES; PROVIDING FOR CONDUCT OF THE ELECTION; CERTIFYING PROVISION OF REQUIRED ACCESSIBLE VOTING SYSTEMS AT EACH POLLING PLACE; AND PROVIDING FOR OTHER MATTERS RELATED TO SUCH ELECTION. THE STATE OF TEXAS COUNTIES OF TRAVIS AND WILLIAMSON CITY OF ROUND ROCK § § § § § § KNOW ALL BY THESE PRESENTS: WHEREAS, pursuant to an election held within the City of Round Rock, Texas (the "City") on August 9, 1997, the voters within the City approved the adoption of an additional sales and use tax within the City at the rate of one-half (1/2) of one percent as authorized by Section 4B, Article 5190.6 Vernon's Texas Civil Statutes; and WHEREAS, the proposition and ballot language approved by the voters restricted the use of such additional sales and use tax for streets, roads, drainage and other transportation system improvements including the payment of maintenance and operating expenses associated with such authorized projects (the "Existing Sales and Use Tax"); and WHEREAS, Section 4B, Article 5190.6 Vernon's Texas Civil Statutes has now been codified as Chapters 501 and 505, Texas Local Government Code (collectively, the "Act"); and WHEREAS, restricting the use of the Existing Sales and Use Tax only to City transportation system purposes has limited the ability of the City to encourage and promote 00200190.DOC economic development, recreational and community facilities, and other projects as authorized by the Act; and WHEREAS, the City Council now deems it to be in the best interest of the City to call an election pursuant to Section 505.2575 of the Act to expand the purposes for which the proceeds of the Existing Sales and Use Tax may be used to include all purposes authorized by the Act; and WHEREAS, the City Council has determined that November 2, 2010 is the appropriate date for holding such special election, and that date allows sufficient time to comply with requirements of law; and WHEREAS, the City Council wishes to encourage all registered voters in the City to vote in this election; and WHEREAS, it is hereby officially found and determined that the written public notice of the date, hour, place, purpose and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof where discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551 of the Texas Government Code (as amended); Now, therefore: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROUND ROCK, TEXAS THAT: Section 1. ELECTION DATE, PRECINCTS AND POLLING PLACES, AND ELECTION JUDGES. Joint Election. The City is located in more than one County and therefore the Williamson County Elections Administrator and Travis County Clerk are conducting the election pursuant to election agreements (the "Election Agreements") between the City and Williamson County and Travis County, respectively, as authorized under Section 31.092 of the Texas Election Code. The election shall be held as a joint election pursuant to Chapter 271 of the Texas Election Code and a joint election agreement to be entered into between the City and the 2 other participating entities located in Williamson County and Travis County, respectively, which are holding an election on November 2, 2010. Election Date. An election shall be held in the City as prescribed by applicable law between the hours of 7:00 A.M. and 7:00 P.M. on November 2, 2010. Precincts and Polling Places. The City election precincts and polling places within the City designated for holding the election shall be determined by Williamson County and Travis County, respectively, and conducted at the polling places used for the Williamson County General Election and Travis County General Election, respectively, which will be attached hereto as Exhibit "A" to this Resolution, and said exhibit is incorporated herein by reference for all purposes. Williamson County's and Travis County's election equipment, respectively, shall be used to conduct the election. Election Judges. The election judges shall be appointed in accordance with the Election Agreements and the Texas Election Code, as amended. For voters in Williamson County, the Williamson County Elections Administrator is conducting such election for the City pursuant to the terms of the Election Agreement. The City Council hereby appoints, for the term of such election, the presiding election judge(s) and alternate election judge(s) as being those designated by the Williamson County Elections Administrator. For voters in Travis County, the Travis County Clerk is conducting such election for the City pursuant to the terms of the Election Agreement. The City Council hereby appoints, for the term of such election, the presiding election judge(s) and alternate election judge(s) as being those designated by the Travis County Clerk. Section 2. ELECTION CLERKS. Unless otherwise directed by the respective