TEMPORARY CONSTRUCTION EASEMENT

KNOW ALL PERSONS BY THESE PRESENTS:
RECITALS:
A. By Waterline Easement effective September 20, 2001, recorded under Document No.
2001070693 in the Official Public Records of Williamson County, Texas (the "Waterline
Easement"), NNP-Teravista, L.P. granted to the City of Round Rock (the "City) perpetual, non-
exclusive easements for the construction, operation, maintenance, replacement, upgrade and repair of
a water line and associated improvements across twenty-five (25) foot strips of land within five (5)
tracts of land as more particularly described in the Waterline Easement.
B. In addition to the perpetual easements for the water line and associated improvements,
the Waterline Easement granted to the City a temporary construction easement 25 feet in width
adjacent to and adjoining the easterly line of the 25 -foot easement created across Tract 5 as more
particularly described on Exhibit "V' of the Waterline Easement (the "Temporary Construction
Easement").
C. The waterline and associated improvements have been constructed within the 25 -foot
easement across Tract 5 as described above, and the Temporary Construction Easement is no longer
necessary.
D. NNP-Teravista, LLC, a Texas limited liability company and formerly known as NNP-
Teravista, L.P., is the owner of the property through and across which the Temporary Construction
Easement is located and has requested the City to terminate and release the Temporary Construction
Easement.
NOW, THEREFORE, the City has terminated and released, and by these presents does
hereby terminate and release, the Temporary Construction Easement unto NNP-Teravista, LLC and
the subsequent owners of the property covered thereby, and does hereby confirm and declare that the
Temporary Construction Easement shall be of no further force and effect.

This is an application to terminate and release a temporary construction easement that was
part of a waterline easement executed in 2001 under Document No. 2001070693 for a
waterline that runs through Teravista. Included on Exhibit E of the original easement document
was a 25 -foot wide waterline easement on Williamson County Parcel R039939 and a 25 -foot
wide temporary construction easement on adjacent Parcel R395520. Typically, an easement
document would state the temporary construction easement would terminate upon completion
of the waterline construction. However, this was not the case for the temporary construction
easement.
This was discovered by the title company when the property owner attempted to sell the tract.
Even though this property is located within the Georgetown ETJ (Extraterritorial Jurisdiction),
the City of Round Rock was the Grantee for the waterline easement and is the party responsible
for processing the termination and release documents.
The City of Round Rock Utilities and Environmental Services Department has consented to the
proposed termination and release of the temporary construction easement.
