R -10-12-16-10A1 WHEREAS, the City of Round Rock ("City") has previously entered into a CDBG Program Grant Agreement, executed by the City on November 9, 2010, and by the Department of Urban Housing ("HUD") on October 7, 2010, and WHEREAS, the United States Office of Management and Budget ("OMB") requires all grant agreements executed on or after October 1, 2010 to include award terms established by the OMB, and said Agreement did not contain such award terms, and WHEREAS, the City Council desires to enter into an Amendment to the Agreement with the Department of Urban Housing to include the award terms established by the OMB, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City PY 2010 CDBG Program Grant Agreement Number B -10 -MC -48-0514 Amendment with the Department of Urban Housing, a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHITE, City Secretary O:\wdox\SCCluts\0112\ 1005\MUNICIPAL \00209218.DOChmc PY 2010 CDBG PROGRAM GRANT AGREEMENT NUMBER B -10 -MC -48-0514 AMENDMENT 4 EXHIBIT „A„ This AMENDMENT is made and entered into, by and between the Department of Urban Housing (HUD) and the CITY OF ROUND ROCK (GRANTEE), WHEREAS, HUD and the GRANTEE have entered into the CDBG Program Grant Agreement, executed by the GRANTEE on November 11, 2010, and by HUD on October 07, 2010 (GRANT AGREEMENT); WHEREAS, the United States Office of Management and Budget (OMB) has required all grant agreements executed on or after October 1, 2010 to include award terms, which set forth uniform requirements concerning the Duns and Bradstreet Data Universal Numbering System (DUNS), the Central Contractor Registration (CCR) database and the Federal Funding Accountability and Transparency Act; WHEREAS, said Grant Agreement did not contain the award terms established by OMB; WHEREAS, HUD and the GRANTEE now desire to amend the GRANT AGREEMENT in order to incorporate the award terms established by OMB; NOW, THEREFORE, in consideration of the promises and mutual covenants set forth in the GRANT AGREEMENT and in this AMENDMENT, HUD and the GRANTEE agree that the GRANT AGREEMENT is now amended to include the following provision, effective as of November 11, 2010. The Grantee shall comply with requirements established by the Office of Management and Budget (OMB) concerning the Dun and Bradstreet Data Universal Numbering System (DUNS), the Central Contractor Registration (CCR) database, and the Federal Funding Accountability and Transparency Act, as set forth in Appendix A to Part 25— Award Term, Financial Assistance Use of Universal Identifier and Central Contractor Registration, 75 Fed. Reg. 55671 (Sept. 14, 2010) (to be codified at 2 CFR part 25), and Appendix A to Part 170—Award Term, Requirements for Federal Funding Accountability and Transparency Act Implementation, 75 Fed.