County, the Presiding Judge shall appoint not less than two nor more than five resident qualified electors of the City to act as clerks to properly conduct the election. However, if the Presiding Judge appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks. The appointment of such clerks must include a person fluent in the Spanish language to serve as a clerk to render oral aid in the Spanish language to any voter desiring such aid at the polls on the Election Day. In the absence of the Presiding Judge, the Alternate Presiding Judge shall perform the duties of the Presiding Judge. Section 3. EARLY VOTING. Dates, Times, and Places for Early Voting. Early voting in the election by personal appearance shall be conducted at the dates, times, and polling places as provided for in the Williamson County General Election and the Travis County General Election, respectively, which will be attached hereto as Exhibit "B" to this Resolution, and said exhibit is incorporated herein by reference for all purposes. 3 Early Voting Clerk. For voters in Williamson County, the City Council hereby appoints the Williamson County Elections Administrator as the City of Round Rock Election Officer and Early Voting Clerk. The Early Voting Clerk's mailing address to which applications for ballots by mail may be sent, for voters residing in Williamson County, is as follows: Rick Barron Post Office Box 209 Georgetown, TX 78627 For voters in Travis County, the City Council hereby appoints the Travis County Clerk as the City of Round Rock Election Officer and Early Voting Clerk. The Early Voting Clerk's mailing address to which applications for ballots by mail may be sent, for voters residing in Travis County, is as follows: Gail Fisher 5501 Airport Road Austin, TX 78751 Applications for ballots by mail for must be received not later than 5:00 PM on October 26, 2010. Section 4. EARLY VOTING BALLOT BOARDS. Early voting ballot boards are hereby created to process early voting results, and the Presiding Judge of the boards will be appointed by the Williamson County Elections Administrator and Travis County Clerk, respectively. The Presiding Judge shall appoint not less than two nor more than eighteen resident qualified electors to serve as members of the Early Voting Ballot Boards. Section 5. VOTERS. All resident, qualified electors of the City of Round Rock, Texas shall be entitled to vote at the election. Section 6. CUSTODIAN OF ELECTION RECORDS. The Williamson County Elections Administrator and Travis County Clerk, respectively, shall serve as the custodian of voted ballots, and the City Secretary of Round Rock, Texas shall be appointed as custodian of all other election records. 4 Section 7. NOTICE. Posting. A substantial copy of this Resolution shall serve as a proper notice of the election. This Resolution, including a Spanish translation thereof, shall be posted on the bulletin board used by the City to post notices of meetings not less than twenty-one (21) days prior to the date the election is to be held, and shall remain posted through Election Day. Publication. A substantial copy of this Resolution shall serve as a proper notice of the election. This Resolution, including a Spanish translation thereof, shall be published in the Round Rock Leader, a newspaper of general circulation in the City, not earlier than the thirtieth (3 -U ) day or later than the tenth (10th) day before Election Day. Authorization to City Secretary. The City Secretary is hereby authorized and directed to publish and post the required notices in the manner and for the time periods required by law. Section 8. VOTING DEVICES. Electronic optical scan voting devices may be used in conducting the election. The Williamson County Elections Administrator and the Travis County Clerk, respectively, may also utilize a central counting station as provided by Section 127.000 et seq., as amended, Texas Election Code. Any central counting station presiding judge and the alternate presiding judge shall be appointed in accordance with the Election Agreement and the Texas Election Code. The Williamson County Elections Administrator and Travis County Clerk are currently using election systems and software certified by the Texas Secretary of State. The City Council of the City of Round Rock, Texas, finds as follows: Section 61.012, Texas Election Code, requires that at least one accessible voting station must be provided in each polling place used in a Texas election on or after January 1, 2006. Such system must comply with state and federal laws setting the requirements for voting systems that (i) fully comply with applicable laws relating to accessible voting systems which make voting accessible for disabled voters; and (ii) provide a practical and effective means for voters with physical