WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering
Services ("Contract") with PBS&J for the design of the extension of Creek Bend Boulevard from
Creek Bend Circle to Wyoming Springs Drive, and
WHEREAS, PBS&J has submitted Supplemental Contract No. 3 to the Contract to modify the
provisions for the scope of services and to increase the fees, and
WHEREAS, the City Council desires to enter into said Supplemental Contract No. 3 with
PBS&J, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental
Contract No. 3 to the Contract with PBS&J, a copy of same being attached hereto as Exhibit "A" and
incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of the date, hour, place and
subject of the meeting at which this Resolution was adopted was posted and that such meeting was
open to the public as required by law at all times during which this Resolution and the subject matter
hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act,
Chapter 551, Texas Government Code, as amended.

This Supplemental Contract No. 3 to Contract for Engineering Services is made by and between
the City of Round Rock, Texas, hereinafter called the "City" and PBS&J, hereinafter called the
"Engineer".
WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter
called the "Contract", on the 23rd day of November, 2004 for the Creek Bend Drive (from Creek
Bend Cir. to Wyoming Springs Dr.) Project in the amount of $728,000.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 1 on March 8, 2007 to
amend the scope of services and to increase the compensation by $181,127.00 to a total of
$909,127.00; and
WHEREAS, the City and Engineer executed Supplemental Contract No. 2 on June 12, 2008 to
amend the scope of services and to increase the compensation by $198,376.00 to a total of
$1,107,503.00; and
WHEREAS, it has become necessary to amend the Contract to modify the provisions for the
scope of services and to increase the compensation by $124,554.83 to a total of $1,232,057.83;
and
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:

forth in the attached Addendum To Exhibit B. Exhibit C. Work Schedule shall be amended as

ADDENDUM TO EXHIBIT B
Engineering Services
The changes to the scope of this project are as follows:
PHASE 2
The puipose of this scope of services is to outline the additional work to be completed by the
Engineer for the City of Round Rock's proposed Creek Bend Boulevard extension project
located in Williamson County, Texas. This Supplemental Work Authorization #3 expands the
previously approved Supplemental Work Authorization #2 scope of services and cost proposal
and includes the following services.
• Redeveloping and coordinating the right of entry (ROE) process to gain additional access
to the proposed right-of-way
• Preparing an Exception Request per TCEQ's recommendation
• Conducting trenching and excavation for archaeological resources
• Consulting with USFWS
• Cost estimating and scheduling
FC120 Ecological Investigation (Environmental Documentation)
A. Right of Entry (ROE)
The Engineer shall redevelop the ROE process to gain additional access to the
landowner's property for the purposes of conducting further environmental
investigations. The Engineer shall perform a site visit with landowner to identify karst
features and proposed trench cuts for cultural resources assessment.
1. General Environmental Coordination and Documentation associated with ROE
The Engineer shall communicate daily and shall follow the property access
communication plan. Unanticipated issues shall be documented, addressed and the
client must be notified. Other Activities are defined under: FC 160 Miscellaneous
Roadway.
B. TCEQ Confirmation (Exception Request)
The Engineer shall coordinate with TCEQ and develop a Protection Plan based on the
karst Survey.
1. Site Preparation of Karst Features
The Engineer shall prepare and excavate all features for visual inspection by TCEQ.

