R -10-11-23-11B1 A RESOLUTION AMENDING "APPENDIX A: FEES, RATES AND CHARGES" TO THE CODE OF ORDINANCES, CITY OF ROUND ROCK, TEXAS, BY AMENDING CHAPTER 46 - ZONING TO PROVIDE A REDUCED FEE FOR PUD APPLICATIONS IN THE DOWNTOWN MASTER PLAN AREA. WHEREAS, the City wishes to establish a reduced application filing fee for PUD projects within the Downtown Master Plan area as an incentive for development/redevelopment within such area; Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That "Appendix A: Fees, Rates and Charges" to the Code of Ordinances, City of Round Rock, Texas, Chapter 46 - Zoning, is hereby amended to read as follows: CHAPTER 46 - ZONING Section Article II. Administration Division 3. Development Review Procedures Subiect Amount 46-92(c)(3)a. Zoning: Map amendment (rezoning) $750.00 Planned Unit Development (in Downtown Master Plan area only, as defined on Page 1 of the Downtown Master Plan adopted by Ordinance No. G -10-06-24-10A1) Planned Unit Development (in all areas outside of Downtown Master Plan area) Notes: $2,000.00 plus $200.00 times the number of acres or fraction thereof in excess of 1 acre, calculated on a pro rata basis. City Council Agenda Summary Sheet Agenda Caption: Consider a resolution amending "Appendix A: Fees, Rates, and Charges" to the Code of Ordinances to establish a reduced filing fee for Planned Unit Development (PUD) applications within the Downtown Master Plan Area. Meeting Date: November 23, 2010 Department: Planning and Community Development Staff Person making presentation: Peter Wysocki, AICP Planning and Community Development Director Item Summary: This resolution will establish a reduced PUD application filing fee of $300 dollars plus $1 per notified property owner for PUD projects within the Downtown Master Plan area. The reduced fee is intended to provide an incentive for development/redevelopment within the Downtown Master Plan area until alternative mixed-use zoning regulations are adopted that would allow similar flexibility as PUD (re)zoning — e.g. form based code. The concept of reducing the fee as a redevelopment incentive was recently discussed by the Council, although the Council did not specify the amount of reduction. The current fee for a PUD application is $2,000, plus $200 per acre or fraction thereof in excess of one acre, not to exceed a total fee of $5,000; plus a flat $300 newspaper notification fee ($150 for P and Z hearing and $150 for Council hearing) and $1 per each notified property owner (for envelopes and stamps). The two public hearing notices in the local newspaper and direct mailing of notices to property owners are required of all zone change applications, including PUDs. Essentially, the proposed reduced fee covers the City's direct cost of processing a PUD application and saves a potential project between $2000 and $5000, depending on size. In Tight of the Council adopting Resolution R-10-10-28-1081 at the October 28, 2010 Council meeting, which readopted fees pertaining to the code of ordinances (including zoning fees), it is necessary for the proposed fee reduction to be adopted by a resolution. Other fees such as building permit fees, and water and sewer connection fees are not proposed to be changed at this time.