disabilities to cast a secret ballot. The Office of the Texas Secretary of State has certified that the DRE - Election Systems and Software iVotronic is an accessible voting system that may legally be used in Texas elections. Sections 123.032 and 123.035, Texas Election Code, authorize the acquisition of voting systems by local political subdivisions and further mandate certain minimum requirements for contracts relating to the acquisition of such voting systems. For voters in Williamson County and for voters in Travis County, as chief elections officer for the City of Round Rock, the Williamson County Elections Administrator and Travis County Clerk shall provide at least one DRE - Election Systems and Software iVotronic in each polling place at every polling location used to conduct any election ordered on or after January 1, 2006. The DRE - Election Systems and Software iVotronic may be acquired by any legal means available to the City of Round Rock, including but not limited to lease or rental from Williamson County or Travis County or from 5 any other legal source, as authorized or required by Sections 123.032 and 123.035 of the Texas Election Code. Section 9. PROPOSITION. At the election, the following PROPOSITION shall be submitted in accordance with law: PROPOSITION Expand the purposes of the existing one half (1/z) of one percent Type B sales and use tax to authorize projects as described in Chapters 501 and 505, Texas Local Government Code, including but not limited to projects for the promotion of professional and amateur athletics and sports including stadiums, ball parks, auditoriums, projects related to entertainment, convention, tourist, and exhibition facilities, amphitheaters, concert halls, and public parks, park facilities and events, open space improvements, military facilities, including closed or realigned military bases, primary job training facilities for use by institutions of higher education, research and development facilities, regional or national corporate headquarters facilities, museums and related stores, restaurant, concession, and automobile parking facilities, related area transportation facilities, and related roads, streets, and water and sewer facilities, recycling facilities, and projects to promote new or expanded business enterprises that create or retain primary jobs, and public safety facilities, streets and roads, drainage, and related improvements, demolition of existing structures, development and expansion of affordable housing, and targeted infrastructure and any other improvements, expenditures, or facilities that are related to any of the above projects and any other project that the board determines will promote new or expanded business enterprises that create or retain primary jobs, and the maintenance and operation expenses for any of the above described projects as now or hereafter authorized by law. Section 10. OFFICIAL BALLOT. The official ballot for the election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "YES" or "NO" on the PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION EXPAND THE PURPOSES OF THE EXISTING TYPE B SALES AND USE TAX FOR THOSE AUTHORIZED PROJECTS AS DESCRIBED IN CHAPTERS 501 AND 505, TEXAS LOCAL GOVERNMENT CODE. YES ( ) SHALL THE ABOVE DESCRIBED PROPOSITION BE NO ( ) ADOPTED? 6 Section 11. CONDUCT ACCORDING TO TEXAS ELECTION CODE. In all substantive respects, the election shall be conducted in accordance with the Texas Election Code and any other applicable statutes. Section 12. ELECTION RESULTS. The Williamson County Elections Administrator and Travis County Clerk, respectively, shall conduct an unofficial tabulation of results after the closing of the polls on November 2, 2010. The official canvass and tabulation of the results of the Special Election shall be conducted by the City Council at a Special Council Meeting in accordance with the Election Code. Section 13. EXISTING SALES AND USE TAX. Should the proposition not be approved by the voters of the City, the Existing Sales and Use Tax shall continue to be levied in accordance with the August 9, 1997 election. Section 14. MISCELLANEOUS PROVISIONS. The provisions of this Resolution are severable; and in case any one or more of the provisions of this Resolution or the application thereof to any person or circumstance should be held to be invalid, unconstitutional, or ineffective as to any person or circumstance, the remainder of this Resolution nevertheless shall be valid, and the application of any such invalid provision to persons or circumstances other than those as to which it is held invalid shall not be affected thereby. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all in accordance with and as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended, and the Act.