2. Respond to TCEQ and Revise Geologic Assessment
The Engineer shall prepare a response for all TCEQ recommendations and revise the
Geologic Assessment in order to maintain consistency within the environmental
documents.
3. Karst Feature field verification and TCEQ site visit
The Engineer and the City shall meet with TCEQ for an on-site inspection which will
include a brief description of each karst feature.
4. Meetings
The Engineer shall attend two (2) meetings with TCEQ in order to coordinate and
deliver the items requested by TCEQ.
5. Meeting Minutes
The Engineer shall document, summarize and distribute meeting minutes.
6. Restore Karst Features as per ROE
The Engineer shall restore all karst features back to previous condition as defined by
the property owner and approved by the City.
7. Exception Request
The Engineer shall develop an exception request and coordinate with the City and
TCEQ to obtain approval.
C. Phase 1 Cultural Resources Survey
The Engineer shall perform the cultural excavation procedure as defined by Texas
Historical Commission.
I. Field Survey and Trenching
The Engineer shall conduct additional trenching, hand excavation, and special
analysis associated with cultural deposits; including six (6) backhoe trenches (up to
50 feet long, 3 feet wide and 6 feet deep). The excavated soil and the trench walls
will be examined for evidence of intact cultural deposits or features. If evidence of
intact cultural deposits or features is encountered in the backhoe trenches, it will be
examined by controlled hand excavated units not exceeding 3.3 feet by 3.3.
2. Prepare the Archeological Investigation Report
All cultural material recovered from the hand excavation will be analyzed and results
of the investigation will be documented in a report which will be submitted to the
City and the Texas Historical Commission.
3. Respond to Comments
The Engineer shall respond to three (3) rounds of comments.

4. Finalize the Archeological Investigation Report
The Engineer shall update and finalize the archeological investigation report and
submit to the City and the Texas Historical Commission.
D. USFWS Consultation
The Engineer shall perforin Informal Consultation with USFWS; however, if
unacceptable by USFWS, then the Engineer shall move directly into formal consultation
which will include:
1. Informal / Formal Consultation
The Engineer shall coordinate with USFWS and prepare meeting materials for
informal/formal consultation of the project.
2. Meetings
The Engineer shall attend up to two (2) meetings with USFWS.
3. Meeting Summaries
The Engineer shall prepare and submit the meeting summaries documenting the result
of Informal/Formal Consultation.
FC121 Environmental Production
A. Environmental Documentation
The Engineer shall consolidate all existing environmental documentation and submit to
the City.
FC163 Miscellaneous Roadway
A. Miscellaneous Roadway Design and Support for Right of Entry
The Engineer shall redevelop, coordinate and provide oversight in order to obtain ROE
and complete the following activities:
1. Development of Exhibits for City of Round Rock
The Engineer shall develop and modify existing exhibits as directed by the City in
order to address to assist in providing additional documentation for the subrnittal of
the Environmental Documents and maintaining consistency with the Proposed Right
of Entry documentation.
2. Development of Exhibit for Property Owner
The Engineer shall develop a simplified exhibit which identifies the proposed
location of Karst Survey and Cultural Excavation activities associated with the Right
of Entry.

3. Development of Exhibits for TCEQ
The Engineer shall develop and modify existing exhibits as directed by the City in
order to address and document the Karst locations and details. These exhibits shall be
reviewed and modified according to the request of TCEQ and the City.
4. Development of Right of Entry Materials
The Engineer shall modify, update and implement a communication plan and entry
notification process. This plan and process shall include:
• Selection of the gate location and installation sign -in box and access
documentation
• Development of on-site rules and regulations
• Daily sign-in/sign-out procedures
• Develop a weekly activities and access work schedule
5. PM Coordination, Management, and Oversight of Right of Entry
• Access Coordination and Oversight: The Engineer shall coordinate the
selection of the gate location perform oversight of all staff and contractor's
access.
• Property Owner Coordination — The Engineer shall notify the Property owner
daily that all activities have ceased for the day, staff has left the premises and
the gate has been locked.
• Activities & Access Work Schedule - The Engineer shall provide the City of
Round Rock with an activities and access work schedule for the following
week's activities.
6. Support of On -Site Brush Removal
The Engineer shall remove all brush resulting from the Karst and/or Cultural
Excavation. The brush will be taken to an outside location and determined by the
City, where it is to be recycled and mulched.
7. Right -of -Way Map
The Engineer shall update the right-of-way map to reflect the elimination of parcel 1.
B. Miscellaneous Roadway Design Cost Estimating and Scheduling
The Engineer shall develop an evaluation for alternative methods of obtaining
environmental clearance.
1. Evaluation of Environmental Alternatives and Schedules
The Engineer shall evaluate up to 6 concepts that include timelines for comparing
federal vs. local processes.
2. Evaluation of Environmental Alternatives and Cost
The Engineer shall evaluate up to 6 concepts showing the project development cost
while comparing federal vs. local processes.

