R -10-12-16-10F4 WHEREAS, the City of Round Rock ("City") prohibits the placement of signs in the public rights-of-way, and WHEREAS, the City recognizes that a need exists to direct prospective home buyers to "Open Houses" for existing homes offered for sale within the City, and WHEREAS, on June 24, 2004 by Resolution No. R -04-06-24-17E3, the City established a temporary program whereby realtors and homeowners were allowed to place Open House signs in specified locations in City rights-of-way for the sole purpose of directing prospective buyers to existing homes offered for sale, and WHEREAS, on December 2, 2004 by Resolution No. R -04-12-02-9F1, the Council extended the temporary program until December 31, 2005, and WHEREAS, on December 15, 2005 by Resolution No. R -05-12-15-9E2, the Council extended the temporary program until December 31, 2006, and WHEREAS, on December 21, 2006 by Resolution No. R -06-12-21-9B1, the Council extended the temporary program until December 31, 2007, and WHEREAS, on December 20, 2007 by Resolution No. R -07-12-20-9A1, the Council extended the temporary program until December 31, 2008, and WHEREAS, on December 18, 2008 by Resolution No. R -08-12-18-7D1, the Council extended the temporary program until December 31, 2010, and WHEREAS, the Council wishes to again extend the temporary program, and WHEREAS, the License Agreement for Open House Signs in City Rights -of -Way, which the Council approved on December 15, 2005 by Resolution No. R -05-12-15-9E2, will continue to be in effect, Now Therefore O:\wdox\SCClnts\0112\ 1005\MUNICIPAL\00209108.DOC/rmc BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That unless specifically extended by the City Council, this program and all license agreements entered into hereunder, shall expire on December 31, 2014. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. December 16, 2010 Department: Administration Staff Person making presentation: Sara White City Secretary Item Summary: The "Open House" sign permit program began in 2004, in response to the real estate community's request to allow "Open House" signs in certain city -owned rights-of-way. The City's sign ordinance is strictly enforced and no signs are permitted in the City owned rights-of-way, except for our new home kiosks. Realtors believe that due to the slow economy, limited access to the rights-of-way are necessary for re -sales to compete with new homes. In 2008, the program was extended for two years and will expire December 31, 2010. This resolution approves and extends the program to December 31, 2012.