Item Summary:
Supplemental Contract No. 3 authorizes the Engineer to redevelop and coordinate right -of -entry to proposed right-
of-way, trench and excavate for archaeological resources, investigate water recharge features with the Texas
Commission on Environmental Quality (TCEQ) staff, prepare an exception request for TCEQ, consult with the U.S.
Fish and Wildlife regarding endangered species and update cost estimates and the schedule.
The extension of Creek Bend includes construction of a 4 -lane divided arterial roadway with curb and gutter, a
bridge over Brushy Creek, bicycle/pedestrian facilities within the right-of-way, drainage and adjustments to utilities.
This roadway extension will provide a new north -south crossing of Brushy Creek west of IH 35, which will improve
mobility, add travel capacity, improve safety by providing an all-weather crossing of Brushy Creek between IH 35 and
Parmer Lane and improve emergency response times. The project limits are Creek Bend Circle to Wyoming Springs
Drive.

Priority Goal 26.0 — Construct major elements of the transportation and mobility system as approved by Council in
the Master Transportation Plan.

ADDENDUM TO EXHIBIT B
Engineering Services
The changes to the scope of this project are as follows:
PHASE 2
The purpose of this scope of services is to outline the additional work to be completed by the
Engineer for the City of Round Rock's proposed Creek Bend Boulevard extension project
located in Williamson County, Texas. This Supplemental Work Authorization #3 expands the
previously approved Supplemental Work Authorization #2 scope of services and cost proposal
and includes the following services.
• Redeveloping and coordinating the right of entry (ROE) process to gain additional access
to the proposed right-of-way
• Preparing an Exception Request per TCEQ's recommendation
• Conducting trenching and excavation for archaeological resources
• Consulting with USFWS
• Cost estimating and scheduling
FC120 Ecological Investigation (Environmental Documentation)
A. Right of Entry (ROE)
The Engineer shall redevelop the ROE process to gain additional access to the
landowner's property for the purposes of conducting further environmental
investigations. The Engineer shall perform a site visit with landowner to identify karst
features and proposed trench cuts for cultural resources assessment.
1. General Environmental Coordination and Documentation associated with ROE
The Engineer shall communicate daily and shall follow the property access
communication plan. Unanticipated issues shall be documented, addressed and the
client must be notified. Other Activities are defined under: FC 160 Miscellaneous
Roadway.
B, TCEQ Confirmation (Exception Request)
The Engineer shall coordinate with TCEQ and develop a Protection Plan based on the
karst Survey.
1. Site Preparation of Karst Features
The Engineer shall prepare and excavate all features for visual inspection by TCEQ.

2. Respond to TCEQ and Revise Geologic Assessment
The Engineer shall prepare a response for all TCEQ recommendations and revise the
Geologic Assessment in order to maintain consistency within the environmental
documents.
3. Karst Feature field verification and TCEQ site visit
The Engineer and the City shall meet with TCEQ for an on-site inspection which will
include a brief description of each karst feature.
4. Meetings
The Engineer shall attend two (2) meetings with TCEQ in order to coordinate and
deliver the items requested by TCEQ.
5. Meeting Minutes
The Engineer shall document, summarize and distribute meeting minutes.
6. Restore Karst Features as per ROE
The Engineer shall restore all karst features back to previous condition as defined by
the property owner and approved by the City.
7. Exception Request
The Engineer shall develop an exception request and coordinate with the City and
TCEQ to obtain approval.
C. Phase 1 Cultural Resources Survey
The Engineer shall perform the cultural excavation procedure as defined by Texas
Historical Commission.
1. Field Survey and Trenching
The Engineer shall conduct additional trenching, hand excavation, and special
analysis associated with cultural deposits; including six (6) backhoe trenches (up to
50 feet long, 3 feet wide and 6 feet deep). The excavated soil and the trench walls
will be examined for evidence of intact cultural deposits or features. If evidence of
intact cultural deposits or features is encountered in the backhoe trenches, it will be
examined by controlled hand excavated units not exceeding 3.3 feet by 3.3.
2. Prepare the Archeological Investigation Report
All cultural material recovered from the hand excavation will be analyzed and results
of the investigation will be documented in a report which will be submitted to the
City and the Texas Historical Commission.
3. Respond to Comments
The Engineer shall respond to three (3) rounds of comments.

4. Finalize the Archeological Investigation Report
The Engineer shall update and finalize the archeological investigation report and
submit to the City and the Texas Historical Commission.
D. USFWS Consultation
The Engineer shall perform Informal Consultation with USFWS; however, if
unacceptable by USFWS, then the Engineer shall move directly into formal consultation
which will include:
1. Informal / Formal Consultation
The Engineer shall coordinate with USFWS and prepare meeting materials for
informal/formal consultation of the project.
2. Meetings
The Engineer shall attend up to two (2) meetings with USFWS.
3. Meeting Summaries
The Engineer shall prepare and submit the meeting summaries documenting the result
of Informal/Formal Consultation.
FC121 Environmental Production
A. Environmental Documentation
The Engineer shall consolidate all existing environmental documentation and submit to
the City.
FC163 Miscellaneous Roadway
A. Miscellaneous Roadway Design and Support for Right of Entry
The Engineer shall redevelop, coordinate and provide oversight in order to obtain ROE
and complete the following activities:
1. Development of Exhibits for City of Round Rock
The Engineer shall develop and modify existing exhibits as directed by the City in
order to address to assist in providing additional documentation for the submittal of
the Environmental Documents and maintaining consistency with the Proposed Right
of Entry documentation.
2. Development of Exhibit for Property Owner
The Engineer shall develop a simplified exhibit which identifies the proposed
location of Karst Survey and Cultural Excavation activities associated with the Right
of Entry.

3. Development of Exhibits for TCEQ
The Engineer shall develop and modify existing exhibits as directed by the City in
order to address and document the Karst locations and details. These exhibits shall be
reviewed and modified according to the request of TCEQ and the City.
4. Development of Right of Entry Materials
The Engineer shall modify, update and implement a communication plan and entry
notification process. This plan and process shall include;
• Selection of the gate location and installation sign -in box and access
documentation
• Development of on-site rules and regulations
• Daily sign-in/sign-out procedures
• Develop a weekly activities and access work schedule
5. PM Coordination, Management, and Oversight of Right of Entry
• Access Coordination and Oversight: The Engineer shall coordinate the
selection of the gate location perform oversight of all staff and contractor's
access.
• Property Owner Coordination — The Engineer shall notify the Property owner
daily that all activities have ceased for the day, staff has left the premises and
the gate has been locked.
• Activities & Access Work Schedule - The Engineer shall provide the City of
Round Rock with an activities and access work schedule for the following
week's activities.
6. Support of On -Site Brush Removal
The Engineer shall remove all brush resulting from the Karst and/or Cultural
Excavation. The brush will be taken to an outside location and determined by the
City, where it is to be recycled and mulched.
7. Right -of -Way Map
The Engineer shall update the right-of-way map to reflect the elimination of parcel 1.
B. Miscellaneous Roadway Design Cost Estimating and Scheduling
The Engineer shall develop an evaluation for alternative methods of obtaining
environmental clearance.
1. Evaluation of Environmental Alternatives and Schedules
The Engineer shall evaluate up to 6 concepts that include timelines for comparing
federal vs. local processes.
2. Evaluation of Environmental Alternatives and Cost
The Engineer shall evaluate up to 6 concepts showing the project development cost
while comparing federal vs. local processes.
